RECOMMENDATION:
1) Review the staff report and concur with its findings .
2 ) Authorize staff to arrange for and hold a public hearing
according to the guidelines of the California Vehicle Code as
an initial procedure for commercial truck movement
restriction.
3) Authorize staff to continue exploring suggestions made by the
area residents for further discussion at future City Council
meetings .
4 ) Direct staff to proceed with additional code enforcement to
improve the overall area appearance and safety considerations .
5 ) Select Portola Avenue as the bypass truck route in conjunction
with the overall commercial vehicle plan.
6 ) Direct staff to coordinate the bypass plan with other affected
jurisdictions .
BACKGROUND:
At the study session held with the area residents on November 4 ,
the Public Works staff was directed by the Council to look at
several suggestions and recommendations brought up at the meeting.
The staff has conducted preliminary investigations that resulted in
the following:

SUBJECT: FRED WARING DRIVE SHORT-TERM TRAFFIC MANAGEMENT PLAN
A. TRUCK MOVEMENT RESTRICTION
There are several issues which need to be clarified on this
item.
1 - Fred Waring Drive is a major arterial roadway connecting
portions of the cities of Indio, La Quinta, Indian Wells,
and unincorporated county areas together and currently
carries nearly 23, 000 vehicles per day.
2 - Only a fraction of this volume of traffic ( less than
three percent) is truck traffic .
3 - Field observations indicated that a substantial amount of
truck traffic have "local" destinations for such purposes
as deliveries .
4 - The entire segment of Fred Waring Drive from its origin
on the east side ( Indio Boulevard) to its wester termini
(Highway 111 ) is on the regional truck route. Cities to
the east of Palm Desert have either already adopted truck
route plans or currently involved with the required
adoption process . Our initial investigations indicated
the above-mentioned street is an integral part of each
jurisdiction' s truck route.
5 - Making restrictions on any local streets without "due
process" is against the California Vehicle Code Sections
35701 , 35703 , and 35705 (see Attachment A) . This
restriction as noted would apply to those segments of
roadways that the local governmental entity has received
gasoline tax funds for either construction and/or
maintenance activities from the state .
The required due process in this case is to arrange fora
notification period to
public hearing with a sixty-day
allow the public to make comments and provide necessary
input in the process as is outlined in the Vehicle Code
( see attachment) .
6 - The restriction of trucks, once the public hearing is
conducted, can be made in one of the following manners :
* Extension of the current limitation from 12 : 00 a.m.
to 6 : 00 a.m. period to include additional daily or
evening hours .

* Redirecting truck traffic thru a bypass route by appropriate
signage using one of the following routes:
ALT I Fred Waring Drive to Cook Street to Highway 111
to San Pablo Avenue to Fred Waring Drive.
ALT II Fred Waring Drive to Cook Street to Highway 111
to Portola Avenue to Fred Waring Drive.
ALT III Fred Waring Drive to Deep Canyon Road to Highway
111 to San Pablo Avenue to Fred Waring Drive.
ALT IV Fred Waring Drive to Deep Canyon Road to Highway
111 to Portola Avenue to Fred Waring Drive.
ALT V Fred Waring Drive to Cook Street to Highway
111 to Monterey Avenue to Fred Waring Drive
ALT VI Total Replacement of Fred Waring Drive by
State Highway 111 from Indio to Palm Desert
Among the streets mentioned above, Deep Canyon Road is
not currently designated as a part of the City truck
route.
Any of the above-mentioned options have their own issues and
complications . For example, the geometry of several
intersections are such that large trucks will have substantial
difficulties in making necessary turns to continue their
journeys . Also, it is worth mentioning that the section of
Cook Street between Fred Waring Drive and Highway 111 falls
under the jurisdiction of the City of Indian Wells and,
therefore, any change in that street' s functions would require
the City of Indian Wells ' approval .
Alternative VI has the most significant set of problems since
this option would require substantial changes in the truck
routes in four cities and the county and, consequently, might
not be found feasible .
7 . Restriction of vehicles with commercial destinations, as
currently imposed for streets in the South Palm Desert
area, has also been reviewed. This option would not only
cause restriction on truck traffic but also any vehicles
used for commercial purposes with "outside" area
destinations . This option seems to be a logical choice
for the current circumstances but would require :

a) Consistent enforcement which sometimes
will be severely time-consuming.
b) Public hearing process, as noted above,
to meet the California Vehicle Code.
B. SPEED REDUCTION
The section of Fred Waring Drive west of Cook Street intersection
is currently posted for 45 miles per hour. It was suggested that
such speed limit be reduced to "slow the traffic down" to an
"acceptable and safe" level .
While there have been recent engineering and surveys done to meet
the Caltrans speed establishment requirements , there was a
suggestion to revisit the matter again.
The staff once again will conduct a radar survey of the area to see
if, indeed, the requested lowering is needed and/or justified.
The City is currently exercising the state law and Caltrans '
standards to establish speed limits on city streets . A main ingre-
dient of such study and the criteria used is the 85 percent rule.
This is recognized criteria and acceptable to the court of law.
C - OTHER MATTERS/SUGGESTIONS
At the public involvement meeting, several other suggestions were
also made which included the following:
I . Increase in Code Enforcement
This suggestion has been noted by the City' s Code
Enforcement Department and will be included in the staff
recommendation.
II . Lane Reduction
This suggestion would reduce the number of travel lanes
from four to two while providing on-street parking. This
matter will be reviewed further by the staff and will be
brought back to the Council in the future.
III . Weight Limit
This suggestion also needs to be looked at in the overall
context of truck route modification and will be studied
at a later date.

IV. Area Rezoning
This suggestion would require a comprehensive planning process
including public hearings at the Planning Commission and City Council
levels. This will also be included in the future studies.
V. Sound Wall
This suggestion also needs to be thoroughly investigated by the Public
Works and Planning staff and requires extensive analysis before being
brought up for discussion at the Planning Commission and City Council.
Total Street Widening
VI.
This suggestion has already been reviewed by the Council, which
lead to the position that the City would no longer consider this as a
viable option at this point, and, therefore, was deleted from further
consideration byCity the Council.
SUMMARY AND CONCLUSION
The staff has conducted a preliminary review of the suggestions
made at the study session with the City Council and area residents .
Staff feels the step-by-step process of selected short-term traffic
management would help alleviate the area residents concerns .
Among suggestions brought up at the meeting and briefly discussed
above, staff recommends that two specific suggestions be focused on
as the first phase of short-term improvement . This includes the
idea of commercial truck restriction and active code enforcement.
The first suggestion, as discussed above, would require the
following:
1) Conducting a public hearing in accordance with the
requirements of the California Vehicle Code.
2 ) Coordinate discussion and perhaps look for some
coordination of policies on truck access restriction
among cities and the county having jurisdiction over
segments of the Fred Waring Drive.
3 ) Review and approval of a truck route bypass as required
( if commercial vehicle restriction is to take place along
Fred Waring Drive) .

Staff recommends that the Council :
