HomeMy WebLinkAboutFred Waring Drive Rezoning CITY OF PALM DESERT DEPARTMENT OF COMMUNITY DEVELOPMENT STAFF REPORT TO: City Council and City Manager FROM: Assistant City Manager/Director of Community Development DATE: March 16 , 1995 SUBJECT: Fred Waring Drive Council will recall that late last year at the request of residents fronting Fred Waring Drive from San Pascual to Deep Canyon, council instructed staff to meet with them to explore the possible rezoning of their properties . Council was concerned, however, that the opinions of those residents on the south side of Fred Waring Drive and those immediately adjacent to the north side residents be considered. A meeting was held; the attached report to council dated January 26, 1995 reflects the results of that meeting. In short, it was the general consensus of residents of the area that rezoning in and of itself would not mitigate their concerns . A series of alternative designs were suggested by residents to alleviate their concerns . A subsequent meeting was held, in the field, with Mayor Crites and myself with Fred Waring representatives . As outlined in Mr. Folkers March 23, 1995 report to council, Mr. Erik Larson submitted some alternative suggestions as the result of that meeting for evaluation. it is apparent that the suggested alternatives cannot be implemented. Prior to all of the above council did adopt an action holding widening of Fred Waring for 10 years . It was after that action that the rezoning issue was initially evaluated. If the alternative designs cannot be accomplished, council may wish to instruct staff to again meet with area residents and evaluate the rezoning issue with the purpose to process the change of zone if consensus from area residents is achieved. CITY OF PALM DESERT DEPARTMENT OF COMMUNITY DEVELOPMENT MEMORANDUM TO: City Manager and City Council FROM: Assistant City Manager/Director of Community Development DATE: January 26 , 1995 SUBJECT: Fred Waring Drive Rezoning On January 4 , 1995 a meeting was held between city staff and property owners along and in the vicinity of Fred Waring Drive. The purpose of the meeting was to discuss the potential rezoning to office professional (O. P . ) on the north and south sides of Fred Waring Drive from San Pascual to Deep Canyon. Currently, the properties on the north side of Fred Waring from San Pascual to Portola are zoned R-3 ; the properties from Portola to Deep Canyon are zoned R-1 . The south side of the street from Deep Canyon to Portola the properties are zoned R-1, and from Portola to San Pablo properties are zoned R-3 and O.P. Staff explained the pros and cons of rezoning. Property owners on the south side of Fred Waring generally felt that current zoning should be retained. However, the property owners felt that a uniform wall should be constructed to improve the street appearance and act as a noise buffer. Property owners on the north side of Fred Waring felt that some form of noise buffering to create a more "livable" environment would be preferable to rezoning the R-1 properties to office professional . In addition some property owners north of those abutting Fred Waring indicated some concern and dissatisfaction with rezoning the property. A suggestion was made that a noise wall be constructed along the north side of Fred Waring and a public access alley in back of that wall . Upon initial investigation by staff , it would appear that such a solution is not possible with the six lane thoroughfare . Staff will continue to look at solutions along the lines of this suggestion. Property owners along Fred Waring generally felt that something needed to be done . If there were no solution that would retain the single family land use, the property owners felt that if properties were rezoned, some modification of development requirements would be in order. The principal suggestion was that required Fred Waring street improvements be waived. At your January 26 meeting staff will present some alternative concepts for a noise attenuation buffer. CITY MANAGER/CITY COUNCIL FRED WARING REZONING JANUARY 26 , 1995 In the event that buffer cannot be feasibly developed, staff will proceed with the change of zones should be completed conduct public hearings May,commencing in March. The rezoning process In the event the wall concept has merit staff will present a follow up report to you in February. RAMON A.
