REQUEST: REQUEST FOR APPROVAL OF BUDGET FOR MAINTENANCE OF
PROPERTIES ACQUIRED — FRED WARING DRIVE WIDENING
PROJECT

Recommendation:
By Minute Motion: That the City Council approve4 the appropriation of
$50,000 from unobligated capital project reserve (Fund 400) for a budget to
maintain acquired dwellings after acquisition by the City while still occupied
by tenants, and to maintain property after demolition of improvements but
before road widening construction begins.
Executive Summary:
Approval of this recommendation will facilitate the cleanup of landscaping on vacant lots
and the ongoing upkeep of residences that are now owned by the City, but whose
occupants have not yet been relocated. Rejection of this recommendation could allow
the properties acquired by the City to fall into disrepair and/or to become overgrown with
weeds and strewn with debris.
Background:
In May 2000, the City council approved a budget of $45,000 to maintain the properties
acquired on Fred Waring Drive between San Pascual Avenue and Deep Canyon Road.
At that time, the project construction was scheduled to commence in the summer of
2001. Since then, the construction work has been broken into two phases: the utilities
will be undergrounded in Summer 2001, but the road widening will be performed in
Summer 2002. Consequently, the properties on the north side of the street will remain
vacant for a year longer than was anticipated when the maintenance budget was
established. The original $45,000 has been virtually exhausted; the requested action

will provide funding to remove weeds and debris from the properties, to water the
remaining landscaping, and to perform other routine maintenance tasks associated with
these properties.

RESOLUTION NO. 01- 57
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, ADOPTING AN AMENDMENT TO THE
MITIGATED NEGATIVE DECLARATION FOR THE PROJECT TO
WIDEN FRED WARING DRIVE BETWEEN SAN PASCUAL AND DEEP
CANYON ROAD
THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS,
DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS:
Section 1. Environmental studies have been conducted as part of a feasibility
analysis on a proposal to widen Fred Waring Drive from four to six lanes between San
Pascual Avenue and Deep Canyon Road ("Project").
Section 2. On the basis of the record, including the Initial Study and
consideration of comments received on the Mitigated Negative Declaration (MND), the
City Council approved Resolution No. 00-122, which adopted the MND, on 12 October
2000.
Section 3. Subsequent to the approval of the MND, a change to the project
was identified; said change may require the acquisition of parts or all of five additional
residential parcels.
Section 4. An addendum to the MND has been prepared and this addendum
reflects the independent judgment and analysis of the City of Palm Desert as the lead
agency for the study.
Section 5. The report of the proceedings for the Project, including the
documents described under Section 2 and Section 4 above, will be maintained by the
City Clerk of the City of the Palm Desert, who will be the custodian of these documents.
Section 6. On the basis of the MND and the addendum to the MND, there is
no substantial evidence that the change to the Project will have a significant effect on
the environment.

Section 7. The addendum to the Mitigated Negative Declaration Plan for the
Proposed Widening of Fred Waring Drive from San Pascual Avenue to Deep Canyon
Road ("Exhibit A" attached) is hereby adopted by the City Council.
PASSED, APPROVED and ADOPTED by the City Council of the City of Palm
Desert, this 10th day of May , 2001, by the following vote, to wit:
