Folkers, Assistant City Manager/Public Works Director SUBJECT: FISCAL YEAR 1990-91 ASSESSMENTS FOR ASSESSMENT DISTRICT NO. 2 DATE: July 26, 1990 RECOMMENDATION: Waive further reading and adopt Resolution No. 90-100 levying the fiscal year 1990-91 assessments for the subject district. BACKGROUND: This assessment district was formed under the Landscaping and Lighting Act of 1972, as outlined in the California Streets and Highways Code, and a public hearing is required at a regular Council meeting before August 10, 1990, to levy annual assessments. At the regular Council meeting of June 28, 1990, a resolution of intention to levy and collect assessments for the subject district was passed and a public hearing legally noticed for July 26, 1990 at 7:00 p.m. An Engineers Report, as required by the Streets and Highways Code, has been on file with the City Clerk and available for review prior to the public hearing. Exhibit "A" to the resolution lists the amount of the Fiscal Year 1990-91 assessment for each parcel within the district described in the Engineers Report. Public Works staff recommends adoption of Resolution No. 9 0-10n establishing the assessments, as listed on Exhibit A, for parcels within the subject. \6; (:: RICHA D J. FOLKS P.E. BACKGROUND This report is prepared for the City Council of the City of Palm Desert to be approved prior to the levy of annual assessments under the Landscaping an Lighting Act of 1972. The report is in compliance with the requirements of Article 4, Chapter 1 . Division 15 of the Streets and Highways Code, State of California. Before the recommended assessments can be confirmed by the City Council a public hearing must be held to allow public comments on the proposed assessments. The date for the hearing will be set by resolution of the City Council at which time the contents of this report will be discussed and approved. SECTION 2. PLANS AND SPECIFICATIONS The plans and specifications for the landscaping and irrigation improvements are on file in the City Public Works Department. The plans were prepared by the developer in accordance with the conditions of approval set forth by the City of Palm Desert. The area to be maintained is the landscaped area along the east side of Highway 74 and the north side of Haystack Road adjacent to Tract No. 11636, which consists of shade trees, shrubs, grass areas, and automatic sprinkler system. All amenities will be maintained on a regular basis. Maintenance includes the provision of services and materials for sustaining growth. harvesting plant material . cultivation or amendment of soil . trimming, pruning, spraying, fertilizing, or curing disease and the removal of dead or discarded material , rubbish, debris or other waste. Page 2 Landscape 8 Lighting SECTION 3. ESTIMATED COSTS. All street lighting and landscaping improvements currently exist within the boundaries of the district. The costs for FY 1990-91 will be for the maintenance of the existing improvements. SECTION 4. ASSESSMENTS The costs developed in Section 3 herein have to be adjusted to account for the contribution by the City. There are 222 parcels within the district; 220 parcels are assessed $63.00 per parcels and 2 parcels are assessed $126.00 per parcel . The maximum amount to be collected through the assessment is $14, 112.00. r Page 3 Landscape & Lighting SECTION 5. ASSESSMENT DIAGRAM A diagram for the Assessment District has been submitted to the City Clerk in the format required and is available for inspection at normal office hours. The lines and dimensions of each lot or parcel within the district are those lines and dimensions shown on the maps at the Assessor of Riverside County, California for the year in which this report was prepared and are incorporated by reference herein and made part of this report. SECTION 6. PROPERTY OWNERS LIST The property owners list with the names and addresses of each property owner of each lot or parcel as shown on the assessment diagram in Section 5 herein is the list of property owners shown on the last equalized tax roll of the Assessor of Riverside County, California and is by reference made part of this report. SECTION 7. ASSESSMENT ROLL The total assessment for FY 1990-91 will be $14, 112.00.
