In adopting the Resolution, the City Council directed that the Resolution be distributed to all cities in Southern California. Please bring the attached Resolution to the attention of the members of your City Council. Original on F.il 41.Lth City Clerk's Office SISTER CITIES Acambaro,Mexico General Administration 909/596-8726 • Water Customer Service 909/596-8744 • Parks & Community Services 909/596-8700 t"hmiadzm'Armenia Public Works 909/596-8741 • Finance 909/596-8716 • Planning 909/596-8706 • Building 909/596-8713 Fax 909/596-8737 RESOLUTION NO. 97-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA VERNE, 1 COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, EXPRESSING DISSATISFACTION AND DISAPPOINTMENT WITH THE RATE SETTING 2 POLICIES AND BUSINESS PRACTICES OF CENTURY CABLE TELEVISION 3 4 WHEREAS, on September 30, 1994, Citizens Century 5 Cable Television Venture ( "Century" ) purchased the cable television system serving the City of La Verne and there- 6 by became a party to a nonexclusive franchise agreement 7 scheduled to expire for October of the year 2000 and 8 were expected to be a positive community partner; and 9 WHEREAS, Century failed to meet this expectation 10 by providing a low level of channel selection; and 11 WHEREAS, Century further in May of 1996, failed 12 to provide appropriate community service and imposed a 13 25% rate increase upon subscribers in the City of 14 La Verne without an increase in channel offerings; and 15 WHEREAS, Century has announced that in May of 16 1997, another 4. 15% rate increase will be imposed upon 17 La Verne subscribers, a portion of which is intended to recover cost increases during the so-called "gap period" 18 between September 30, 1992, and March of 1994 -- a 19 period during which Century did not own the system; and 20 WHEREAS, Century has continuously failed to 21 maintain a state-of-the-art system for service delivery 22 in the City of La Verne with only 38 channels included 23 in the "second tier" offerings; and 24 WHEREAS, Century has refused to provide the City 25 of La Verne with a schedule for a system upgrade to be 26 compatible with neighboring cities served by Century; 27 NOW, THEREFORE, the City Council of the City of 28 La Verne hereby expresses its dissatisfaction and 29 disappointment with the greedy rate setting policies and unconcerned self-serving business practices of Century. 30 In La Verne, community partners are known for their deep 31 32 regard for La Verne citizens; but Century Cable seems 1 more satisfied with maximizing profit and minimizing service. 2 3 The Mayor shall sign and the City Clerk shall 4 certify to the passage and adoption of this Resolution of disdain for Century and, thereupon, the same shall 5 take effect and be in force. 6 7 APPROVED AND ADOPTED this 5th day of May, 1997. 8 9 ANONSUMENSTAFF 10 Mayor of the City of La Verne 11 ATTEST: 12 IS/N.KATHLEEN HAMM 13 City Clerk 14 15 • 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 RESO.NO. 97-43 -2- 32 STATE OF CALIFORNIA ) CITY CLERK'S CERTIFICATE COUNTY OF LOS ANGELES ) ss.
