FRONTAGE ROAD WEST OF PORTOLA AVENUE AND HIGHWAY 111

RECOMMENDATION:
By minute motion:
(1) Approve the reimbursement of$26,749.00, for superblock modifications of the
south frontage road west of Portola Avenue south of Highway 111.
(2) Appropriate $26,749.00 from unallocated Measure A funds.
BACKGROUND:
This item was before the Council at the meeting on November 9, 2000. At that meeting
concerns were expressed regarding developer improvement responsibility, building
location and right-of-way vacation.
As previously reported, the subject project received approval from the City's Planning
Commission in November 1998, and final approval of working drawings from the
Architectural Review Commission in July 1999. Those approvals represent the project
as it exists today with respect to architectural issues including building elevations, set
back, landscaping, etc.
Conditions of approval for the project required the reconfiguration of the frontage road
and involved the implementation of the City's "superblock" concept as well as the
Highway 111 corridor widening project. As has been implemented in previous projects
along the highway/frontage road, existing street rights-of-way were vacated and new
rights-of-way dedicated to facilitate the "superblock" concept. In the case of the subject
project, the area of land associated with the street right-of-way vacation totaled 2,225
square feet and the land dedicated as "new" right-of-way totaled 2,564 square feet
resulting in a net increase of 339 square feet of street right-of-way.

As a result of this "give and take" associated with the proposed roadway configuration,
the building footprint was sited such that the front of the building (Highway 111
frontage) was located at the approximate line of the southerly curb line of the frontage
road, about ten feet closer to Highway 111 than existing buildings to the west. Again,
this approach being similar to that utilized in previous projects involving the
implementation of the "superblock" concept.
While the project required the reconfiguration of the frontage road as a condition of
approval, certain portions of the work required to accomplish the reconfiguration were
beyond the project limits. These costs totaled $26,479, and this amount is being
recommended as a reimbursement to the project developer as costs over and above
his project requirements.
Therefore, staff recommends that the City Council approve a reimbursement in the
amount of $26,749, to the project developer for off-site roadway improvements. and
authorize the appropriation of $26,749. Funds for the reimbursement will be from the
City's unallocated Measure A funds.

Department of Public Works:
1 . Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code
and Ordinance No. 653, shall be paid prior to issuance of a grading permit.
2. Signalization fees, in accordance ccordance with Cityof Palm Desert
Resolution Nos. 79-17 and

3. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm
Desert Municipal Code, shall be installed in accordance with applicable city standards.
The engineering design of any public improvements constructed as part of this project
shall be in conformance with City of Palm Desert Project No. 653 (Portola Avenue/
Highway 111 intersection improvements). The City's obligation under Project 653
shall include, but not be limited to, design and construction of asphalt paving,
concrete curb and gutter, traffic signal modifications utility relocation and minor
landscaping modifications on Highway 111 and Portola Avenue. The applicant's
responsibility shall include, but not be limited to, the design and construction of
improvements "Within the realigned Highway 111 and Portola Avenue curb line
including the relocated frontage road, drainage facilities, parking area and sidewalk.
4. A priva e drive' ays a • parking lots shall be inspected by the e gineering
department and a standard inspection fee paid prior to the issuance of a grading
permit.
5. Landscaping maintenance on all public street property frontages shall be the
responsibility of the property owner.
6. A complete preliminary soils investigation, conducted by a registered soils engineer,
_shall be submitted to and approved by the Department of Public Works prior to the
issuance of the grading permit.
7. Any and all offsite improvements shall be preceded by the approval of plans by the
Director of Public Works and the issuance of valid encroachment permits by the
Department of Public Works.
8. In accordance with Palm Desert Municipal Code Chapter 27, complete grading plans
and specifications shall be submitted to the Director of Public Works for checking and
approval prior to the'issuance of any permits associates with this project.
9. As required under Palm Desert Municipal Code Section 26.28, and in accordance with
Sections 26.40 and 26.44, complete improvement plans and sp ecifications shall be
submitted to the Director of Public Works for checking and approval before
