SUBJECT: JONI DRIVE EXTENSION FROM VELIE DRIVE TO 42ND AVENUE
(PROJECT #627-99) GRANT OF EASEMENT
DATE: February 10, 2000
RECOMMENDATION:
City Council approve the Grant of Easement to Southern California Edison for the purpose
of relocating the existing transformer to the new location(see attached diagram) to allow
the construction of the Joni Drive Extension.
Authorize the Mayor to execute the enclosed Grant of Easement.
BACKGROUND:
The existing transformer and electrical panel are located within the limits of the proposed
roadway extension for Joni Drive. The transformer will need to be relocated to the
northeast corner of the Corporation Yard, west of the extended Joni Drive. This transformer
will provide power to the Corporation Yard and expansions that may occur to the west, as
well as, the property on the east side of the extended Joni Drive.
Southern California Edison requires a Grant of Easement to relocate the transformer,
therefore the Public Works staff recommends that the City Council approve the Grant of
Easement to Southern California Edison; and authorize the Mayor to execute the enclosed
Grant of Easement.

Dear Mr. Ferrante:
As you are aware, Southern California Edison Company (Edison) has retained MARMAC
to acquire rights of way to install Edison's electric distribution facilities.
In response to your request for electric service, we will need an easement to permit the
construction and maintenance of electric facilities to 74796 Velie in Palm Desert. The
enclosed assessor parcel map shows the location of the proposed facilities.
You will find enclosed a revised original and one copy of a Grant of Easement. Please
have the original Grant of Easement executed, have the signatures notarized, and return to
me in the envelope provided. Failure to return the signed and notarized easement to this
office will delay the scheduling of your facility installation. The copy of the easement is
for your files.

CITY OF PALM DESERT, a Municipal Corporation (hereinafter referred to as "Grantor"), hereby grants to
SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter referred to as
"Grantee"), an easement and right of way to construct, use, maintain, operate, alter, add to, repair, replace, reconstruct,
inspect and remove at any time and from time to time underground electrical supply systems and communication systems
(hereinafter referred to as "systems"), consisting of wires, underground conduits, cables, vaults, manholes, handholes, and
including above-ground enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or
useful for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over, under, across and
along that certain real property in the County of Riverside, State of California,described as follows:
THE NORTHERLY 26.00 FEET OF THE WESTERLY 32.00 FEET OF THE EASTERLY 92.00 FEET OF SAID
LOT 10, TRACT NO. 5224, AS PER MAP FILED IN BOOK 88,PAGES 11 AND 12 OF MAPS, IN THE OFFICE
OF THE COUNTY RECORDER OF SAID COUNTY.
Legal description was prepared pursuant to Sec. 8730(c)of the Business&Professions Code.
Grantor agrees for itself, its successors and assigns, not to erect, place or maintain, nor to permit the erection,
placement or maintenance of any building,planter boxes, earth fill or other structures except walls and fences on the above
described real property. The Grantee, and its contractors, agents and employees, shall have the right to trim or cut tree
roots as may endanger or interfere with said systems and shall have free access to said systems and every part thereof,at all
times, for the purpose of exercising the rights herein granted; provided, however, that in making any excavation on said
property of the Grantor,the Grantee shall make the same in such a manner as will cause the least injury to the surface of the
ground around such excavation,and shall replace the earth so removed by it and restore the surface of the ground to as near
the same condition as it was prior to such excavation as is practicable.
