Waive Condition 111.3 (Application and Approval Process) of the City of Palm Desert Guidelines for Use of Civic Center Facilities, which prohibits the reservation of facilities on a serial basis, for the Bureau of Land Management which has requested the use of the Council Chamber on June 1, 2002, August 3, 2002, October 5, 2002, December 7, 2002, and February 1, 2003, provided Councilman Buford Crites will open and close the Chamber and assist BLM staff as needed. 2. Waive Condition 11.1 (Organizations Qualifying For Use Application) of the City of Palm Desert Guidelines for Use of Civic Center Facilities, which assesses a $40.00 per hour usage fee. Executive Summary: To ensure appropriate use by community groups of available meeting rooms located at City Hall, the City of Palm Desert established "Guidelines For Use of Civic Center Facilities", which outlines the requirements, fee schedule, and application process for usage. The Bureau of Land Management is requesting a waiver of the provision of these guidelines r which prohibits serial reservations of any given facility. In addition, the BLM is requesting a waiver of the $40.00 an hour usage fee. Background: As requests to use meeting rooms located at City Hall are received from individuals and groups throughout the community, staff provides a copy of the City of Palm Desert Guidelines For Use of Civic Center Facilities to determine eligibility for use and to ensure that all provisions are met by groups meeting appropriate criteria. The Bureau of Land Management is requesting a waiver of Condition 111.3 (Application and Approval Process) which prohibits the reservation of a meeting room on a serial basis to accommodate scheduled meetings of the Advisory Committee to the Santa Rosa and San Jacinto Mountains National Monument. BLM staff has requested that the City Council Chamber be made available for this purpose on the following Saturdays; June 1 , 2002, August 3, 2002, October 5, 2002, December 7, 2002, and February 1, 2003. In addition, the BLM has requested that the City Council approve a waiver of the $40.00 an hour usage fee as outlined in Condition 11.1 (Organizations Qualifying For Use Application) of the City of Palm Desert Guidelines For Use of Civic Center Facilities. Provided Councilman Crites is available to open the Council Chamber and provide assistance to BLM staff on each of these dates, staff recommends approval of the request to waive Conditions 111.3 and 11.1 of the City of Palm Desert Guidelines For Use of Civic Cent r Facilities. We are aware you had some questions and had asked us to call you;however,it seems your phone lines have been out of service. While your application is for six dates,all of which are on Saturdays from 9:00 a.m.-4:00 p.m.,the City's Facilities Use Guidelines do not allow us to preclude a series of dates for any organization. You will have to apply in advance of each meeting for approval. We are enclosing an application form as well as a copy of the guidelines which were provided to you during your visit last week. We have approved the Monument Advisory Committee request for April 6 and we will waive the$40/hour charge. However,the staff capable of assisting in the use of audio/visual equipment are not available on April 6. Therefore, this equipment cannot be made available to you for that meeting. Your organization is a very important new segment of our community,and we will work diligently to assist you in any way we can provided we can meet the guidelines as established by the City Council. The new application for each use will assist us in making sure that we have advance notice and the ability to address your needs for that particular meeting. Public agencies (other than the City of Palm Desert), senior citizen organizations, or other non-profit organizations, clubs, or associations organized in Palm Desert for cultural activities and general character building or welfare/charitable programs may be granted permission to use the facilities at $40.00 per hour. III. APPLICATION & APPROVAL PROCESS 1. A person or group desiring to use Civic Center facilities must file an Application for Use of Facilities with the City Clerk's Office. Applications must be completed and submitted at least two calendar weeks prior to the scheduled event unless otherwise authorized by the City Manager. 2. Approval shall be granted by the City Manager or his designated representative unless the requested use involves some type of art exhibit or musical performance, in which case application shall be forwarded immediately to the Civic Arts Committee for its review and approval. Approved permits will be issued to the person filing the application prior to the event. 3. In the interests of widest community use of the Civic Center facilities, no one group shall pre-empt a series of dates. 1 IV. FEES FOR USE OF FACILITIES 1 . Per City Council action, agencies may be charged a rate of$40/hour for use of Civic Center facilities, aid charge to be applied at the discretion of the City Manager. V. CIVIC CENTER EQUIPMENT 1. City-owned equipment such as audio, equipment, furniture, and kitchen facilities may be used provided the organization using it assumes the responsibility for such equipment and agrees to repair or replace any equipment damaged, lost or stolen while under its jurisdiction. VI. SPECIFIC RULES, PROCEDURES AND CONDITIONS 1. No intoxicants or narcotics shall be permitted in the Civic Center facilities, nor shall profane language, quarreling, fighting, or gambling be allowed. Violation of this rule by any organization during occupancy shall be sufficient cause for denying further use of the Civic Center facilities. 2. Programs offered in and during the use of Civic Center facilities shall not contain any matter which might tend to cause breach of the peace and which constitute subversive doctrine, seditious utterances, and which agitate changes in our form of government or social order by violence or unlawful methods. 3. Juvenile organizations shall have adequate supervision when using Civic Center facilities at a ratio of not less than one adult per twenty minors. Disregard of this rule shall be considered cause for immediate cancellation of future Civic Center Facilities Use Permits. 4. No preparation of any kind shall be used on floors, walls, etc., by groups using the facilities for any reason. 5. Any approved Application for Use of Facilities may be revoked without previous notice where conflicting dates have resulted or where need of the property for public purposes has subsequently developed. For other cause(s), permits may be revoked at any time upon reasonable notice. 6. The City may require applicants to furnish proof of liability or other insurance for the protection of the public and the City. Said requirement shall be upon the specific recommendation of the City Attorney and City Manager. 7. No smoking, eating, or drinking is permitted in the Council Chamber of the Civic Center. 8. Furniture may be rearranged, but rooms shall be returned to original arrangement. Users shall ensure that all facilities are cleaned and cleared of any debris resulting from use of the facilities prior to leaving. 2
