Q 1 - (D3 REQUEST: Consideration of an Ordinance Requiring New Development to Dedicate Electricity Utility Systems Within said Developments to the City of Palm Desert. SUBMITTED BY: Robert Kohn, Director of Special Programs DATE: June 12, 2003 CONTENTS: Ordinance No. 1050 Recommendation: Waive further reading of Ordinance 1050 and pass to second reading. Executive Summary: The City Council adopted Ordinance NO. 1048 establishing the Palm Desert Municipal Utility and Authorizing the City Manager to take all steps necessary to implement the same. In order for the City of Palm Desert to move forward with development of a Spot Municipal Utility serving the undeveloped North Sphere area it is necessary for developers/builders to dedicate the utility distribution systems over to the City of Palm Desert Municipal Utility. The attached ordinance is designed to make dedication of utility distribution systems a requirement of new developments within the designated spot municipal utility. Discussion: Staff has met with Enco Utility Services and determined that a spot municipal utility may be feasible in the North undeveloped area of the City. In order to take the next steps in planning and development of a spot utility the City needs to ensure that it has access and control of the distribution systems as they are installed. There are a number of other tasks/steps necessary prior to making any final commitment to formation of a spot municipal utility.
