Folkers, Assistant City Manager/Public Works Director SUBJECT: ANNEXATION TO LANDSCAPE AND LIGHTING DISTRICT NO. 6 (MONTEREY MEADOWS) DATE: June 13, 1991 RECOMMENDATION; Adopt resolution No. 91-71 approving the annexation to the subject assessment district. BACKGROUND: Annexation No. 1 to Assessment District No. 6 is being completed to provide for the maintenance of landscape improvements conditioned or developments along Hovley Lane West between Portola and Monterey Avenues. At the Council meeting of May 23, 1991 , the Engineer's Report was filed and accepted by resolution and a public hearing was set. Public Works staff recommends that any protests to the annexation be overruled and the resolution approving the annexation to the subject assessment district be approved. C-4.-ej RI ARD J. The City Council further adopted ordinances and regulations governing the development of land providing for the installation and construction of certain landscaping, lighting and appurtenant facilities to enhance the quality of life and to benefit the value of property. The requirement for the construction and installation' of landscaping, lighting and appurtenant facilities• is a condition of development and is a . requirement of issuance of a permit for construction of any residential , commercial , industrial , and planned unit development. Landscaping and appurtenant facilities generally include trees, shrubs, plants, turf, irrigation systems, and necessary appurtenances including curbs, hardscape, monumentations, fencing located in public right-of-ways, medians, parkways, and/or easements adjacent to public right-of-ways, in and along major thoroughfares and certain designated primary and secondary arterials. Lighting and appurtenant facilities includes poles, lighting fixtures, conduits and the necessary equipment to maintain, operate and replace a lighting system at designated intersections, in medians parkways and adjacent • to certain public facilities in the along certain streets, right-of-ways and designated lots. The installation of landscaping and lighting systems and the construction of the necessary appurtenant facilities is the responsibility of the property owner/applicant, triggered by the approval of a development application. The City may cause the installation by property owners directly, or accept financial arrangements for installation of these facilities. • The servicing, operation, maintenance, repair and replacement of the landscaping, lighting and appurtenant facilities in turn becomes the responsibility of the benefiting properties. The owners/applicants petitioned for formation of. the Landscaping Lighting Assessment District and/or annexation. These applications are in various stages of processing, and when completed, will increase the City' s obligation for maintenance and servicing. The City of Palm Desert is administering a lighting system for the benefit of all parcels of land within the City, . The lighting benefit is directly related to public safety and property protection. These benefits have been studied widely, locally, regionally and nationally. To insure a flow of funds for the ongoing maintenance and servicing to the landscaping and lighting, the City is considering annexation to the Landscaping and Lighting Assessment District 89-6. The annexation to the • Page 1 • Landscaping and Lighting Assessment District 89-6 will insure a fair and equitable levying of the necessary costs of servicing and maintenance of the respective facilities, which in turn will enhance the value of each and every parcel in the District directly and collectively. The 89-6 District Boundaries of the Landscaping and Lighting Assessment District are the boundaries of Tract 25217 recorded in Map Book 181 , Pages 1 and 2, Records of Riverside County, and Tract 21791 , recorded in Map Book 167,. Pages 11 and 12. The boundaries of Annexation No. 1 to said district are shown on a map entitled Annexation No. 1 , to Assessment District 89-6, attached hereto and made part of this report. Servicing and administration of the City' s landscape maintenance program shall be according to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of CHlifornia. Payment for the assessment for each parcel will be made in the same manner and at the same time as payments are made for property taxes for each Property. The proceedings will be conducted under the Landscaping and Lighting Act of 1972, Part 2,. Division 15, Sections 22500 through 22679, of the Streets and Highways Code of the State of California: Formation of the district was a condition of approval of the Tracts within the proposed annexation. Annually thereafter, the City Council will review the current and projected year' s costs for the. servicing, maintenance, repair, and replacement of the District Facilities and set the assessment for the ensuing fiscal year, which runs between July 1 and June 30, annually. In the setting the annual assessment, City Council will consider any fund balances or shortages, and adjust the assessment accordingly. • This report contains the necessary data required to conduct the annexation proceedings and is submitted to the Clerk of the City for filing. • Page 2 CITY OF PALM DESERT ENGINEER'S REPORT PREPARED PURSUANT TO THE PROVISIONS LANDSCAPING AND LIGHTING ACT OF 1972 SECTION 22500 THROUGH 22679 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE . FOR ANNEXATION NO. 1 TO A.D. 89-6 Pursuant to Part 2 of Division 15 of the Streets and