RE: HEARING ON PROPOSED RESOLUTION OF NECESSITY - MONTEREY
AVENUE WIDENING PROJECT; PROJECT NO. 672-98
PROCEDURE
The City is considering a proposed resolution of necessity for the initiation of
condemnation proceedings to acquire certain real property needed for construction of the
Monterey Avenue Widening Project. A Project Description is attached as part of Exhibit"1"
hereto. The hearing is set for July 22, 1999, and a notice for this hearing was sent to the
owners on July 1, 1999. A copy of the Notice of Hearing and a Proof of Service of this
Notice is attached hereto as Exhibit "2". If a written request to appear at the hearing is
made, then the record owners must be allowed to speak. No one other than someone who
has an interest in the property is legally entitled to speak at the hearing. The only issues
to be addressed at the hearing are:
(a) Whether the public interest and necessity require the proposed project;
(b) Whether the proposed project is planned or located in a manner that will be
most compatible with the greatest public good and least private injury;
(c) Whether the real property described in the resolution is necessary for the
proposed project;
(d) Whether the required offer to purchase the real property has been made.
At the hearing, a representative of the City Engineering Department will describe
the Monterey Widening Project and explain why the City needs the property. Offers of just

compensation, based upon the appraised value of the property, have been made to the
owners and copies of those offers are attached as Exhibits "3(a)" through "3(d)". Each
of the four findings listed above should be fully discussed in the presentation. The City
Clerk should also note for the record the proofs of mailing of the notice of the hearing.
In the course of the public hearing, no members of the City should suggest that they
have prejudged the issue as to whether condemnation proceedings should be initiated.
The purpose of the hearing is to review that question and should be conducted in a way
that provides a full and fair hearing for the involved owners. It is not usually recommended
that those who do not have an interest in the property be allowed to speak at the hearing.
This is inadvisable because the purpose of the hearing is to give the owners an
opportunity to present their position as to whether or not condemnation should be initiated.
Any presentation by those who do not have an interest in the property may "dilute" the
presentations of those who do have such an interest. Nevertheless, it is a matter of
discretion to allow such persons to speak. If no one wishes to speak, the City may
proceed after hearing the staff reports.
After everyone has made their presentation, a vote should be taken as to whether
to adopt the resolution. (It is not recommended that the City Council go into closed
session to consider how to vote on the resolution.) The resolution will only be adopted if
two-thirds of the City Council vote to adopt it. That means that at least four members of
the City Council must vote in favor of the resolution for it to be adopted.
If the resolution is adopted, City counsel will initiate condemnation proceedings,
and, if so instructed, will attempt to obtain an order for immediate possession. If the City
instructs us to obtain an order for possession, then a deposit based upon the appraised

value of the real property will have to be made with the court. The deposit will "freeze" the
date of value for one year.
Attached to this memo as Exhibit "4" is a proposed Agenda for conducting the
meeting. This is simply a guide for the presiding officer at the hearing to know what steps
to follow in the course of the hearing.
The proposed Resolution of Necessity is attached to this report as Exhibit "5".
CALIFORNIA ENVIRONMENTAL QUALITY ACT COMPLIANCE
This eminent domain activity is a "project", subject to the California Environmental
Quality Act("CEQA"). Under CEQA, the City shall determine whether the project is exempt
from CEQA. (14 Cal. Administrative Code , Section 15061). Staff has determined and
recommends that the City Council find that this condemnation project is: (1) statutorily
exempt from CEQA because this project calls for re-striping of Monterey Avenue to relieve
traffic congestion (California Public Resources Code, Section 21080.19), and; (2)
categorically exempt from the CEQA because this project involves a minor alteration of an
existing public or private facility, involving the negligible expansion of use beyond that
existing now (California Administrative Code, Section 15301(c)). If the council finds that
this condemnation project is exempt from CEQA, staff will prepare a "notice of exemption"
containing the information required by California Administrative Code Section 15062 (a)
and staff will file the notice of exemption with the county clerk of Riverside County, as
provided by California Administrative Code Section 15062 (c) (2). A copy of the Notice of
Exemption is attached hereto as Exhibit "6".

