SUBJECT: APPROPRIATE FUNDS FOR THE USED OIL RECYCLING BLOCK GRANT
RECOMMENDATION
By minute motion, the City Council appropriate $11,387 to Account#110-4511-442-3911 from the Unobligated
General Reserve Fund to pay for expenses on the Used Oil Recycling Block Grant which will be reimbursed by the
State of California, California Integrated Waste Management Board (CIWMB).
BACKGROUND
A staff report was submitted to Council on December 14, 1995, (see report attached) requesting approval to allow
staff to apply for a CIWMB Used Oil Recycling Block Grant (based upon population). The grant educates the
proper disposal and recycling of used motor oil in Palm Desert.
The City of Palm Desert and City of Palm Springs received letters of confirmation (see attached letter) receiving
block grants. Both cities are working together on this program.
All expenses are 100% reimbursable from the CIWMB through the grant. Both cities agreed to share expenses
equally. When the City of Palm Desert has depleted their funds,the City of Palm Springs will be incurring all
additional expenses to complete the education campaign.

The City Council, by minute motion adopt Resolution No 95-10$llowing staff to administer the California
Integrated Waste Management Board (CIWMB) Used Oil Recycling Block Grant to encourage the proper disposal
and recycling of used motor oil in Palm Desert.
BACKGROUND:
The California Oil Recycling Enhancement Act (Act) (Statutes of 1991, Chapter 817) authorizes the California
Integrated Waste Management Board(CIWMB)to issue grants to enhance the collection and recycling of used motor
oil. Under the Act, oil manufacturers pay a four cent per quart fee on every quart of motor oil sold, transferred
or imported into California. The Act mandates the CIWMB to use these funds for specified activities that encourage
the legal disposal of used motor oil. Public Resources Code 548653 specifically authorizes the CIWMB to issue
block grants to local governments for the establishment of new programs or the enhancement of existing programs
that address the proper management of used lubricating oil.
All California cities are entitled to the Used Oil Recycling Block Grant funding. The money is awarded according
• to population. Palm Desert's annual entitlement is approximately $10,500. Staff proposes to utilize the grant for
the following promotional/educational materials:
Direct mail brochure
Promoting annual household hazardous waste roundups
Promote ABOP (Antifreeze, Batteries, Oil and Paint) Collection Center — located in Palm Springs
Transit signs — Sunline has agreed to work with the City to develop bus stop signage to promote
the program
Public service announcements for radio and television — if funding available
Funding from this program has been available to all California cities since 1990. However,this is the first time that
Palm Desert is participating and educating their residents on the need for the proper and legal disposal of used oil.
The City of Palm Springs has also applied for this block grant. Palm Springs will be receiving approximately
$13,500 in funding. Palm Springs will be working with the City of Palm Desert to design public education materials
and outreach efforts. Also,the County of Riverside has agreed to work with the City on several public education
pieces.
In addition, staff will return to the City Council in February of 1996 to request City Council's approval to apply
for an additional used oil grant that is based on competition throughout California. If Palm Desert receives this
competitive grant, residents in Palm Desert will receive consecutive and quality educational materials to heighten
residents awareness. With proper education, recycling used motor oil will become as habit forming as curbside
recyclin in our City

WHEREAS, the people of the State of California have enacted the California Oil
Recycling Enhancement Act that provides funds to cities and counties for establishing and
maintaining local used oil collection programs that encourage recycling or appropriate disposal
of used oil; and
WHEREAS, the California Integrated Waste Management Board has been delegated the
responsibility for the administration of the program within the state, setting up necessary
procedures governing application by cities and counties under the program; and
WHEREAS, the applicant will enter into an agreement with the State of California for
development of the project;
NOW, THEREFORE, BE IT RESOLVED that the City of Palm Desert:
1. Authorizes the submittal of grant applications to the California Integrated Waste
Management Board for all available grants under the California Oil Recycling
Enhancement Act and all available HEW grants under the California Integrated
Waste Management Act for the period of June 1, 2000.
2. The Environmental Conservation Manager or their designees, is hereby authorized
and empowered to execute in the name of the City of Palm Desert necessary
applications, contracts, payment requests, agreements and amendments hereto for
the purposes of securing grant funds and to implement and carry out the purposes
specified in the grant application.

WITNESSETH: That the Contractor for and in consideration of the covenants, conditions, agreements, and stipulations of the State hereinafter expressed,
does hereby agree to furnish to the State services and materials as follows: (Set forth service to be rendered by Contractor, amount to be paid Contractor,
time for performance or completion, and attach plans and specifications, if any.)
Contractor agrees to undertake and complete all necessary tasks to implement a local used oil collection program as authorized by Public Resources Code
48690 and 48691. At a minimum, the contractor's used oil collection program must:
1. Include a public education component that informs the public of locally available used oil recycling opportunities, AND
2. Ensure the contractor's Block Grant eligibility requirements are met by ensuring that either of the criteria below or a combination of the two are
achieved and maintained during the grant term so that all residents are served: a) Provides used oil curbside collection for all residents of the city
including multi-family residences; or b) ensures that at least one certified used oil collection center is available for every 100,000 residents not served by
curbside used oil collection.
The term of the agreement will be 12 months. commencing June 30, 1996 and terminating June 30. 1997. Contractor will be paid in accordance with the
attached Terms and Conditions and Administrative Procedures and Requirements. The State will withhold 10% of the total grant award until completion
of all work and other requirements to the satisfication of the State in accordance with this contract.
Contractor agrees to abide by all legal and administrative requirements for this grant as described in the Terms and Conditions and Administative
Procedures and Requirements, excluding the paragraph entitled, "Entire Agreement" to read, "This agreement supercedes all prior agreements, oral or
written, made with respect to the subject hereof." These documents are attached to this agreement and incorporated by reference.

Dear Ms. Constande:
Congratulations on receiving a Used Oil Recycling Block Grant(Fourth Cycle). The
California Integrated Waste Management Board(CIWMB)approved your grant at its
March 27, 1996 meeting. The formal agreement for your grant will be mailed to you during
June 1996. There has been a recalculation of the fund resulting in your award being
augmented by nine percent: Your total grant amount will now be$11,387.00.
To remain eligible for block grant funding, local governments are responsible for ensuring that
a sufficient number of certified centers are available within their jurisdictions. Additionally,
participating local governments are required to maintain their certified centers according to
Title 14,California Code of Regulations(CCR)Section 18659.3(d). Beginning with the
fourth cycle block grants,we will be providing you with a checklist and a guidance document
on site visit procedures as well as a reporting form to assist you in complying with CCR
Section 18659.3(d). Please use these forms to report the results of the visits you make to the
certified centers in your jurisdiction and include completed reporting forms with your progress
reports.
For your information,we will also be awarding used oil grants to eleven Local Conservation
Corps statewide. These grants will be used to distribute information, conduct public outreach
events, and for support of local government used oil programs. Local corps representatives
• will be contacting you in the near future and we encourage you to coordinate your efforts with
them and employ them whenever possible. Our goal is for the corps to become a resource to
local governments for current and future projects.
