SCE Easement - Parcels of Desert Willow Development
PALM DESERT REDEVELOPMENT AGENCY INTEROFFICE MEMORANDUM DATE: JANUARY 23, 1997 TO: EXECUTIVE DIRECTOR, HONORABLE CHAIRMAN AND MEMBERS OF REDEVELOPMENT AGENCY BOARD FROM: RUDY ACOSTA, PROJECT ADMINISTRATOR SUBJECT: GRANT OF EASEMENT TO SOUTHERN CALIFORNIA EDISON (SCE) ALONG CERTAIN PARCELS OF DESERT WILLOW DEVELOPMENT Recommendation: By minute motion, authorize the Chairman, on behalf of the Palm Desert Redevelopment Agency Board, to execute a Grant of Easement for SCE along certain parcels within the Desert Willow development. Background: SCE has requested that the Palm Desert Redevelopment Agency grant them an easement for access purposes to their electrical power lines and equipment to be installed across certain parcels within the Desert Willow Project. Said easements are described in Exhibit "A" document attached to this report. The City's Engineering staff has reviewed the SCE submittal documents and does not anticipate any adverse effects to the project by the granting of the requested easement. Therefore, staff recommends that the Agency Board, by minute motion, authorize the Chairman to execute a grant of easement for SCE along the described parcels within the Desert Willow development. The Grantor agrees for themselves, their heirs, and assigns, not to erect, place or maintain, nor to permit the erection, placement or maintenance of any building, planter boxes, earth fill or other structures except walls and fences on the above described real property. The Grantee, and its contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or interfere with said systems and shall have free access to said systems and every part thereof, at all times, for the purpose of exercising the rights herein granted; provided, however, that in making any excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause the least injury to the surface of the ground around such Grant of Easement 6879-2565/6-2509 Page 3 EXHIBIT "A" The West half of the Northwest quarter of Section 4, Township 5 South, Range 6 East, San Bernardino Meridian.
