SUBJECT: RIVERSIDE COUNTY WASTE RESOURCES MANAGEMENT DISTRICT'S (RCWRMD)
REDUCTION OF LANDFILL TIPPING FEE FROM $38.50 TO $30.00 PER TON
RECOMMENDATION
1. Waive further reading and adopt Resolution No 96-,56 authorizing the following:
A. Adoption of the new solid waste collection and residential recycling service rate
structure submitted by Waste Management of the Desert (Exhibit A); and
B. Rescind Resolution No. 94-56 pertaining to the RCWRMD's landfill tipping fee
increase and the solid waste collection and residential recycling service charge
increase, respectively; and
2. By minute motion:
Direct the City's franchised waste hauler, Waste Management of the Desert, to remit funds collected
under the RCWRMD's landfill tipping fee reduction to the City for deposit in a special fund entitled,
"Waste and Recycling Fee."
BACKGROUND
Solid Waste Collection and Residential Recycling Service Increase. On April 16, 1996, Waste Management
of the Desert (WMD) requested a service rate increase of.85 per cent (Exhibit B). The franchise agreement states
that WMD may request a rate increase once a year during the month of April to reflect ordinary changes in the
cost of doing business as measured by the Consumer Price Index (CPI),in the amount equal to 50%of CPI from
March to March in the Los Angeles area. The CPI for this year, in this area, is 1.7 per cent. Therefore, under
this provision WMD is entitled to a .85% "automatic" increase (see Exhibit A which reflects the rate increase).
Landfill Tipping Fee. The County of Riverside's Board of Supervisors has passed a resolution reducing the
landfill tipping fee from$38.50 to $30.00 per ton effective July 1, 1996 (Exhibit C). As a result of reducing the
tipping by 22%, the RCWRMD will reduce or eliminate funding from solid waste and recycling programs as
follows:

Specific programs targeted for reduction or elimination of funding includes:
• MRF/Transfer Station Development Fund--the Task Force investing all options for disposal of
all waste in the Coachella Valley. This fund supports a consultant and two Coachella Valley
Association of Governments (CVAG) staff members that prepare all documents and agendas for
the Task Force.
• AB 939 Program Fund — Numerous regional recycling and solid waste programs, including
Household Hazardous Waste, Christmas tree recycling,used oil recycling, composting workshops,
public education, grant administration, and mandatory reporting to the State. Funds two positions
at CVAG that are responsible for the regional implementation of these programs.
CVAG's Proposed Plan for Allocating the $8.50 Per Ton ,l
CVAG has developed a proposed plan for the continued funding and support of these programs by capturing
the $8.50 and replacing County programs with regional programs. Simply, trash rates will not be lowered in
accordance with the County's reduction in order for regional programs to be funded to replace County
programs.
Each city will contribute an amount equal to $8.50 multiplied by the its franchised hauler tonnage as reported
to the RCWRMD's tonnage tracking system. Each city must contribute to the regional fund in order for that
city's residents to benefit from regional programs. If a city fails to contribute to the regional fund, the city will
have to provide for and implement programs for their residents on their own. The following is an outline of
proposed programs that allocates the entire $8.50 per ton reduction:
$0.75 PER TON--HOUSEHOLD HAZARDOUS WASTE PROGRAM. Provides for biannual
collection events. A contractor will be utilized to conduct collection events and dispose of the
wastes.
$1.25 PER TON--AB 939 PROGRAM. CVAG Solid Waste and Recycling Program will provide
numerous solid waste and recycling programs including phone book recycling, used oil recycling,
Christmas tree recycling, composting workshops, coordination on regional and State solid waste
regulations, and coordination of a public education master calendar.
$3.00 PER TON--TRANSFER STATION DEVELOPMENTPROGRAM. With the impending
closure of the Coachella and Edom Hill Landfills, this program will continue to fund the planning
costs,land acquisition costs,financial advisor costs,up-front bond issuance costs,project management
costs, construction management costs, and staff costs of the Transfer Station/MRF Task Force.
$3.50 PER TON-- PRE-LEVELIZATION OF HAUL COSTS PROGRAM. The MRF/Transfer
Task Force has determined that levelizing haul costs once the Coachella Landfill closes and the East
Valley cities begin hauling to the Edom Hill landfill will result in the lowest possible transferring and
landfilling fees. This $3.50 per ton will fund the pre-levelized haul costs for the East Valley cities.
A final recommendation on pre-levelized haul costs will be made by the Transfer Station/MRF Task
Force and ratified by the cities participating in the construction and operation of the Transfer Station.

