Funding for this purchase order is available in the CIP budget for the current fiscal year (Account 400-4384- 433-4001). Executive Summary: Acceptance of the staff recommendation will allow necessary technical monitoring of the subject project to commence as soon as Notice to Proceed is given to the construction contractor, Granite Construction. Rejection of the staff recommendation would require that another firm be selected and that construction be delayed until this was accomplished; or would permit construction to begin without adequate testing to ensure acceptable qualities of construction. Discussion On April 11 , 2002, a contract was awarded to Granite Construction for roadway improvements required to widen Fred Waring Drive from four to six lanes from San Pascual Avenue to Deep Canyon Road and from two to three lanes in the westbound direction from G:\RDA\Patty Leon\Wpdocs\LAylaian\Staff Reports\PSI-5-9-02.wpd Staff Report Award of a Purchase Order to Professional Services Industries, Inc. Page 2 May 9, 2002 San Pablo Avenue to San Pascual Avenue. As a matter of course in the construction of public improvements, a certain amount of testing of the compaction and the paving and concrete materials used is performed to ensure that the contractor is in full compliance with the contract documents. These services are provided on a call out basis for the duration of the construction work. It is impossible to determine in advance of the work how many tests will be required or what the total cost of the services will be. Therefore, professional test labs were contacted and requested to submit their schedule of hourly rates for different classifications of personnel and unit rates for performance of specific types of material tests that will be used on the subject project. On the basis of the cost proposals submitted by Professional Services Industries, Inc., Southland Geo Technical, and Earth Systems Southwest, Professional Services Industries Inc. was determined to be the most cost effective of the testing firms considered. Experience on previous similar projects indicates that the cost of the professional testing services should be in the range of $20,000; therefore, a purchase order in the amount not to exceed $25,000 is requested so that there is some allowance for unforeseen circumstances arising during the duration of the project. (City Project No. 651-99) SUBMITTED BY: Joseph S. Gaugush, Director of Public Works/City Engineer DATE: April 11, 2002 CONTENTS: Vicinity Map Recommendation: Staff recommends that the City Council, by minute motion: approve the Coachella Valley Water District reimbursement in the amount of $140,377.00, for the sewer relocation on the Fred Waring Widening Project at the Palm Valley Storm Water Channel. Monies for this utility relocation are available in the Fiscal Year 2001/02 CIP budget in Account 213-4399-433-4001. Executive Summary: An existing sewer line is currently in conflict with the proposed widening of the Fred Waring Bridge across the Palm Valley Storm Water Channel. By having CVWD expedite the relocation of the conflicting sewer utility, the City will be saving money and time on the construction of the Fred Waring Bridge. In addition accelerating the sewer relocation schedule will allow the bridge contractor to immediately begin the bridge construction. Background: The proposed improvements will widen Fred Waring Drive from four to six lanes between Highway 111 and Fairhaven Drive, including the bridge spanning the Palm Valley Channel. CVWD has a blackout period in the Palm Valley Storm Water Channel from July 15 to October 15 in which the channel concrete lining cannot be compromised. In order to have the bridge construction completed this year, the sewer relocation by CVWD forces will need to be expedited. This will allow the bridge contractor to immediately begin the Staff Report Approval of Coachella Valley Water District Reimbursement April 11, 2002 Page 2 of 2 bridge construction and installation of the piles and piers prior to the start of the July 15 blackout period in the channel. The bridge and street widening improvements are currently out to bid and are scheduled to be presented for award at the May 9, 2002 council meeting. This expense is reimbursable by CVAG under the terms of the agreement currently in place for reimbursement of 75% of the project costs. Therefore, staff recommends that City Council, by minute motion, approve the Coachella Valley Water District reimbursement in the amount of $140,377.00, for the sewer relocation on the Fred Waring Widening Project at the Palm Valley Storm Water Channel. The Palm Desert Redevelopment Agency intends to spend redevelopment funds to reimburse the City of Palm Desert for land acquisition and other capital costs associated with the widening of Fred Waring Drive. Section 2. The Agency intends that the foregoing described expenditures be reimbursed to the Agency from the proceeds of bonds or other obligations to be issued by the Agency, by the Palm Desert Financing Authority, or by_a related public entity. The Agency expects that all such expenditures will be reimbursed with the proceeds of such bonds. Section 3. Section 1.150-2 of the Treasury Regulations governs the allocation of expenditures of a reimbursement bond. A reimbursement bond is that portion of an issue of bonds (or other obligations) allocated to reimburse an original expenditure (i.e., an expenditure for a governmental purpose that is originally paid from a source other than a reimbursement bond) that was paid before the date of issue of the bonds. Section 1.150-2 provides rules to determine when an allocation of proceeds of bonds to reimburse an original expenditure will be treated as an expenditure of those proceeds. Section 4. In order for such an allocation of those proceeds to be treated as an expenditure, the issuer (or in certain cases, a conduit borrower) of the bonds must, in accordance with Section 1.150-2, adopt an official intent for the original expenditure. The official intent is a declaration of intention by the issuer to reimburse the original expenditure with proceeds of bonds. Such official intent is declared in Section 2 hereof. Section 5. The maximum principal amount of bonds or obligations expected to be issued for the above-described costs associated with the widening of Fred Waring Drive is $7,000,000.