AT THE HEARING ON RESOLUTION OF NECESSITY;
RECOMMENDATION FOR CITY ACTION
SUBJECT
Hearing on proposed resolution of necessity to acquire a portion of real property
owned as follows:
Lot 6, APN 627-061-010, William H. Nye and Shirley E. Nye, husband and wife;
Lot 5, APN 627-061-009, Donald M. Bolas, an unmarried man;
Lot 4, APN 627-061-008, Nancy Noel as Trustee of the Nancy Noel Living Trust;
Lot 3, APN 627-061-007, Myers Investment.
RECOMMENDED ACTION
That the City open a hearing to consider adoption of a resolution of necessity.
The City adopt a Resolution, declaring that the acquisition of the real property
interest by eminent domain is necessary for traffic and circulation purposes and making
certain determinations.
INTRODUCTION
The City is being asked by staff to consider the adoption of a Resolution of
Necessity declaring an intent to acquire through eminent domain proceedings four parcels
of property (hereinafter referred to as "the Properties")for purposes of widening Monterey
Avenue to the East. The description of the Properties to be acquired are attached hereto
as Exhibit "1-A". The Project is described on Exhibit "1-B".
Acquisition of the Properties will enable the City to eliminate a bottle-neck on
Monterey Avenue.

I.
THE PUBLIC INTEREST AND NECESSITY
REQUIRE THE PROPOSED PROJECT
The project is the widening of Monterey Avenue to the east. The project will have
numerous short term and long term economic and social benefits for the City including
better traffic accommodation and alignment of Monterey Avenue where it intersects with
San Gorgonio Road.
II.
THE PROPOSED PROJECT IS PLANNED OR
LOCATED IN A MANNER THAT WOULD BE MOST
COMPATIBLE WITH THE GREATEST PUBLIC GOOD AND
LEAST PRIVATE INJURY
The project will not result in dislocation of any individuals or businesses. The City
will relocate affected improvements, such as monument signs that are on the Properties.
The proposed project will improve traffic flows on Monterey Avenue.
III.
THE PROPERTY INTEREST SOUGHT TO BE ACQUIRED
IS NECESSARY FOR THE PROPOSED PROJECT
The Properties are necessary for the development of improved traffic circulation on
Monterey Avenue. The Properties are integral to the proposed realignment of Monterey
Avenue.

THE OFFER OF JUST COMPENSATION HAS BEEN MADE
On July 1, 1999, the City made offers of just compensation for the Properties based
on the fair market value of the Properties as indicated in the independent valuation
appraisal prepared by Rose Sweet of R. F. Sweet & Associates.

That the City adopt a Resolution of Necessity for the reasons stated above.

Project Description
The scope of the Project is to widen the north bound side (east half) of Monterey
Avenue from the north half of San Gorgonio Way to the BCR of the southeast curb
return of the southerly driveway into hacienda De Monterey The proposed widening is
approximately 400 lineal feet and will increase the traffic lanes from two lanes
northbound to three lanes northbound within the project limits. The new three traffic
lanes will tie into the existing three lanes to the north at the Hacienda De Monterey
driveway. The proposed widening will affect the first four parcels north of San
Gorgonio Way. Minor taking of these parcels will be required to proceed with the
proposed widening.
Monterey Avenue is three lanes wide (northbound) from Highway 111 to San
Gorgonio, becomes only to lanes wide where the project is located, and then returns to
three lanes in width to the north of the project. If this project is approved, the city will
acquire a triangular parcel of property from four parcels on the east side of Monterey,
sufficient to eliminate this bottle-neck and make Monterey Avenue three lanes wide
from Highway 111 to Fred Waring Drive. Traffic congestion will be reduced. Air quality
will be improved, because drivers will experience less waiting time at the San
Gorgonio and Highway 111 intersections. Traffic capacity or volume on Monterey
Avenue, however, will not be increased. The maximum "take" is eight feet on the
southernmost portion of the project and reduces down to zero feet at the north portion
of the project. Access to Monterey Avenue will not be affected. Signs and other
improvements, such as planters, will be relocated. Realigned Monterey Avenue will
then be pre-striped to relieve traffic congestion."

