The claim on itself has no merit and if it were up to me I would deny it. I assume that the sub will also deny it but I am waiting to see. Mr. Trevino has been calling me every other day and I don't have a good answer for him. He would certainly loose in small claims court with lack of any real proof. His best bet is to be patient. I sent the claim to the subcontractor 2 weeks ago and I have not had a response. I was not able to give the sub any other information or pictures. The only picture of a tire we have does not show what penetrated it. The picture also shows the penetration is not in the sidewall. The problem is that Mr. Trevino has not shown us any proof or pictures that the damage occurred on the project. He states nails in his claim, yet the only thing the sub was working with is sheet metal screws. H&H has not been working with nails since June 2nd and the project had been swept several times since then. The only possibility of damage from H&H would be a sheet metel screw from our Carport Subcontractor. I DO NOT have any pictures showing what has actually penetrated his tires. 6 Mr. Trevino also bought 4 new tires and is asking to be compensated for 2 of them. That tells us that the tires were at the end of their life or at the least very worn down. He also states that there were 2 nails in each tire, the chances of that happening seem extremely low in probability. The report from the tire company also states NAILS. If the tires had nails in them it would be 100% denied. I was waiting to see if the subcontractor is willing to pay $300 for the 2 tires with no proof. If the sub denies the claim, then H&H will deny the claim. I will continue to try and get a response from the subcontractor. The lack of pictures and the inconsistency in the nails vs screws make this claim very tough to accept. Please let me know if you have any questions. I should have an official response before the end of next week.
