CLUB

The attached letter from Ms . Cindy Finerty, President of the Desert
Breezes Casas Homeowners Association, and Charles Ash, President of
the Palm Desert Country Club Homeowners Association, request the
City to initiate a zone change .
The communication also outlines other requests .
Staff recommends that this matter be referred to staff for report
to Council at its first meeting of January.

Dear Mayor Snyder:
We request the City Council initiate rezoning of above referenced property(19.39 Acres in Por
SE 1/4 of Sec 13 T5S R6E) from R-1 9000 to R-1 20000. We support rezoning of above
referenced property (Parcels 1-85 in East 1/2 of Sec. 13, T5S, R6E, SBM) from R-1 9000 to
R-1 40000.
We further request the following:
1. A moratorium on any change of zone application or general plan amendment until
conclusion of the specific planning process.
2. Since property is subject to a specific plan, any application for development be
forwarded to the Project Area 4 Advisory Committee for specific recommendation.
3. No redevelopment projects, including any future application by Coachella Valley
Housing Coalition, be pursued without concurrence by the Project Area 4 Advisory
Committee.
4. This letter will confirm our verbal request of 11/18/95 that all Desert Breezes Casas
Homeowners and Palm Desert Country Club HOA be noticed for any further application
affecting above referenced property.
5. By copy to Mr. Drell, this will confirm that no staff report was completed on the
change of zoning request and proposed project by Coachella Valley Housing Coalition.

Dear Honorable Mayor and City Council:
We request the City Council initiate rezoning of above referenced property from R-1 9000 to
R-1 40000. Please see attached map.
We believe the following will show the intent was for R-1 40000 zoning.
A. Protective Covenants and Restrictions recorded April 9, 1956
1. Land Use and Building Type. "No parcel shall be used except for residential
purposes. No building shall be erected, altered, placed or permitted to remain on
any parcel other than(a) one detached single family dwelling not to exceed two
stories in height except on corner parcels and parcels 1 to 16 inclusive where there
may be two dwellings not to exceed two stories in height (b) a guest house not
to exceed two stories in height which may include sleeping and bathroom
facilities..."
B. Record of Survey dated September 21, 1955. Lots vary from a width of 138 to 157
feet. From a practical standpoint, it doesn't seem realistic to put four parcels on each
lot.
C. Riverside County Planning Department Staff Report dated September 17, 1986.
Page 1 Background "Tract Map No. 19803 is for a 172 unit residential development
on 21.7 acres. The change of zone request is for R-2-5000 on the subject property.
The current WCVP designation on the site, Residential Category 2A-MF (8-18
DU/AC), 2B (2-5 DU/AC) and 3A(.4-2 DU/AC), is not consistent with the proposed
tract and change of zone request." The reference of 3A(.4-2 DU/AC)indicates on
every acre 2 dwelling units are permitted or one unit per two acre lot.
D. Palm Desert Planning Commission Hearing Page 14. "Mr. Smith indicated that R-1
9000 zoning did not permit horses, but if the area was left one acre lots, which he felt
was the city's intention..."
This letter endorses and confirms our support for all requests in the December 1, 1995 letter to
the Palm Desert City Council from Cindy Finerty and Charles Ash.

3. Request: Amend the Western Coachella Valley Plans Land Use
Allocation Map of the Land Use Element from Residential
Category 2A-MF (8-18 DU/AC), 2B (2-5 DU/AC) and 3A
(.4-2 DU/AC), to Residential Category 2A (5-8 DU/AC) on
21.7± Acres.
4. Location: West side of Washington Street between Country Club
Drive and Fred Waring Drive in the Cathedral City-Palm
Desert Zoning District.
5. Letters: Caltrans 8/15/86 (see attached)
Coachella Valley Water District 8/7/86 (see attached)
County Road Department dated 9/9/86 (see attached)
BACKGROUND
County General Plan Amendment No. 62 is located on 21.7 acres on the west side
of Washington Street. Both Tract Map No. 19803 and Change of Zone 4438 are
filed on this subject property. The tract and change of zone request were
initially approved by Planning Commission and the East Area Planning Council ,
at which time several letters of opposition were received. The tract went
before the Board of Supervisors after the Western Coachella Valley Plan was
adopted. Both the tract and change of zone were continued off calendar until
which time a decision can be reached concerning this County General Plan
Amendment.
Tract Map No. 19803 is for a 172 unit residential development on 21.7± acres.
The change of zone request is for R-2-5000 on the subject property. The
current WCVP designation on the site, Residential Category 2A-MF (8-18 DU/AC).
2B (2-5 DU/AC) and 3A (.4-2 DU/AC), is not consistent with the proposed tract
and change of zone request.
ENVIRONMENTAL ASSESSMENT
Staff has prepared an Environmental Assessment (E.A. No. 19692) and has found
that CGPA No. 62 will not result in a significant impact on the environment.

were delayed because of economic viabilities, and the
property were to be annexed prior to construction, would
he have difficulty with Palm Desert. He felt the land
usage zonings should be investigated carefully to
comprehend all the aspects of the county zonings. He
also asked if he were to build prior to annexation if the
city would be difficult about the usage at that time.
Mr. Smith stated that Palm Desert would recognize the county
approval, assuming it were final when annexation took place
and it would run as long as it was good under the county and
Palm Desert would also look at any time extensions after
becoming part of the city, with no guarantee that the time
extension would be granted, but it would be reviewed. If the
building was constructed or under construction when the
annexation took place, Palm Desert would accept the county
approval and the use.
Mr. Garson asked how long it would take for the
annexation to occur if everything went positively.
Mr. Smith indicated that he would anticipate a hearing at
LAFCO in January next year if everything was fairly straight
forward and an added 60 days for the actual physical
annexation.
MR. JEFFRY PLACE, 77-776 Mountain View, stated that was
part of the possible study area mentioned. He stated
that he moved there ten years ago and he and his wife
moved there because they thought it was a nice rural area
because of the one acre lot sizes.
MR. HAL DURCHIN, 43-595 Calle Las Brisas in Desert
Breezes, stated that he was in support of the annexation
and all their residents support the annexation.
MS. PATRICIA OSBORN, building a home at 77-805 Delaware
Street, stated that she wanted the area to remain rural
and informed commission that she had horses and wanted
to know about the proposed R-1 9, 000 zoning.
Mr. Smith indicated that R-1 9, 000 zoning did not permit
horses, but if the area was left one acre lots, which he felt
was the city ' s intention, then through the study it would
likely be zoned rural estate lots, which was one acre lots
that would permit horses. Commissioner Richards clarified
that it was not Palm Desert ' s intention to change their way
of life, but hopefully improve it. He stated that if horses
