Resolution No. 02- 56 Recommendation: Waive further reading and adopt Resolution No. 02- 56 establishing a policy that the operation of unregistered golf carts shall be allowed on all 25 miles per hour streets within Palm Desert Country Club. Background: The City of Palm Desert has a Golf Cart Transportation Program which allows and encourages the use of golf carts on public streets. The program requires that golf carts be registered by the City and that certain safety equipment be installed on the cart. As our program currently exists, golf carts driven on public streets within Palm Desert Country Club are required to be registered and conform to the safety requirements. The California Vehicle Code does provide that the City can, by ordinance or resolution, establish that the use of unregistered gold carts on public streets within one mile of a golf course is appropriate. Golf carts used within Palm Desert Country Club in conformance with such an ordinance or resolution would be exempted from the safety equipment requirements of the Golf Cart Transportation Program and they would be confined to operation within Palm Desert Country Club only. Since the purpose of the Golf Cart Transportation Program is to encourage the use of golf carts for transportation, it seems appropriate to allow this operation. Golf cart operation on any street with a speed limit greater that 25 MPH can only be allowed if the golf cart is registered in the Golf Cart Transportation Program, which requires the cart to be equipped with appropriate safety equipment. There are several streets within Palm Desert Country Club with speed limits greater than 25 MPH. WHEREAS, the City of Palm Desert has a Golf Cart Transportation Program; and WHEREAS, the City of Palm Desert encourages the use of golf carts on public streets; and WHEREAS, Palm Desert Country Club is the area bounded by Washington Street, Fred Waring Drive, Indian Wells City Limit and Hovley Lane East; and WHEREAS, golf carts have been operated on public streets in Palm Desert Country Club for many years; and WHEREAS, the use of unregistered golf carts on public streets within one mile of a golf course is allowed under the California Vehicle Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, that the operation of unregistered golf carts be allowed on all 25 miles per hour streets within Palm Desert Country Club, as shown on Exhibit A.