. , To date, staff is not able to de........ine the precise impact of RCWRMD's __ring fee reduction on the City of
Palm Desert. The County and CVAG member cities are not in agreement with RCWRMD as to the level of
service that may continue or may discontinue. Staff believes that the CVAG proposal for funding allocation is
satisfactory. However, at this time, it is difficult for staff to make a recommendation on the funding allocation
based on regional programs for the following reasons:
1. The scope and cost of a MRF/transfer station project can not be determined until each valley city
formally indicates whether it prefers a JPA for the management of its long term management of its
municipal solid waste stream;
2. A majority of proposed funding allocation is tied to a regional MRF/Transfer Station. The City
Council will not have the opportunity to review this plan and consider joining a Joint Powers
Association (JPA) until sometime in November;
3. A number of viewpoints exist between the County and CVAG regarding the current landfill system and
future disposal options. Over the next few months, the MRF/Transfer Task Force has been directed by
the CVAG Executive Committee to work on these issue and recommend options for referral to the
individual cities to assist with long range solid waste disposal and recycling planning and budgeting.
4. Staff believes that all these issues are tethered to one another and should be viewed as comprehensive.
However, all information is not available at this time due to individual jurisdiction exploring other
options versus a regional approach to municipal solid waste disposal. Each jurisdiction has the ability to
decide how to utilize the $8.50 tipping fee reduction and explore options for long range disposal options
according to direction of its city council. For example, the following is a current status on each
jurisdiction:
• Desert Hot Springs has elected to retain the $8.50 per ton tipping fee reduction
and to have its waste hauler develop and administer programs. As to the allocation of
Desert Hot Springs funds, staff does not know.
• Palm Springs is developing a solution of its own for the future waste disposal
needs. It is in the process of developing a facility that uses sludge and municipal solid
waste to produce compost that allows for an estimated 70%reduction from its current
landfill waste stream. It is Palm Springs intention to retain the $8.50 per ton tipping
fee reduction.
• La Quinta, Indian Wells, and Cathedral City have voted for the CVAG
proposed allocation of the $8.50 per ton tipping fee reduction.
• Rancho Mirage has not and does not know when it will bring the $8.50 per ton
tipping fee reduction before its City Council.
• Indio has indicated that it would like to design and construct a transfer station on
its own located at the eastern boundary of the Valley. It is currently working with
a firm, BLT Enterprises, that was eliminated by the evaluation process from the
CVAG MRf/Transfer Task Force due to the inability to submit accurate
information for evaluation.
• Coachella has not made its intentions known to CVAG when and if it plans to
present the $8.50 per ton tipping fee reduction to its council or what its
recommendation may be.

It is staff's recommendation that the City Council:
1. Ratify the .85% solid waste collection and residential recycling service increase requested by Waste
Management of the Desert as provided for in our franchise agreement;
2. Adopt the RCWRMD's landfill tipping fee surcharge reduction, retain the $8.50 per ton tipping
fee reduction and direct the funds to a special account entitled, "Waste and Recycling Fee;"
3. Increase commercial rates by .85 percent, and utilize a portion of the $8.50 per ton tipping fee
reduction so that residential customers do not receive an .85% rate increase;
4. Waive further reading and adopt the attached resolution setting the solid waste collection and
residential recycling service rates.
Staff will return to the City Council when it is able to make specific recommendations for the
allocation of the "Waste and Recycling Fee" fund.

RESOLUTION NO. 96-56
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AMENDING THE RATE SCHEDULE OF FEES FOR THE
COLLECTION, RECYCLING, AND DISPOSAL OF MUNICIPAL SOLID WASTE
AND RESIDENTIAL RECYCLING, RESCINDING RESOLUTION NO. 94-56.
WHEREAS, on the 13th day of July, 1995, the City Council of the City of Palm
Desert, California, authorized an exclusive contract with Waste Management of the Desert to
provide solid waste collection and residential recycling services; and
WHEREAS, the provisions of the franchise agreement allows Waste Management
of the Desert an annual rate increase equal to 50% of the Consumer Price Index (CPI) as
measured in the Los Angeles- Anaheim-Riverside area from March to March; and
WHEREAS, the CPI from March 1995 to March 1996 is 1.7% and Waste
Management of the Desert requested on April 16, 1996, an .85% increase for solid waste
collection and residential recycling services; and
WHEREAS, the Riverside County Waste Resources Management District
(RCWRMD) sets the landfill tipping fees; and
WHEREAS, RCWRMD has reduced the landfill tipping fee from $38.50 to $30.00
per ton, effective July 1, 1996.
NOW, THEREFORE, BE IT RESOLVED as follows:
SECTION 1: That the City Council of the City of Palm Desert, California, rescinds
Resolution No. 94-56 effective July 1, 1996.
SECTION 2: That the City Council of the City of Palm Desert, California,
effective July 1, 1996, ratifies the .85% solid waste collection and residential recycling service
increase requested by Waste Management of the Desert as provided for in our franchise
agreement.
SECTION 3: That the City Council of the City of Palm Desert, California,
effective July 1, 1996, ramifies the RCWRMD's landfill tipping fee surcharge reduction from
$38.50 to $30.00 per ton.
SECTION 4: That the City Council of the City of Palm Desert, California,
effective July 1, 1996, retains the $8.50 per ton tipping fee reduction and directs the funds to
a special account entitled, "Waste and Recycling Fee;"

