City Manager/Public Works Director SUBJECT: GRANT OF EASEMENT TO COACHELLA VALLEY WATER DISTRICT (CVWD) [ACROSS REDEVELOPMENT AGENCY—OWNED PARCELS WITHIN THE CIVIC CENTER PARK PHASE II] DATE: October 14, 1993 RECOMMENDATION: By minute motion, authorize the Chairman, on behalf of the City of Palm Desert Redevelopment Agency Board, to execute a Grant of Easement for CVWD across Redevelopment Agency—owned parcels within the Civic Center Park. BACKGROUND: CVWD has requested that the City grant them an easement for access purposes to their eight—inch water line, recently installed, for service to Phase III of the Civic Center Park. The parcels in question are those that are currently used as the parking lot for the Multipurpose Recreation Facility. Staff has reviewed the CVWD submittal documents and does not anticipate any adverse affects to the property by the granting of the requested easement. Therefore, staff recommends that the Redevelopment Agency Board, by minute motion, authorize the Chairman, on behalf of the City of Palm Desert Redevelopment Agency Board, to execute a Grant of Easement for CVWD across Redevelopment Agency—owned parcels within the Civic Center Park. The centerline of said strip being described as follows: COMMENCING at the Northeast corner of said Lot 82; thence South 00°09'02" West a distance of 20 feet; thence North 89°50'06" West a distance of 114 feet to the TRUE POINT OF BEGINNING; thence North 00°09'02" East a distance of 60 feet; thence South 89°50'06" East a distance 165 to a point hereinafter referred as Point "A"; thence continuing South 89°50'06" East a distance of 5 feet. ALSO a strip of land 10 feet in width lying within said lots 1, 3 & 81. The centerline of said strip being described as follows: BEGINNING at the aforementioned Point "A"; thence North 57° West a distance of 420 feet. This legal description was prepared pursuant to Sec. 8730(c) of the Business & Professions Code. The Grantor agrees for itself, its successors and assigns, not to erect, place or maintain, nor to permit the erection, placement or maintenance of any building, planter boxes, earth fill or other structures except walls and fences on the above described real property. The Grantee, and its contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or interfere with said systems and shall have free access to said systems and every part thereof, at all times, for the purpose of exercising the rights herein granted; provided, however, that in making any excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause the least injury to the surface of the ground around such excavation, and shall replace the earth so removed by it and restore the surface of the ground to as near the same condition as it was prior to such excavation as is practicable.
