Folkers, Assistant City Manager/Public Works Director SUBJECT: ANNUAL ASSESSMENT AND FORMATION OF LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 6 (MONTEREY MEADOWS) DATE: May 25, 1989 RECOMMENDATION: By minute motion: ( 1) Adopt Resolution No. 89-61 levying and collecting assessments for fiscal year 1989-90 for the subject assessment district. (2) Adopt Resolution No. 89-64 approving the formation of the subject assessment district. BACKGROUND: The formation of Landscaping and Lighting Assessment District No. 6 is a condition that has been placed upon the developer of Tract Nos. 21791 and 22741, more commonly known as Monterey Meadows. The assessment district will provide for the maintenance of the landscaping fronting Hovley Lane along both tracts and the four street lights serving forty single-family homes. The developer, David Germain, was conditioned to maintain the landscape and pay for the energy costs for the lighting until the formation of the assessment district. This landscape has been maintained for over a one-year period, and Public Works staff has inspected the landscape and found it to be in satisfactory condition. The Streets and Highways Code requires that a public hearing be conducted at the first City Council meeting in June for the purpose of levying the annual assessments for the assessment district formed under the Landscape and Lighting Act of 1972. The assessment for this tract pays for the energy and maintenance costs for the streets lights, landscape material , and utilities required for irrigation. RI H D J. FO S, P.E. WHEREAS, pursuant to Section 22620 of the Streets and Highways Code, it is the intent of the City Council of the City of Palm Desert, California, to establish the annual assessments for landscaping and lighting assessment districts. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: ( 1 ) That said City Council hereby declares its intent to levy and collect assessments within the assessment district for fiscal year 1989-90. (2) That existing improvements are not part of said assessment district and are described as follows: (a) Street lighting within Monterey Meadows. (b) Landscaping of planter areas along Hovley Lane, which consists of trees, ground cover, other landscaping, and automatic sprinkler systems. (3) That the existing assessment district is designated as Landscaping and Lighting Assessment District No. 6 and is generally located with boundaries as follows: Within the improvements created by Tract Nos. 21791 and 22741 . (4) That said City Council does hereby give notice that on Thursday, June 8, 1989, at 7:00 p.m. , at the regular session of the City Council of the City of Palm Desert a hearing will be held on the levy of assessments for fiscal 1989-90. Said Clerk of the City of Palm Desert is hereby ordered to give notice of said hearing in accordance with Section 22626 of the Streets and Highways Code. (3) The public ways to be lighted within district to be created are as follows: Clover Lane, Meadow Lane, Hovley Lane (4) That the engineer's report on file with the City Clerk and hereby designated as Attachment "A" and made a part hereof contains a full and detailed description of the improvements, the boundaries of the assessment district, the proposed assessments upon assessable lots, and parcels of land within said district and said report is hereby approved. (5) That said City Council does hereby give notice that on June 8, 1989, at 7:00 p.m., at the regular session of the City Council of the City of Palm Desert , a hearing will be held on the question of formation of said landscaping and lighting district and on the levy of the proposed assess- ments referred to in the above-mentioned engineering report. Said Clerk of the City of Palm Desert is hereby ordered to give notice of said hearing in accordance with Sections 22556 and 22588 of the Streets and Highways Code. The requirement for the construction and installation of landscaping, lighting and appurtenant facilities is a condition of development provided for in City's Subdivision Ordinance and is a requirement of issuance of a permit for construction of any commercial, industrial, and planned unit development. Landscaping and appurtenant facilities generally include trees, shrubs, plants, turf, and irrigation systems located in medians, parkways, and/or easements adjacent to public right-of-ways, in and along major thoroughfares and certain designated primary and secondary arterials as defined in the General Plan's Circulation Element. Lighting and appurtenant facilities includes poles, lighting fixtures, conduits and the necessary equipment to maintain, operate and replace a lighting system at designated intersections, in medians, parkways and adjacent to certain public facilities in and along certain streets, right-of-ways and designated lots. The installation of landscaping and lighting systems and the construction of the necessary appurtenant facilities is the responsibility of the property owner/applicant, triggered by the approval of a development application. The City may require the installation by property owners directly, or accept financial arrangements for installation of these facilities as provided for by the City's ordinances and regulations. The servicing, operation, maintenance, repair and replacement of the landscaping, lighting and appurtenant facilities in turn becomes the responsibility of the benefiting properties. The City now has several Landscaping and Lighting Assessment Districts and is accepting additional facilities with each subdivision and/or each development. Additional applications for parcels of land are being processed and the property owners/applicants petitioned for inclusion in the Landscaping and Lighting Assessment District. These applications are in various stages of processing, and when completed, will increase the City's obligation for maintenance and servicing. Further subdivisions and development is expected to add to this load. The City of Palm Desert is administering a lighting system for the benefit of all parcels of land within the City. -1- The lighting benefit is directly related to public safety and property protection. These benefits have been studied widely, locally, regionally and nationally, and are further referenced in the various reports listed at the end of this introduction. To insurea flow of funds for the ongoing maintenance and servicing to th e landscaping and lighting, the City is considering the formation of Assessment District 89-6 for Landscaping and Lighting Assessment District. The formation of this District will ensure a fair and equitable levying of the necessary costs of servicing and maintenance of the respective facilities, which in turn will enhance the value of each and every parcel in the District directly and collectively. The Proposed District boundaries of the Landscaping and Lighting Assessment District are the boundaries shown on the maps consisting of Tracts 21791 and 22741. Said plans and specifications are on file in the offices of the Superintendent of Streets and City Clerk. PART B An estimate of the cost of the proposed improvements, including incidental costs and expenses in connection herewith, is as set forth on the lists thereof, attached hereto, and are on file in the Office of the Clerk of the City. The Standard Number not attached, appeared to have been removed. (b) Between Lots 14 and 15 of said tract, designated as Standard No. 4025010E.