Highways Code of the State of California, and in accordance with the Resolution of Intention, being Resolution No. adopted by the Council of the City of Palm Desert, State of California, in connection with the proceedings for: PALM DESERT LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 89-6 AND ANNEXATION NO. 1 TO SAID DISTRICT; hereinafter referred to as the "Assessment District", I , Joseph Kicak, the duly appointed ENGINEER OF WORK, submit herewith the "Report" consisting of three (3) parts as follows: PART A Plans and Specifications for the proposed improvements are filed herewith and made a part hereof. Said plans and specifications are on file in the Office of the Clerk of the City. Description of the work for the proposed improvements and description of all rights-of-way, easements and lands to be acquired, if necessary. PART B A list of the names and addresses of the owners of real property . within this Assessment District, as shown on the last equalized roll of the Assessor of the County of Riverside, or as known to the Clerk. The list is keyed to the records of the County of Assessor of the County of Riverside which are incorporated herein by reference. PART C The Diagram of the Assessment District Boundaries showing the exterior boundaries of the Assessment District, and the lot dimensions of each lot or parcel of land within the Assessment District has been submitted to the Clerk of the Agency, a facsimile is included herein. The lines and dimensions of each lot or parcel within the Assessment District are those lines and dimensions shown on the maps of the Assessor of the County of Riverside, for the year when this Report was prepared and are incorporated by reference herein and made part of this Report. Page 3 PART A PLANS AND SPECIFICATIONS The installation of planting, landscaping, irrigation systems, lighting and the construction of appurtenant facilities to be operated, serviced and maintained, is more specifically described herein whereas, the landscaping and lighting facilities have been or will be provided by developers as a condition of subdivision of land, or part of the Conditional Use review and approval process. DATE: June 26, 1991 The attached letter has just been received from Barcon Development, the developers of Sonata I . The letter states how the buyers were informed of the requirement that a maintenance district would be formed for the perimeter landscape. If any deficiencies exist in this notification or disclosure, it is a matter between the buyer and seller of the property. The annexation to the existing district involves 265 developed and undeveloped parcels and any majority protest would involve 133 property owners. Within this maintenance district only four new subdivisions will be maintained and assessed for FY 1991-92 affecting 142 property owners. We maintain that each and every homeowner was verbally informed that (a) the City would be maintaining the exterior landscaping and street lighting, (b) that a maintenance district would be formed by the City to accomplish such maintenance, and (c) that homeowners would pay for the maintenance in an amount to be determined, through their property taxes; and 2 . The homeowners were, in fact, informed in writing that a maintenance district would be created at the project. In the CCR's for Sonata I , which were recorded on April 7 , 1989 as instrument number 110969 in the Records of Riverside County, and which were given during escrow to each purchaser, Section 3 . 03 provides (as to landscaping in those Sonata I areas not included within individual lots) , in pertinent part that "Owners shall have no responsibility to maintain any area . . . which lies within a maintenance district . . " The information in this section coincides with the information we provided purchasers; that is, that a maintenance district would be created. 41-625 Eclectic, Suite H-1, Palm Desert, CA 92260, (619) 773-9024, Fax (619) 773-9065 Tom Bassler June 24 , 1991 Page 2 Of course, as the homeowners representatives are aware, we are continuing to work with them in an effort to assist them in holding down the costs associated with the district, both in terms of maintenance expense on the landscaping as it now exists, and exploring alternative landscaping types which will require less expensive maintenance. We have indicated to the homeowners that while we do not agree with the contention that they did not receive adequate information, and clearly do not agree with their contention that they had no written indication that a maintenance district would be formed, we nevertheless are attempting to act in a conciliatory fashion in order to reach a resolution which will satisfy, at least to some extent, their desires. We of course believe that the City must form the assessment district - as you are aware, the landscaping at the project has been maintained by Barcon for about two years now and not the one year limit originally intended before the district was to be formed. We hope that in a review of all facts and circumstances, the City Council will concur and will approve the maintenance district for Sonata I , while at the same time giving any possible latitude to the desires of the homeowners to have the assessment amount reasonably reduced. Finally, as also discussed, we do not plan to attend the Council meeting, in order to keep the hearing from (potentially) becoming a "contest" ; this letter essentially sets forth our position for Council consideration.
