SUBJECT: ANNEXATION TO ASSESSMENT DISTRICT NO. 6 (MONTEREY MEADOWS). CONDITIONS
OF DEVELOPMENT.

At the last Council meeting, several residents of Tract 23982 - Sonata I , raised
concerns about being annexed into the existing Landscaping and Lighting
Assessment District No. 6 (Monterey Meadows) and being assessed for the
maintenance of landscaping and improvements. The Council continued the
annexation hearing and asked staff to provide the conditions that were placed on
the development regarding the establishment of an assessment district.
Attached are copies of the conditions that relate to the formation of an
assessment district to provide for the ongoing maintenance of four developments
that are to be included into the assessment district and assessment levied for
fiscal year 1991-92. All landscape maintenance was to be provided for though an
assessment district.
Property owners in Tract 23982 - Sonata I have stated that they were not fully or
properly informed by the developer/seller as to the true impact of there
requirement to participate in an assessment district after the developer was no
longer involved in the project. Several residents did state that they were aware
that the City would be taking over the maintenance from the developer with
perceptions being that no additional fees or costs would be involved and/or the
costs were included as part of their property tax. Any lack of communication or
disclosure between the seller and buyer is beyond the scope of the City's
involvement, other than verifying that a condition of assessment exists when and
inquiry is made.
In follow-up discussions with residents, the maintenance cost for their
development and the high per parcel assessment is another issue and concern.
This assessment district is and will be comprised of individual subdivisions,
each with its own distinct and unique maintenance requirements. The costs
involved for the maintenance and upkeep of each subdivision will be distributed
among the property owners of that subdivision. The reality is that in some
subdivisions there are a limited number of property owners to share in the cost
and therefore higher individual costs.
After reviewing information obtained from the residents, developer, assessment
district engineer and city attorney. Public Works staff recommends that the City
Council proceed with the annexation to Assessment District No. 6 (Monterey
Meadows) and adopt the resolution to levy assessments as presented in the

Any settlement or negotiation reached between the property owners and the
developer of Tract No. 23982 - Sonata I , may be considered by the Council .

I. DISCUSSION:
The project developer has requested sane minor changes to TT 23982 that
777 require ccmnission action. The applicant originally proposed a homeowners
association for the 16 lot single family subdivision southwest: of Portola
and Hovley. The association would be responsible for maintenance of both
the street and landscaping. However, due to lengthy procedures with the
State Department of Real Estate it would be much more expedient to
eliminate the association and create a public street and assessment
district to maintain perimeter landscaping. This would require
clarification of the 20 foot front setbacks, which are measured usually
from front property line. The original intent was to measure it from
curb-face, but the public street status also requires an additional 7 feet
of public right-of-way on both sides of the street beyond curb-face.
Also, the discovery of a 20 foot easement along the south property line
led to re-drawing of the property lines in this area to accommodate
potential swimming pool spaces.

7. All private streets shall be inspected by the engineering department and
a standard inspection fee shall be paid prior to recordation of the final
map.

by the homeowner's association.
9. As required under Section 12. 16 and 26.44 of the Palm Desert Municipal
Code. all existing utilities shall be underarounded per each respective
utility district' s recommendation. if determined to be unfeasible,
applicant shall agree to participate in any future utility undergroundina
district.
10. in accordance with Palm Desert Municipal Code Section 26.44. complete
grading plans and specifications shall be submitted to the director of
public works for checking and approval prior to issuance of any permits.
II . As required by Section 26.32 and 26.40 of the Palm Desert Municipal Code.
and in accordance with the Circulation Network of the City's General Plan,
dedication of half-street right-of-way at 50 feet on Portola Avenue and
44 feet on Hovley Lane shall be provided prior to recordation of the final
map.
12. Traffic safety striping on Hovley Lane/Portola Avenue shall be provided
to the specifications of the director of public works. A traffic control
plan must be submitted to and approved by the director of public works
before placing pavement markings.

10. As required by Sections 26.32 and 26.44 of ti'e Palm Desert Municipal
Code, and in accordance with the Circulation Network of the City' s
General Plan half-street right-of-way at 55 feet on Monterey Avenue, 44
feet on Howley Lane and full right-of-way at 50 feet cn Lot "A" (proposed
Glenwood Lane) shall be, offered for dedication cn the final map.
11. Traffic safety striping shall be installed to the specifications of the
.Director of Public Works. A traffic control plan must be sutxnitted to,
and approved by, the Director of Public Works prior to the placement of
any pavement markings.
12. Full improvements of interior streets based cn residential street standar-
ds in accordance with Section 26.40 of the Palm Desert Municipal Code
shall be provided.
13. Complete tract map shall be submitted as required by ordinance to the
Director of Public Works for checking and approval and be recorded before
issuance of any permits.

Deparbnent of Public Works:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Palm Desert Ordinance No. 507, shall be paid prior to
recordation of final map.
2. Drainage facilities, as designated within the Northside Area Drainage
Master Plan shall be provided to the specifications of the Director of
Public Works.
3. Storm drain construction shall be contingent upon a drainage study
prepared by a civil engineer that is reviewed and approved by the
department of public works.
4. Signalization fees, in accordance with City of Palm Desert Resolution
No's. 79-17 and 79-55, shall be paid prior to recordation of final map.
5. Full public improvements, as required by Sections 26.44 and 26.40 of the
Palm Desert Municipal Code, shall be installed in accordance with
applicable city standards.
