BUSINESSMAN"
I have reviewed your proposed ballot designation, "Palm Desert Commissioner," for the upcoming
November 5, 2024, General Municipal Election. Unfortunately, I cannot accept this designation
due to non-compliance with California Elections Code Section 13107. According to the law, a
candidate may provide, in three words or less, their principal profession, vocation, or occupation.
"Principal" is defined as:
"...a substantial involvement of time and effort such that the activity is one of the primary,
main, or leading professional, vocational, or occupational endeavors of the candidate. The
term 'principal' precludes any activity that does not entail significant involvement on the
part of the candidate. Involvement that is only nominal, pro forma, or titular in character
does not meet the requirements of the statute."
Consistent with this definition, the following are not acceptable ballot designations:
• Avocations/hobbies, social activities, and other amateur pursuits for enjoyment
• Pro-forma professions requiring little of the candidate’s time (i.e., "honorary chair,"
"honorary professor," "goodwill ambassador," etc.)
• One’s status relative to other persons or the community that is generic in nature and
generally fails to identify with any specificity the manner by which the candidate earns their
livelihood or spends a substantial majority of their time (includes "reform er," "founder,"
"taxpayer," "concerned citizen," "husband," "wife," etc.)
Your proposed ballot designation was "Palm Desert Commissioner/Businessman." However, the
Planning Commission only meets regularly twice per month for approximately one hour, and
commission members are not compensated for their time. Additionally, several meetings have
been canceled in the past year. Overall, commission service is nominal, pro forma, or titular in
character, rather than a principal profession, vocation, or occupation. As such, the Elections Code
requires me to reject these ballot designations.
Pursuant to California Elections Code Section 13107(f)(1), you have three days, excluding
Saturday, Sunday, and any state holiday, following receipt of this letter to submit an alternative
ballot designation for consideration by this office. Should you fail to submit an alternative ballot
designation within this period, no ballot designation shall appear following your name.

Minutes of the Regular Meeting of the Palm Desert City Council (CC),
Successor Agency to the Palm Desert Redevelopment Agency (SARDA),
and Housing Authority (HA)
STUDY SESSION:
A Study Session was called to order by Mayor Kelly on Thursday, June 22, 2023, at
2.00 p.m. in the Council Chamber, City Hall, located at 73-510 Fred Waring Drive,
Palm Desert, California. All members of the City Council were present.
The City Council received informational presentations regarding a Broadband Feasibility and Master
Plan Study and the North Palm Desert Community Park design. The City Council also provided
feedback on allowing right-of-way encroachments for railings and planters for outdoor dining on a
case -by -case basis. No formal actions were taken on these topics.
The City Council recessed at 3:27 p.m. and reconvened to call the regular meeting to order at
3:38 p.m.
CALL TO ORDER:
A Regular Meeting of the Palm Desert City Council was called to order by Mayor Kelly on
Thursday, June 22, 2023, at 3:38 p.m. in the Council Chamber, City Hall, located at 73-510 Fred
Waring Drive, Palm Desert, California.

There being no member of the public wishing to speak on any closed session items, the City Council
recessed to Closed Session and reconvened at 4:22 p.m.

Dear Mr. Mejia,
I am writing to justify my proposed ballot designation, "Palm Desert Commissioner/Businessman,"
for my candidacy for the Palm Desert City Council.
According to Elections Code 13107, candidates may use up to three words to describe their
principal professions, vocations, or occupations during the preceding year, with the primary
restriction being that the designation must not mislead voters. The California Secretary of State's
Ballot Designation Regulations (operative 12/21/2009) further clarify that the purpose of these
regulations is to ensure accurate and informative ballot designations to assist voters in making
informed decisions.
Over the past year, my primary professions, occupations, and vocations have been:
1. City Director
2. Palm Desert Planning Commissioner
3. Businessman
4. Father
I propose the ballot designation "Palm Desert Commissioner/Businessman" based on the following
justifications:
1. Palm Desert Planning Commissioner: I have served on the Palm Desert Planning
Commission since 2015. This role occupies a significant portion of my time and involves
substantial responsibilities. The term "Commissioner" is widely accepted and was used in
more than 120 races in California in 2022. In Riverside County alone, 12 candidates across
seven cities used "Commissioner" as their ballot designation (Exhibit A).
2. Businessman: I hold a business license to run a rental management company in Palm
Desert, qualifying me to use the term "Businessman." This designation accurately reflects
my professional status and is a significant aspect of my daily activities.
3. Clarity and Informative Value: These designations are both accurate and informative,
fulfilling the intent of the Secretary of State's regulations to provide voters with relevant
information about my professional background. They most directly relate to the position I
am seeking on the City Council.
4. Compliance with Word Count: As per the regulations, geographical names such as "Palm
Desert" are considered one word. Therefore, the full designation "Palm Desert
Commissioner/Businessman" counts as three words, which is permissible under the law.
5. Legal Compliance: My attorney has reviewed this designation and confirmed that it is
accurate, permissible, and does not conflict with any provision of the Elections Code or the
Secretary of State's regulations.
The proposed designation "Palm Desert Commissioner/Businessman" meets all legal