SECTION 5: That the City Council of the City of Palm Desert, California,
effective July 1, 1996, increases commercial rates by .85 %, and utilizes a portion of the $8.50
per ton tipping fee reduction so that residential customers do not receive an .85 percent rate
increase;
SECTION 6: That Waste Management of the Desert shall notify its commercial
customers of the solid waste collection increase of .85% based upon their request for CPI
increase.
SECTION 7: That Waste Management of the Desert shall forward to the City on
a monthly basis an amount equal to $8.50 multiplied by the City's franchised hauler residential
garbage tonnage as reported to the RCWRMD Tonnage Tracking System.
SECTION 8: That Waste Management of the Desert shall forward to the City on
a monthly basis an amount equal to $8.50 multiplied by the City's franchised hauler
commercial and industrial (roll-off) garbage tonnage as reported to the RCWRMD Tonnage
Tracking System.
SECTION 9: That the schedule of solid waste collection and residential recycling
service rates and landfill tipping fee surcharge shall be in accordance with Exhibit A attached
hereto and made part hereof:

Dear Mr. Diaz,
Waste Management of the Desert respectfully requests a review of its service rates per
Section III.X. of the Franchise Agreement.
The March 1996 Consumer Price Index (CPI) from the U.S. Department of Labor,
Bureau of Labor Statistics indicates we experienced an inflation factor of 1.7% during the
past year. The contract allows us to seek 50% of this CPI increase, or .85%. This is the
increase in service rates that we are seeking.
In addition, Riverside County has announced a decrease in Iandfill fees from $38.50 to
$30.00 per ton for disposal. In order that we may develop a proposed rate structure for
1996-97, we request your direction on whether the landfill fee decrease should be passed
through to the customer or if it will be retained by the city.

9 Section 1. DEFINITIONS. The words used in this ordinance shall have
10 the definitions provided in Public Resources Code 40100 et. Seq.
11 Section 2. ESTABLISHMENT OF SITES. Subject to control of the
12 Board of Directors, the Chief Executive Officer of the Waste Resources
13 Management District may designate and operate or control by contract County
14 or District owned or leased or contracted sites to be used for the public transfer,
15 processing or disposal of solid waste.
16 Section 3. REFUSE FROM OUTSIDE OF COUNTY. Unless so
17 authorized in writing by the Chief Executive Officer of the District or his
18 designated representative, under general policies adopted by the Board, no person
• 19 shall place, deposit, or dump, or cause to be placed, deposited, or dumped, in or
20 upon any County or District owned, leased, or contracted transfer station or
21 disposal site, any solid waste originating outside of the County of Riverside.
22 Section 4. REGULATIONS. All County or District owned, leased, or
23 contracted transfer stations and disposal sites shall be under the supervision of the
24 Chief Executive Officer of the Waste Resources Management District who shall
25 have the power and the duty to prescribe reasonable regulations regulating the use
26 by the public and the operation of such sites. Such rules shall include, but need
27 not be limited to, the following subjects:

1 ' a. Days and hours of use.
2 b Charges for use of sites at times other than regular hours, which
3 shall be sufficient to reimburse the District for equipment, personnel
4 and overhead costs.
5 c. Maximum size of articles and objects being dumped.
6 d. Allocation of various types of waste to specific sites and the
7 I placement of waste within any site.
8 e. Prohibition or conditional acceptance of harmful or dangerous
9 materials, including a reasonable charge for their acceptance.
10 f. Prohibition of unauthorized persons from access to areas within a
11 site, including the unauthorized conducting of salvage operations.
12 Any regulation fixing days or hours of operation shall be submitted to the
13 Board of Directors for approval before taking effect. All regulations prescribed
14 by the Chief Executive Officer of the District shall be filed in his or her office and
15 shall be available for public inspection.
16 Section 5. SALVAGE OPERATIONS. Subject to the approval of the
17 Board of Directors, salvage operations of reusable waste materials at County or
18 District transfer stations and disposal sites may be conducted only by such
19 persons as are authorized to do so and upon such terms and conditions as are
20 imposed by the Chief Executive Officer of the District.
21 Section 6. FEES. Pursuant to the authority of Health and Safety Code
22 Sections 4741.7 and 5471, fees for the disposal of solid waste and disposal of
23 liquid waste at enumerated landfills shall be as established by the Board of
24 I Directors following a duly noticed public hearing. The fees so established shall
25 be in an amount sufficient to cover all costs including but not limited to the
26 following: closurelpostclosure (including past unfunded costs), remediation,
27 environmental mitigation, state mandated and other pass-through fees, and