Pursuant to Section 1245.235 of the California Code of Civil Procedure, you are
hereby notified that at an adjourned meeting of the Palm Desert City Council to be held at
3:00 p.m. on July 22, 1999 at 73-510 Fred Waring Drive, Palm Desert, California, the City
of Palm Desert intends to consider adopting a Resolution of Necessity authorizing the
commencement of an eminent domain proceeding for the acquisition, in fee, for public use
of certain property (the "Property") which. according to the last equalized county
assessment roll, is owned by you. The public use for which the Property is being taken
is for the widening of Monterey Avenue to the East to accommodate traffic volumes and
to align the South and North intersections of Monterey Avenue and San Gorgonio Way.
The legal description of the Property to be acquired is attached as Exhibit"A"to this
notice.
A hearing will be held at the time and place mentioned above. You have the right
to appear and be heard on the following matters:
1. Whether the public interest and necessity require the project for which the
Property is sought to be acquired.
2. Whether the project is planned or located in the manner that will be most
compatible with the greatest public good and least private injury.
3. Whether the Property is necessary for the proposed project.
4. Whether the offer required by Section 7267.2 of the California Government
Code has been made.

Description Of Property Proposed To Be Acquired
A copy of the legal description and map are attached hereto as Exhibit "A".
Offer
The City offers to purchase the property described on Exhibit "A" for Eight Thousand Six
Hundred Twenty Five Dollars($8,625.00), the amount shown on the enclosed Written Offer of Just
Compensation form. The compensation will be paid after title to the property is vested with the City,
free and clear of existing trust deeds. The amount offered is the full amount which the City believes
to be just compensation for the property to be taken. The amount offered is not less than the
approved appraisal of the fair market value of the property proposed to be purchased. The amount
offered does not include any increase or decrease in the value of the property caused by public
improvements for which the property is being acquired. The amount offered does not reflect or
include any relocation assistance or payments or other benefits. The City will also relocate any
planters and/or monument signs affected by the project.
Please respond to this offer on or before July 21, 1999 by 5:00 p.m. If you decide to accept
the City's Written Offer of Just Compensation, please execute the Grant Deed previously provided
to you before a notary public and return it,together with signed copies of the Claim for Payment that

The City offers to purchase the property described on Exhibit "A" for Seven Thousand Five
Hundred Ninety Dollars ($7,590.00), the amount shown on the enclosed Written Offer of Just
Compensation form. The compensation will be paid after title to the property is vested with the City,
free and clear of existing trust deeds. The amount offered is the full amount which the City believes
to be just compensation for the property to be taken. The amount offered is not less than the

Public Use For Which The Property Is Sought To Be Purchased
The property is sought to be purchased for the widening of Monterey Avenue, to the East.

Rose Sweet, R. F. Sweet & Associates, 73-241 Highway 111,
Suite 3D, Palm Desert, California, 92260, has been retained by
plaintiff City of Palm Desert in the above action. Her opinion
of the value of the parcel of property described in the complaint
and, under Government Code §7267 . 2 (a) , is as follows :

2 . Legal Description of Fee Property Being Taken.
Fee described on the attached Exhibit "A" .

foot, times 28 square feet, for a total value of $504 . 00 . The
fair rental value of the temporary construction easement is $18
per square foot, times 600 square feet, times 100, divided by 12
months, times 2 months, for a total rental value of $180 . 00 . The
total just compensation is $684 . 00 .
4 . Basis of Amount Established as Just Compensation.

A RESOLUTION OF THE CITY OF PALM DESERT
DECLARING THAT THE ACQUISITION OF CERTAIN REAL
PROPERTY BY EMINENT DOMAIN IS NECESSARY FOR
WIDENING OF MONTEREY AVENUE
WHEREAS, the City of Palm Desert (the "City") proposes to acquire certain real
property legally described in Exhibit "A" attached hereto, in the City of Palm Desert for
purposes of widening Monterey Avenue pursuant to the authority granted to it by
Government Code Section 37350.5; and
WHEREAS, pursuant to Code of Civil Procedure Section 1245.235, the City
scheduled a public hearing for July 22, 1999, at 3.00 p.m., at the City Council Chambers,
located at 73510 Fred Waring in Palm Desert, California, and gave to each person who
owns an interest in the properties to be acquired and whose names and addresses
appeared on the last equalized county assessment roll, notice and a reasonable
opportunity to appear at said hearing and be heard on the matters referred to in Code of
Civil Procedure Section 1240.030; and
WHEREAS, said hearing has been held by the City and each person who owns an
interest in the properties to be acquired by eminent domain was afforded an opportunity
to be heard on said matters; and
WHEREAS, the City may now adopt a Resolution of Necessity pursuant to Code
of Civil Procedure Section 1245.030;
NOW, THEREFORE, THE CITY OF PALM DESERT RESOLVES AND DECLARES
AS FOLLOWS:

