alcohol at this event and at various events throughout FY 2019/2020 and FY
2020/2021. Staff is seeking a waiver from the Palm Desert Municipal Code to allow for
alcohol to be served at this event. Staff is also seeking approval for a waiver from the
Palm Desert Municipal Code for yet to be determined events hosted by the PDACC
throughout the balance of FY 2019/2020 and in FY 2020/2021, as reviewed on a case
by case basis by the City Manager.
Upon approval, PDACC will apply for all required permits and adhere to all regulations
stipulated by the City, the Police Department, and the California Department of
Alcoholic Beverage Control. Staff will work with PDACC and the City's Risk Manager to
ensure that all of the required insurances are in place prior to commencement of events.
This item is coming before the City Council as an Urgency Item because City staff just
learned of PDACC's intent to serve alcohol at its February 19, 2020 event. Recently
there have been significant staffing changes at PDACC, and the new staff was not
aware of the necessity for the City Council to waive the appropriate codes for
consumption of alcohol on City property.
Fiscal Analysis
There is no fiscal impact to the City associated with this request.

Thank YOU for making me aware of the approval process needed to have alcohol served on City Property.
Our first event happens on 2/19/2020, so we are respectfully requesting to be added (in an emergency
fashion) to your City Council agenda on Thursday, 2/13/2020. Thank you for your partnership in
accommodating the Palm Desert Area Chamber due to the time sensitivity of this request.
The Palm Desert Area Chamber of Commerce is requesting permission and approval to serve alcohol at
the Palm Desert Area Chamber Building location at 72559 Highway 111, Palm Desert, CA 92260 during our
February Block Party Mixer and BBQ networking event on 2/19/2020.
We hope we can garner your support for this event as well as the entire 2020 calendar year.

Chapter 9.58 PUBLIC DRINKING AND LIOUOR POSSESSION
9.58.010 Consumption of alcoholic beverages on public property.
No person shall drink, use or consume any alcoholic beverage, as defined in Section 23004 (and related sections) of
the Business and Professions Code of the state, upon any public street, sidewalk, highway, road, lane or alley, or in or
upon any other publicly owned property which is open to the use or the business of the public at the time, but which place
is not licensed for the consumption of such beverage on the premises. The provisions of this section shall not apply,
however, to the park and recreation area regulated elsewhere in this code. (Ord. 391 § 1, 1984)

Chanter 9.58 PUBLIC DRINKING AND LIQUOR POSSESSION
9.58.020 Possession of alcoholic beverages on_public property.
No person shall, in or upon any of the places listed in Section 9.58.010 of this chapter, have in possession any
alcoholic beverage defined as in Section 9.58.010 of this chapter contained in any bottle, can or other receptacle, which
has been partially removed; provided, that this section shall not apply when the beverage is in possession at the time
strictly for the purpose of transporting it, along with other items, briefly and temporarily and directly through a place
listed in Section 9.58.010 of this chapter. Further, this section shall not apply to park and recreation area, regulated
elsewhere in this code. (Ord. 391 § 1, 1984)
