BACKGROUND: As part of the development in the southwest corner of Highway 111 and Portola Avenue, the developer constructed the connection from the south frontage road of Highway 111 to Presidents Plaza East. This construction was part of the development program reviewed by the Planning Commission, and it was included in the conditions of development. This work was done prior to the Highway 111 and Portola Avenue improvements currently underway. The change was also a part of the superblock program that has been underway for many years. The staff recommends that the City Council approve the reimbursement of the development in the amount of $26,749. The City of Palm Desert will undertake the design and construction (including Caltrans permitting) for Highway 111 and Portola Avenue street improvements. Those improvements include, but are not limited to, asphalt paving, concrete curb and gutter, traffic signal modifications, utility relocation and minor landscape modifications. In addition, the city will process the vacation of that portion of the existing frontage road right-of-way not required for the above-referenced improvements. You as the development project proponent (applicant) shall design, seek City approval, and improve all of the property within the realigned Highway 111 and Portola Avenue curb line including the relocated frontage road, drainage facilities, parking area, sidewalk and building improvements. In addition, applicant shall dedicate relocated frontage road right- of-way and be responsible for all appropriate development fees. Sherman 61788 Tom McArthur Loop Bend, OR 97702 SUBJECT: OFF-SITE STREET WORK REIMBURSEMENT PRECISE PLAN 98-17; PORTOLA AVENUE/HIGHWAY 111 Dear Mr. Sherman: We have reviewed yogi request for reimbursement and the various supporting documents submitted as well as the project conditions of approval. As you may recall, the project responsibility included "... the design and construction of improvements within the realigned Highway 111 and Portola Avenue curb line including the relocated frontage road, drainage facilities, parking and sidewalk." Subsequent to that approval, in meetings between city staff and yourself it was agreed that the city would reimburse you for a portion of work associated with the relocated frontage road. The limit of this work was shown on the engineered improvement plans (Precise Grading Plan) prepared by The Keith Companies and approved by the City on January 6, 2000. Utilizing the approved plans and the unit costs for the various items of work as shown on Dateland Construction Company's Invoice No. 3785 dated March 6, 2000, we have determined the value of the work subject to City reimbursement to be $26,749.00 (See Attachment "A"). • Based upon the above information, we are requesting that you revise your request for payment and resubmit for reimbursement. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Ordinance No. 653, shall be paid prior to issuance of a grading permit. 2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and - 5, shall be paid prior to issuance of a •radin• • - mit. 3. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Desert Municipal Code, shall be installed in accordance with applicable city standards. The engineering design of any public improvements constructed as part of this project shall be in conformance with City of Palm Desert Project No. 653 (Portola Avenue/ Highway 111 intersection improvements). The City's obligation under Project 653 shall include, but not be limited to, design and construction of asphalt paving, concrete curb and gutter, traffic signal modifications utility relocation and minor landscaping modifications on Highway 111 and Portola Avenue. The applicant's responsibility shall include, but not be limited to, the design and construction of improvements within the realigned Highway 111 and Portola Avenue curb line including the relocated frontage road, drainage facilities, parking area and sidewalk. 4. A priva e drive' ays a • parking lots shall be inspected by the e gineering department and a standard inspection fee paid prior to the issuance of a grading permit. 5. Landscaping maintenance on all public street property frontages shall be the responsibility of the property owner. 6. A complete preliminary soils investigation, conducted by a registered soils engineer, _shall be submitted to and approved by the Department of Public Works prior to the issuance of the grading permit. 7. Any and all offsite improvements shall be preceded by the approval of plans by the Director of Public Works and the issuance of valid encroachment permits by the Department of Public Works. 8. In accordance with Palm Desert Municipal Code Chapter 27, complete grading plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to the-issuance of any permits associates with this project. 9.
