GIBSON,DIRECTOR OF FINANCE Subject: RESOLUTION APPROVING THE PAYMENT BY THE PALM DESERT REDEVELOPMENT AGENCY FOR THE IMPROVEMENTS TO FRED WARING DRIVE BETWEEN SAN PASCUAL AVENUE AND DEEP CANYON ROAD. Date: JUNE 22,2000 RECOMMENDATION: Staff recommends that the City Council, by minute motion, adopt Resolution No. 00-69 approving the payment by the Palm Desert Redevelopment Agency of all or part of the value of the land for and the cost of relocation, installation, design and construction of improvements to Fred Waring Drive between San Pascual Avenue and Deep Canyon Road. BACKGROUND: The Public Works Department has conducted an analysis in which it was determined that portions of Fred Waring Drive were operating at a level of service"D" or lower. It was also determined that portions of Fred Waring Drive would be operating at a level of service of"B" by the year 2003. The City has established"C" as its standard,meaning that the current and future traffic on Fred Waring exceeds the City's standards for a four-lane road. This project will improve traffic circulation within Project Area#1 and, thereby,mitigate congestion and safety hazards, all for the benefit of the health, safety and welfare of the residents and taxpayers of the Project Area. The proposed improvements will improve traffic circulation in Project Area#1 of the Agency by providing an alternative to Highway 111,thereby, diverting traffic form Highway 111 onto Fred Waring and relieving traffic congestion on Highway 111. The improvements will assist in the elimination of conditions of blight within the Project Area which are caused by inadequate public improvements. This project is, therefore, consistent with the goals and objectives of the project area. . Pursuant to provisions of the Community Redevelopment Law (California Health and Safety Code Section 33000, et seq. ) , and in particular Section 33445 thereof, the Palm Desert Redevelopment Agency (the "Agency" ) proposes to pay for all or a part of the value of the land for and the cost of the installation and construction of improvements to Fred Waring Drive . The proposed improvements to Fred Waring Drive include the widening of Fred Waring Drive between San Pascual Avenue and Deep Canyon Road from four lanes to six lanes, and the installation and construction of bike lanes, golf cart paths, sidewalks, landscaped parkways and medians (the "Improvements" ) . A needs analysis performed by the City of Palm Desert Public Works Department in 1999 found that portions of Fred Waring Drive were operating at a Level of Service ( "LOS" ) "D" or lower. The analysis also found that other portions of Fred Waring Drive that were operating at LOS "C" would likely decline to LOS "E" by the year 2003 . The City has established LOS "C" as its standard, meaning that current traffic on parts of Fred Waring Drive exceeds the City' s standards for a four lane road. The proposed Improvements are located in Project Area No. 1 of the Agency (the "Project Area" ) . The City Council has previously determined that the Project Area is an area in which the combination of conditions of blight is so prevalent and so substantial that it causes a reduction of, or lack of, proper utilization of the area to such an extent that it constitutes a serious physical , social and economic burden on the community which cannot reasonably be expected to be reversed or alleviated by private enterprise or governmental action, or both, without redevelopment . Among other things, the Project Area contains vacant and underutilized properties, properties which suffer from depreciated or stagnant property values, and deteriorated, aged and obsolete buildings . In addition, the Project Area is characterized by the existence of inadequate public improvements and public facilities, including inadequate circulation improvements which cannot be remedied by private or governmental action without redevelopment . Fred Waring Drive is a major east - west arterial in the City, which runs parallel to Highway 111 . The proposed Improvements will improve traffic circulation within the Project Area and thereby mitigate congestion and safety hazards, all for the benefit of the health, safety and welfare of the residents P6402\0001\604303.2 ' • • Resolution No. 00-69 and taxpayers of the Project Area . The widening of Fred Waring Drive will improve traffic circulation on Fred Waring Drive and also provide an alternative to Highway 111 (which is located in the Project Area) , thereby diverting traffic from Highway 111 onto Fred Waring Drive and relieving traffic congestion on Highway 111 . The proposed Improvements will thereby assist in the elimination of conditions of blight within the Project Area which are caused by inadequate public improvements . This in turn will assist in eliminating a factor which prevents or substantially hinders the economically viable use or capacity of buildings or lots and will encourage private-sector investment in the Project Area, thereby facilitating the redevelopment of the Project Area . Section 2 . The budget constraints of the City prevent the City from financing the Improvements by any means . No moneys of the City are available to pay for the cost of the Improvements . Traditional methods of financing such as the issuance of general obligation bonds are unavailable as a practical matter because of the extraordinary majority voter approval requirements of two-thirds of the electorate. Assessment financing or special tax financing could overburden benefitting properties with assessments or special taxes and, in addition, special taxes require a two-thirds vote and assessments are subject to a majority protest . Section 3 . The City Council hereby finds and determines that based upon the foregoing and other information presented to the City Council : (i) the Improvements are of benefit to the Project Area and the immediate neighborhood in which the project is located; (ii) the payment of funds for the acquisition of land and the cost of the Improvements will assist in the elimination of one or more blighting conditions inside the Project Area; (iii) the payment of funds for the acquisition of land and the cost of the Improvements is consistent with the Agency' s implementation plan adopted pursuant to Health and Safety Code Section 33490; and (iv) no other reasonable means of financing the Improvements is available to the City. Section 4 . The City Council hereby approves payment by the Agency for all or a part of the value of the land for and the cost of the installation and construction of the Improvements, including, but not limited to, the costs of installation and construction, environmental studies, design services, the acquisition of necessary rights-of-way, and relocation payments and replacement housing costs, from any revenues of the Agency lawfully available therefor. Any moneys paid initially by the City for the value of the land for and the cost of the Improvements will constitute loans of such moneys by the City to the Agency, and the Agency will repay such loans to the City, from time to time, upon demand of the City.