1 general District operations. The Board of Directors may from time to time
2 establish different rates through contractual agreements when the terms of said
3 agreements help stabili?p system rates over a long term period. Fees and the
4 landfills to which they shall apply appear as Appendix A to this Ordinance.
5 Section 7. PROHIBITIONS. No person shall violate any regulation
6 prescribed by the Chief Executive Officer of the District regulating the use of a
7 County or District disposal site or transfer station, or fail to obey any sign giving
8 notice of any regulation, maintained at any such site or facility by the Chief
9 Executive Officer of the District. Violation of any such regulation shall be a
10 violation of this Ordinance.
11 Section 8. VIOLATIONS AND PENALTIES. It shall be unlawful for
12 any person to violate any provision of this Ordinance. Any person violating any
13 provision of this Ordinance shall be deemed guilty of an infraction or
14 misdemeanor as hereinafter specified. Such persons shall be deemed guilty of a
15 separate offense for each and every day or portion thereof during which any
16 violation of any of the provisions of this Ordinance is committed or continued.
17 Any person so convicted shall be: (1) guilty of an infraction offense and
18 punished by a fine not exceeding One Hundred dollars ($100,00) for a first
• 19 violation; (2) guilty of an infraction offense and punished by a fine not exceeding
20 Two Hundred dollars ($200.00) for a second violation. The third and any
21 additional violations shall constitute a misdemeanor offense and shall be
22 punishable by a fine not exceeding Five Hundred dollars ($500.00),
23 Notwithstanding the above, a first offense may be charged and prosecuted as a
24 . misdemeanor. Payment of any penalty herein shall not relieve a person from the
25 responsibility for correcting the violation.
26 Section 9, SEVERABILITY. If any provision, clause, sentence or
27 paragraph of this Ordinance (including its appendix) or the application thereof to
28

' 1 any person or circumstances shall be held invalid, such invalidity shall not affect
2 the other provisions or applications of the provisions of this Ordinance (and its
3 appendix) which can be given effect without the invalid provision or application,
4 and to this end, the provisions of this Ordinance (and its appendix) are hereby
5 declared to be severable.
6 Section 10. EFFECTIVE DATE. This Ordinance shall take effect 30
7 days after the date of adoption.

• The following gate fees will be applicable at Highgrove, El Sobrante, Mead
Valley, Badlands, Edom Hill, Lamb Canyon, Coachella, and Blythe Landfills
WASTE GROUP DESCRIPTIONS RATE
1. Any vehicle Hauling 2 or less large trash bags No Charge
2. Vans, pickup trucks or any vehicle pulling a two-wheel trailer or any other vehicle:
(a) hauling miscellaneous waste not exceeding .3 ton $5,001 load
(b) hauling miscellaneous waste exceeding .3 ton $30.00/ton •
3. Any vehicle hauling:
(a) wastes consisting exclusively of concrete, asphalt, stones and/or some dirt in
which no single piece of concrete, asphalt, or stone weighs more than 150 lbs.

Councilman Crites moved to: 1) Waive further reading and adopt Resolution No. 96-56 authorizing
the following: a) adoption of the new solid waste collection and residential recycling service rate structure
submitted by Waste Management of the Desert (Exhibit "A"); b) rescission of Resolution No. 94-56
pertaining to the RCWRMD's landfill tipping fee increase and the solid waste collection and residential
recycling service charge increase, respectively; 2) by Minute Motion, direct the City's franchised waste
hauler, Waste Management of the Desert, to remit funds collected under the RCWRMD's landfill tipping
fee reduction to the City for deposit in a special fund entitled "Waste and Recycling Fee". Motion was
seconded by Spiegel and carried by unanimous vote.
Councilman Crites moved to add a condition to instruct staff, as they continue to be part of the
MRF task force, to also investigate other transfer station/MRF options considered by other cities in the
Valley as well as considered by the County of Riverside. Motion was seconded by Spiegel and carried by
unanimous vote.

PLAN AT LINCOLN SCHOOL/PALM DESERT MIDDLE SCHOOL.