Section 1. Compliance with Code of Civil Procedure. There has been
compliance by the City with the requirements of Code of Civil Procedure Section 1245.235
regarding notice and hearing.
Section 2. Public Use. The public use for which the real properties to be
acquired is the widening of Monterey Avenue. Section 37350.5 of the California
Government Code authorizes the City to acquire by eminent domain property necessary
for such purposes.
Section 3. Description of Property. Attached and marked as Exhibit "A" is
the legal description of the real properties to be acquired by the City. Exhibit"A"describes
the general location and extent of the properties to be taken with sufficient detail for
reasonable identification.
Section 4. Findings. The City hereby finds and determines each of the
following:
A. The public interest and necessity require the proposed project;
B. The proposed project is planned or located in a manner that will be most
compatible with the greatest public good and least private injury;
C. The real properties described in the attached Exhibit "A" are necessary for
the proposed project; and
D. The offers required by Section 7267.2 of the California Government Code
has been made.
Section 5. Some or all of the properties to be acquired by the City may be
subject to easements and rights-of-way appropriated to existing public uses. The legal
descriptions of any such easements and rights-of-way are on file with the City which
descriptions describe the general location and extent of the easements and rights-of-way

with sufficient detail for reasonable identification. Pursuant to Section 1240.610 of the
Code of Civil Procedure, the City finds and determines that the herein described use or
uses are more necessary than said existing public uses. In the event the herein described
use or uses will not reasonably interfere with or impair the continuance of any said public
use as it then exists or may reasonably be expected to exist in the future, counsel for the
City is authorized to acquire the properties subject to such existing public use, pursuant
to Section 1240.510 of the Code of Civil Procedure.
Section 6. Further Activities. Legal Counsel for the City is hereby authorized
to acquire the hereinabove described real properties in the name of and on behalf of the
City, by eminent domain, and legal counsel is authorized to institute and prosecute such
legal proceedings as may be required in connection therewith. Legal counsel is further
authorized to take such steps as they may be authorized and required by law to take, and
to make such security deposits as may be required by order of court, to permit the City to
take possession of and use said real properties at the earliest possible time. Legal
counsel is further authorized to make or agree to non-material changes in the legal
description of the real properties that are deemed necessary for the conduct of the
condemnation action or other proceedings or transaction required to acquire the subject
real properties.
Section 7. Effective Date. This Resolution shall take effect upon adoption.

NOTICE OF EXEMPTION

3. Description of nature, purpose, and beneficiaries of project:
Monterey Avenue is three lanes wide (northbound) from Highway 111 to San
Gorgonio, becomes only two lanes wide where the project is located, and then
returns to three lanes in width to the north of the project. If this project is
approved, the city will acquire a triangular parcel of property from four parcels
on the east side of Monterey, sufficient to eliminate this bottle-neck and make
Monterey Avenue three lanes wide from Highway 111 to Fred Waring Drive.
Traffic congestion will be reduced. Air quality will be improved, because drivers
will experience less waiting time at the San Gorgonio and Highway 111
intersections. Traffic capacity or volume on Monterey Avenue, however, will not
be increased. The maximum "take" is eight feet on the southernmost portion of
the project and reduces down to zero feet at the north portion of the project.
Access to Monterey Avenue will not be affected. Signs and other improvements,
such as planters, will be relocated. Realigned Monterey Avenue will then be
pre-striped to relieve traffic congestion.

7. Reason why project was exempt:
The project will result in a minor alteration of Monterey Avenue, an existing
public street. There will be negligible or no expansion of traffic volume or
capacity on Monterey Avenue beyond that existing at the present time. Thus the
project is categorically exempt under 14 California Administrative Code Section
15301. The project will also result in the re-striping of Monterey Avenue to
relieve traffic congestion. Thus the project is statutorily exempt under Public
Resources Code section 21080.19.
