Folkers, Assistant City Manager/Public Works Director SUBJECT: ANNUAL ASSESSMENT FOR LANDSCAPE AND LIGHTING DISTRICT NO. 5 (COOK AND COUNTRY CLUB) DATE: May 28, 1992 RECOMMENDATION: By minute motion: 1. Approve the Engineer's Report for subject assessment district as filed. 2. Adopt Resolution No. 92-44 declaring the intent to levy and collect assessments for the fiscal year 1992-93 and setting the public hearing for subject assessment district. BACKGROUND: This district was formed under the Landscaping and Lighting Act of 1972 as outlined in the California Streets an Highways Code. Annually, each district is reviewed and an updated Engineer's Report is presented to the City Council for action and a resolution of intention is adopted to levy and collect assessments for the maintenance of the district improvements. The Engineer's Report includes specific information on the assessment district, plans and specifications, estimates of costs, a diagram of the district and an assessment of the estimated costs and improvements. This report is approved as filed or modified, and is the basis for the annual assessment and kept on file in the City Clerks office for review prior to the public hearing. Public Works staff recommends that the Engineer's Report be approved as filed and the adoption of the resolution setting the public hearing for this assessment district. RICHA 0 J. FOL S, P.E. BACKGROUND This report is prepared for the City Council of the City of Palm Desert to be approved prior to the levy of annual assessments under the Landscaping an Lighting Act of 1972. The report is in compliance with the requirements of Article 4, Chapter 1 , Division 15 of the Streets and Highways Code, State of California. Before the recommended assessments can be confirmed by the City Council a public hearing must be held to allow public comments on the proposed assessments. The date for the hearing will be set by resolution of the City Council at which time the contents of this report will be discussed and approved. SECTION 2. PLANS AND SPECIFICATIONS The improvements to this district consist of landscaped street medians and developed subdivision within the district that consist of landscaped parkways and /or street lighting. The street medians are: Country Club Drive - Cook Street east to Eldorado Drive. ** Country Club Drive - Cook Street west 3/4 mile. Frank Sinatra Drive - Cook Street east to Desert Falls Country Club entrance. Cook Street - Frank Sinatra Drive sout to Hovley Lane East. Hovley Lane East - Corporate Way west to Beacon Hill . Via Cinta - Hovley Lane East north to end. ** NOTE: this median section is maintained by Marriott Desert Springs. The landscaping includes trees, shrubs, ground cover, lighting and automatic sprinkler system. The subdivisions are: Tract 25639 (Desert Mirage) - The improvements consist of parkway landscaping and street lights (4) Tract 213398-1 (Sandcastle) - The improvement consist of street lights ( 11 ) . RESOLUTION NO. 92-44 Page 2 Engineer's Report #5 All amenities will be maintained on a regular basis. Maintenance includes the provision of services and materials for sustaining growth, cultivation or amendment of soil , trimming, pruning, spraying, fertilizing or curing disease and removal of dead or discarded mateial rubbish, debris or other waste. SECTION 3. ESTIMATED COSTS. All street lighting and landscaping improvements currently exist within the boundaries of the district. The costs for FY 1992-93 will be for the maintenance of the existing improvements. SECTION 4. ASSESSMENTS Individual assessments for street medians are distrubted on a proportional basis related to the percentage of street median adjacent to the property. Parcels within the industrial areas south of Hovley Lane East receive a benefit due to access to the street and are assessed $15.00 each. All parcels, within a subdivision that is maintained through the district, share equally in the benefit and cost. This direct cost will be added to any cost derived from the street median maintenance. The amount to be collected through assessment is $62,361 .00. SECTION 5. ASSESSMENT DIAGRAM A diagram for the Assessment District has been submitted to the City Clerk in the format required and is available for inspection at normal office hours. The lines and dimensions of each lot or parcel within the district are those lines and dimensions shown on the maps at the Assessor of Riverside County, California for the year in which this report was prepared and are incorporated by reference herein and made part of this report. SECTION 6. PROPERTY OWNERS LIST The property owners list with the names and addresses of each property owner of each lot or parcel as shown on the assessment diagram in Section 5 herein is the list of property owners shown on the last equalized tax roll of the Assessor of Riverside County, California and is by reference made part of this report.
