Folkers, Assistant City Manager/Public Works Director SUBJECT: FISCAL YEAR 1990-91 ASSESSMENTS FOR ASSESSMENT DISTRICT NO. 5 DATE: July 26, 1990 RECOMMENDATION: Waive further reading and adopt Resolution No. 90-98 levying the fiscal year 1990-91 assessments for the subject district. BACKGROUND: This assessment district was formed under the Landscaping and Lighting Act of 1972, as outlined in the California Streets and Highways Code, and a public hearing is required at a regular Council meeting before August 10, 1990, to levy annual assessments. At the regular Council meeting of June 28, 1990, a resolution of intention to levy and collect assessments for the subject district was passed and a public hearing legally noticed for July 26, 1990 at 7:00 p.m. An Engineers Report, as required by the Streets and Highways Code, has been on file with the City Clerk and available for review prior to the public hearing. Exhibit "A" to the resolution lists the amount of the Fiscal Year 1990-91 assessment for each parcel within the district described in the Engineers Report. Public Works staff recommends adoption of Resolution No. 90-98 establishing the assessments, as listed on Exhibit A, for parcels within the subject. RICHARD J. FOLKERS, .E. C—� Original on F, ,�. -�� wizn C:itY Clerk s Office CITY OF PALM DESERT ENGINEER'S REPORT FOR THE LEVY OF 1990-91 FISCAL YEAR ANNUAL ASSESSMENTS LANDSCAPING AND LIGHTING DISTRICT NO. 5 SECTION 1. BACKGROUND This report is prepared for the City Council of the City of Palm Desert to be approved prior to the levy of annual assessments under the Landscaping an Lighting Act of 1972. The report is in compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California. Before the recommended assessments can be confirmed by the City Council a public hearing must be held to allow public comments on the proposed assessments. The date for the hearing will be set by resolution of the City Council at which time the contents of this report will be discussed and approved. SECTION 2. PLANS AND SPECIFICATIONS The improvements to this district consist of landscaped street medians. The medians assessed are on Country Club Drive from Cook Street, one mile east, and on Cook Street from Country Club Drive one half mile south. Median sectins north and west from the Cook Street/Country Club Drive intersection are within the district. However, their maintenance is not charged to the district at this time. The landscaping includes trees, shrubs, ground cover, lightihng and automatic sprinkler system. All amenities will be maintained on a regular basis. Maintenance includes the provision of services and materials for sustaining growth, cultivation or amendment of soil, trimming, pruning, spraying, fertilizing, or curing disease and removal of dead or discarded material rubbish, debris or other waste. Page 2 Landscape & Lighting SECTION 3. ESTIMATED COSTS. All street lighting and landscaping improvements currently exist within the boundaries of the district. The costs for FY 1990-91 will be for the maintenance of the existing improvements. SECTION 4. ASSESSMENTS Individual assessments are distributed on a proportional basis related to the amount of median strip adjacent to the property. Parcles that are not adjacent to any median strip (the northwest of the Cook Street/Country Club Drive interestion) are assessed one dollar each. The maximum amount to be collected through assessment is $42,584.000. SECTION 5. ASSESSMENT DIAGRAM A diagram for the Assessment District has been submitted to the City Clerk in the format required and is available for inspection at normal office hours. The lines and dimensions of each lot or parcel within the district are those lines and dimensions shown on the maps at the Assessor of Riverside County, California for the year in which this report was prepared and are incorporated by reference herein and made part of this report. • SECTION 6. PROPERTY OWNERS LIST The property owners list with the names and addresses of each property owner of each lot or parcel as shown on the assessment diagram in Section 5 herein is the list of property owners shown on the last equalized tax roll of the Assessor of Riverside County, California and is by reference made part of this report.
