SUBJECT: ANNUAL ASSESSMENT FOR LANDSCAPING AND LIGHTING DISTRICT NO. 5
(COOK STREET/COUNTRY CLUB DRIVE MEDIANS)
DATE: May 25, 1989
RECOMMENDATION:
By minute motion, adopt Resolution No. 89-59 declaring the intent to levy
and collect assessments for fiscal year 1989-90 for the subject assessment
district and setting the annual public hearing for the district.
BACKGROUND:
This existing landscaping and lighting district encompasses the areas to the
northeast, northwest, southwest, and southeast of the intersections of Cook
Street and Country Club Drive. Included in the district are The Lakes, Desert
Falls Country Club, and the Marriott Desert Springs Resort.
On June 23, 1983, the City Council formed this assessment district and
levied the annual special assessment tax. In order to cover maintenance, water,
energy, and other costs associated with the district, the City Council must levy
assessments in fiscal year 1989-90. This levy must be made in the month of June,
as specified in the State of California Streets and Highways Code. The code
requires that public hearings for levying annual assessment districts be held at
the first regular Council meeting in June.
The assessments for this district pay for the maintenance of the landscaped
median strips on Cook Street and Country Club Drive. Charges for electricity,
water , irrigation, and lighting repairs and other associated expenses are
included in the assessed costs.
Public Works staff recommends adoption of the resolution setting the annual
public hearing for this assessment district.

A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, DECLARING ITS INTENT TO LEVY AND
COLLECT ASSESSMENTS WITHIN LANDSCAPING & LIGHTING ASSESSMENT
DISTRICT NO. 5 IN FISCAL YEAR 1989-90.
WHEREAS, pursuant to Section 22620 of the Streets and Highways Code, it
is the intent of the City Council of the City of Palm Desert, California, to
establish the annual assessments for landscaping and lighting assessment
districts.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
( 1 ) That said City Council hereby declares its intent to levy and
collect assessments within the assessment district for fiscal year
1989-90.
(2) That existing improvements are a part of said assessment district
and are described as follows:
Maintenance of an existing landscaped median strip including all
landscape materials, lighting system and water/sprinkler system.
(3) That the existing assessment district is designated as Landscaping
and Lighting Assessment District No. 5 and generally encompasses
the following areas:
The easterly 3,360 feet of the northerly one-half of Section 9;
the easterly one-half of Section 4; the westerly 3,300 feet of
Section 3; the northerly one-half of Section 10 in the City of
Palm Desert, County of Riverside, California.
(4) That said City Council does hereby give notice that on Thursday,
June 9, 1989, at 7:00 p.m. , at the regular session of the City
Council of the City of Palm Desert, a hearing will be held on the
levy of assessments for fiscal 1989-90. Said Clerk of the City of
Palm Desert is hereby ordered to give notice of said hearing in
accordance with Section 22626 of the Streets and Highways Code.
PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm
Desert, California, on this 25th day of May , 1989, by the following vote, to
wit:
