Joseph Arcader with Insignia National Sign Corp and James Fitzpatrick, Applicant Representative, introduced themselves and answered questions from the Commission. With no other members of the public wishing to comment, Chair Vuksic closed the public comment period. Discussion on the item ensued with Commissioners providing comments for the project. A motion for continuance by Chair Vuksic, seconded by Commissioner Latkovic was carried with a 7-0 vote of the Commission. Following the motion, with the Chair’s approval, public comment was reopened to allow the Applicant Representative to address the Commission regarding their comments for continuance. Further discussion on the item ensued resulting in the Commission’s reconsideration of their motion for continuance. Following discussion, MOTION BY CHAIR VUKSIC, SECOND BY COMMISSIONER COLVARD, CARRIED 7-0; to approve Case No. SARC24-0004 with the following conditions: 1. Sign number 3 which is south facing shall be non-illuminated. 2. All wall mounted signs, illuminated and non-illuminated, shall be individual channel letters with no raceway or cabinet. 3. CASE NO: SARC24-0008 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration for design review approval for two entry wall mounted signs on an existing block wall reading “M” Millennium Apartments located at entry locations off Technology Drive and Gerald Ford Drive. APPLICANT AND ADDRESS: Signarama, Palm Desert, CA 92260 LOCATION: 74699 Technology Drive ZONE: District Commercial Center (PC-2) Principal Planner, Carlos Flores, requested the Commission continue the item to the next regularly scheduled ARC meeting of June 25, 2024, to allow staff time to meet with the applicant to further review the full scope of their request, which may include revisions to the previously approved wall design in addition to the proposed signs. Chair Vuksic opened the public comment period. Russell MacDonald, HSA, stated he is the designer of the entry way and informed the entry was redesigned as a result of engineering and parking expanding in that area. He noted several changes made to the entry, including proposed materials. He expressed confusion as to what staff’s concerns are regarding the changes and asserted his frustration at the item being continued. Principal Planner Flores explained that staff will need to discuss with the applicant the proposed changes to the entry and obtain additional information so that the ARC’s review is of the complete request with all information provided for consideration. Glenn Davis, Signarama, asserted his discontent and frustration with staff’s request for continuance adding that staff has had his submittal for weeks to review and is confused as to why the design of the wall would prohibit review of the signage. He opined about the inconvenience of being continued on such short notice. With no other members of the public wishing to comment, Chair Vuksic closed the public comment period. MOTION BY VICE CHAIR MCINTOSH, SECOND BY COMMISSIONER MCAULIFFE, CARRIED 7-0; to continue Case No. SARC24-0008 to a date uncertain. 6. CITY STAFF Principal Planner Flores provided the following updates: • At the regular meeting held on June 4, 2024, the Planning Commission approved a recommendation of approval to the City Council for Zoning Ordinance changes which included updates to the commercial overlay zone and the Cannabis ordinance. • Wildest Restaurant Patio Expansion and Shadow Ridge projects will be on the agenda for the next Planning Commission meeting scheduled for June 18, 2024. • Staff has selected a firm to establish a historic context statement and to complete a city survey. A request for an award of contract for this service is anticipated to go before City Council for approval this month. • Upon request, Commissioners Colvard and Blakely volunteered for the West Coast Storage ARC subcommittee review for monument signage. • Upon inquiry, information was provided for allowable signage on windows for commercial buildings per the Palm Desert Municipal Code. C. ATTENDANCE REPORT The attendance report was provided with the agenda materials. The Commission took no action on this matter. 8. BACKGROUND/ANALYSIS: Executive Summary: The proposal is a request by Humphreys & Partners Architects, Applicant, for consideration of a Design Review to approve architectural revisions for the “Bravo Gardens” project, located on the south side of Hovley Lane East at the intersection of Jasmine Court. (APN: 624-040-019) Case No.: MISC24-0009 (Related cases: PP 16-394 and MISC21-0032) On April 26, 2018, the City Council adopted Resolution No. 2018 -18 approving The Sands Apartments, which included approving Precise Plan 16-394 (PP16-394). The development generally includes a 388-unit residential apartment community and related improvements and included a density bonus and housing agreement for affordability restrictions on 20% of the units. The 388-units are contained within 16 residential apartment buildings. The approved apartment buildings range in height from two- to three- stories feature Spanish Colonial Revival architecture. Thirteen (13) buildings were approved for two stories, and the remaining three (3) were approved for three-story buildings. Other approved site improvements consisted of a single-story clubhouse building, detached garage structures, and detached carports. The Architectural Review Commission (ARC) originally reviewed the architecture for the project on March 28, 2017, subject to the following conditions of approval: 1) Balcony walls shall be thickened to 12 inches. 2) Masonry columns at the gates shall be increased to 24” square and plastered. 3) Roofs on carports (garages) shall be gabled with an approximate 9’ plate on both sides. 4) The fencing that separates Phase 1 and Phase 2 development shall be more than construction fencing. 5) Replace the tube steel with wrought iron on the exterior fence. 6) A/C units and gas meters shall be screened. 9 Architectural Review Commission City of Palm Desert MISC24-0009 Bravo Gardens Revisions Page 2 of 5 The items requested by the ARC were incorporated in the City Council Resolution as Condition of Approval No. 16 of City Council Resolution 2018-18. In 2021, the Applicant applied for Case No. MISC21-0032 to revise the approved architecture of the project for the “Bravo Gardens” project (formerly known as “The Sands”). The design proposed as part of MISC21-0032 was to replace the approved architecture approved via Resolution 2018-18 for PP16-394. The proposed revision also changed the approval from four (4) building types to three (3) building types. The ARC considered and approved Case No. MISC21-0032, subject to the following conditions of approval: 1) Revisit prominent architectural forms, massing and breaks in plane, with particular attention to details that cover multiple stories, proportion, depth, and size; 2) Revisit three-story arch design, consider the use of a base or other elements to provide more mass to the outer plane of the arch; 3) Revisit and increase depth of 6-inch wall masses; 4) Explore alternative options for placement of mechanical equipment to avoid overcrowding and excessive noise; 5) All mechanical equipment should be properly screened with access for service, use of other methods of screening in addition to landscape is encouraged; 6) Applicant will work with Planning staff to develop a landscape maintenance agreement which will ensure the upkeep of landscape utilized for screening and as a buffer between the project and Via Venezia; and 7) Project will be reviewed by staff and return to the ARC should there be any items that cannot be resolved with Applicant. These conditions of approval were to be addressed during building permit construction and would be reviewed by staff. The Applicant submitted construction plans (Plans) through a building permit (APTS22-0012). Staff reviewed the plans to confirm compliance with PP16-394 and MISC21-0032, including all conditions of approval. The Plans were compliant with conditions 1 through 6 from MISC21-0032 listed above but reflected architectural changes to the elevations and floor plans on all three (3) building types. The proposed architectural changes to the approved plans require ARC consideration for Design Review approval. Project Summary: The Applicant proposes architectural revisions to the three (3) building types for the “Bravo Gardens” project as summarized in Attachment 1. Only portions of the buildings are proposed to be revised and the majority of the approve d architecture remains in place. There are no proposed changes to site plan, materials, landscaping, number of buildings, or style. A. Property Description The project site is a vacant 18.13-acre property located on the south side of Hovley Lane East at the intersection of Jasmine Court. The site topography is generally undisturbed except for perimeter block walls to the south, east, and west of the property. The site is characterized by large sand dunes in the central and southern portions of the site, scattered 10 Architectural Review Commission City of Palm Desert MISC24-0009 Bravo Gardens Revisions Page 3 of 5 native desert vegetation, and evidence of refuse from dumping. The street frontage of the property is developed with full road width, curb, gutter, and sidewalk. B. The originally approved architectural style is not being revised as part of this submittal. The project has been previously reviewed and approved via PP16-394 and MISC21-0032 to ensure compliance with all applicable development standards and the Palm Desert Municipal Code. 11 Architectural Review Commission City of Palm Desert MISC24-0009 Bravo Gardens Revisions Page 4 of 5 Findings ARC approval is required for all Design Review applications per PDMC Section 25.68.020 (A). Findings for ARC decisions are listed under PDMC Section 25.68.040 – Findings of the ARC. Findings in support of the project are listed below: To approve a design review application, the ARC shall find the following: A. That the proposed development conforms to any legally adopted development standards. The project is in conformance with the proposed development previously approved by the City Council per Resolution No. 2018-18. The approved proposal conforms with legally adopted development standards set forth by the PDMC for the PR zoning district. The project does not propose a scope that would impact the previously analyzed and approved project that confirmed conformance with legally adopted development standards. B. That the design and location of the proposed development and it s relationship to neighboring existing or proposed developments and traffic is such that it will not impair the desirability of investment or occupation in the neighborhood; and that it will not unreasonably interfere with the use and enjoyment of neighbor ing existing or proposed developments and that it will not create traffic hazards or congestion. The amended design continues to be compatible with surrounding developments in the area in terms of residential density, design, and parking provided as previ ously approved by the City Council. The revision to the architecture is equivalent in character and quality to the original approval and does not adversely impact surrounding developments. C. That the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan of the City. The revised architecture continues to be compatible with the development pattern within the surrounding area of the proposed 388 multi -family dwellings contained within two- and three-story buildings as previously determined by City Council. The property is designated Town Center Neighborhood in the General Plan. Land Use Policy No. 3.21 (Infill Neighborhoods), in existing developed areas, the City encourages development that repairs connectivity, adds destinations, and encourages complete neighborhoods. The proposed project supports the expansion of housing by providing high-quality residential development that is within a vacant property fronting Hovley Lane East. The revision to the architecture is equivalent in character and quality to the original approval and does not adversely impact surrounding areas. D. That the design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors, and that it is aesthetically of good composition, materials, textures, and colors. 12 Architectural Review Commission City of Palm Desert MISC24-0009 Bravo Gardens Revisions Page 5 of 5 The revised project continues to utilize high-quality finishes and features a quality Spanish Colonial Revival design characterized by gable roofs, varying rooflines, balconies, and desert compatible colors as originally approved. The buildings will provide for a quality visual aesthetic along Hovley Lane East. The project also includes previously approved extensive onsite landscaping and amenities which are located in central areas of the development where it is easily accessible for use by all residents of the apartment community. E. That the proposed use conforms to all the requirements of the zone in which it is located and all other applicable requirements. The amended development conforms with legally adopted development standards set forth by the Planned Residential zone. The proposed project does not include any change of use and conforms with all applicable development standards as previously analyzed and approved. F. That the overall development of the land shall be designed to ensure the protection of public health, safety, and general welfare. The amended project did not change the originally designed site plan, which included hard surface pedestrian pathways and connections from the public right-of-way to ensure walkability throughout. The preliminary grading plan has been reviewed to ensure the design of the project incorporates the proper improvements including, adequately sized retention basins for onsite drainage. RECOMMENDATION: Staff recommends the ARC approve the request for Design Review approval, determining the requirements of the findings have been met including an exception for illumination of the signs. BACKGROUND/ANALYSIS: The Applicant, Signarama, is requesting design review approval for two new, internally illuminated, wall mounted signs, approximately 24 square feet each in area, on the north entry of the residential complex facing Technology Drive and at the southwest entry of Gerald Ford Drive. Approval of the signs would set the guidelines for sign criteria, including size, location, construction, height, length, and illumination for the two (2) apartment identification signs. On June 11, 2024, City staff requested the Architectural Review Commission (ARC) continue the item until June 25, 2024, to provide staff additional time to obtain information regarding modifications to the entry block wall for the proposed signage and logo prior to the ARC review. Project Summary: A. Property Description On March 15, 2022, the City of Palm Desert Planning Commission adopted Resolution No. 2809, which approved Precise Plan (PP) 21-0009 to construct a 330-unit apartment development located on Parcel 7 of Parcel Map 36792 at the southeast corner of Gerald Ford Drive and Technology Drive, within the Millenium Specific Plan. The Planning Commission approved this project after the Architectural Review Commission (ARC) approved the design of the building on December 14, 2021. Conceptual Sign design or standards for the building were presented as part of the Design Review. Project approval by the Planning Commission included a condition of approval requiring proposed signage be submitted for review and approval. Building permits have been issued, and the project is currently u nder construction. The applicant has submitted SARC24-0008 per the condition of approval. 37 Architectural Review Commission City of Palm Desert SARC 24-0008 – Millennium Specific Plan Page 2 of 6 B. Project Description The Applicant is proposing two new entry wall signs and construction of modified entry block walls that include the following detailed information: Modification of entry block wall materials and colors and include the construction of a trellis as an architectural design feature. (See analysis) The “M” logo sign would be made of a translucent aluminum channel letter face with painted multi-colored (gray, green, salmon, and navy blue) proposed at approximately 13 square feet. The sign would have 1/4” aluminum cutouts, white backing, and internal white 7000k LED illumination. (Sheets 2 and 3, Attachment 1). The individual channel letters “Millennium Apartments” are ¼” thick aluminum painted gloss black on studs, approximately offset 1.0” from the block wall below the “M” logo sign and measuring a maximum of 8” in letter height, which accounts for the capital “A” and descender “p” in “Apartments”. The sign letters would not be illuminated. ANALYSIS Development Standards The purpose of the Design Review is to determine if the sign is in conformance with the following requirements: Palm Desert Municipal Code Sections 25.68.050 and 25.56.070 (C) PP21-0009 Condition of Approval Millennium Specific Plan 38 Architectural Review Commission City of Palm Desert SARC 24-0008 – Millennium Specific Plan Page 3 of 6 To achieve quality, well-designed signs that enhance the previously approved PP21-0009 and neighborhood area, the ARC considers the following elements in evaluating a sign permit application: Ensure sign visibility and legibility, including letter height and legibility, contrast background relationship, placement, and location. Intensity of sign illumination of the “M” sign logo does not adversely impact surrounding neighborhoods or businesses in the vicinity. The relation of the signs to the architectural design of the entry wall and building. An attractive scale between the sign and the entry wall shall be maintained. Ensure the graphic design of the sign logo emphasizes simplicity and identification. Block Wall Modification (Wall24-0036) to approved (Wall23-0027) Permit The developer submitted a block wall modification plan which was reviewed by staff. Revisions were to the entry block walls on which the entry wall signs will be mounted and include: Exterior color change to Masonry Jared Tan which would be applied to the ground face CMU block wall. The entry block walls are 7’-4” in height and approximately 17’-4” in length for the Technology entry and 12’ in length for the Gerald Ford Drive entry. A single panel steel trellis approximately 11 feet in height with a color finish of Pale Beach DE6199. The proposed Millennium Apartments signage and “M” logo would be installed onto the entry block walls, as shown on (Sheet 4, Attachment 1). The remaining exterior perimeter wall varies between 6 and 9 feet in height from the finished grade with a CMU block material and plaster finish color to match the architecture of the apartment building consistent with the approved Precise Plan PP21- 0009. The color and material modification of the entry block walls and trellis feature are intended to relieve the massing of the perimeter wall surfaces on the north and south wall entries to the Millennium Apartment Complex. Therefore, as proposed, the minor modifications to the entry walls for Technology and Gerald Ford Drive are in substantial conformance with the original approval PP21-0009, Millennium Specific Plan, and Palm Desert Municipal Code Section and 25.56.070 (C). Information on the entry walls are included as reference and are not within the purview of the sign design review under consideration for SARC24-0008. No additional changes are proposed to the site plan, landscape plan, building elevations, or parking areas from the original entitlement, except for minor modifications to the exterior entry walls as mentioned. Section 25.56.070 (C)(3) of the Zoning Ordinance allows a maximum of 40 square feet of sign face area per sign face with a maximum of 6 feet in height, for residential community identification signage. The signs proposed are 4’-2” in width, with a sign face at 5’-7” in height. The signage height and proposed M logo internal illumination will not adversely affect adjacent properties. Section 25.68.050(C)(5) allows the ARC to review signs unique in design consistent with the required findings under Section 25.68.050. Staff believes that the proposed signs are suitable for the residential Millennium Apartments complex and that the design does not detract from the surrounding area. Further, the signs are appropriately sized and clear enough to be visible from 39 Architectural Review Commission City of Palm Desert SARC 24-0008 – Millennium Specific Plan Page 4 of 6 Technology and Gerald Ford Drive while blending well with the architectural features of the perimeter wall and the apartment aesthetics. Zoning Ordinance Summary: Findings for ARC decisions of sign design review applications are listed under Palm Desert Municipal Code (PDMC) Section 25.68.050(D) as follows: A. That the sign is necessary for the applicant's enjoyment of substantial trade and property rights. The number and location of signs are necessary to provide adequate identification to residents and visitors to the Millennium Apartment complex as they are located at the entry locations from Technology Drive and Gerald Ford Drive. The proposed signs are needed to identify the Millennium Apartment complex for vehicles and pedestrians passing along Technology Drive and Gerald Ford Drive. At their proposed location and size, the signs are scaled appropriately based on the building architecture where they are placed on the modified entry block walls. Additionally, the proposed signage is in conformance with the legally adopted development standards set forth by the PDMC for the Millennium Specific Plan, Chapter 25.56 (Sign Ordinance), including the condition of approval of Precise Plan 21-0009 requiring a sign permit application for review before construction. B. That the sign is consistent with the intent and purpose of this chapter and title. The project is located within the Millennium Specific Plan (PR-22) zoning district and is subject to Chapter 25.56 (Sign Ordinance) Signage Guidelines requirements. The proposed entry wall mounted signs will be located at en tryways (Technology and Gerald Ford Drive) and serve as the apartment complex's primary identification signage. The entry wall mounted signs will be designed to be consistent with the approved Millennium Apartments (PP21- 0009), the City's Sign Ordinance standards, and the Millennium Specific Plan. The proposed entry wall mounted signs are integrated with the apartment complex aesthetic design and do not impact existing use or neighborhood development, nor are they expected to generate traffic hazards or congestion. C. That the sign does not constitute a detriment to public health, safety, and welfare. The approval of the sign review will not be detrimental or injurious to property or improvements in the vicinity, harmful to the public health, safety, general welfare, or convenience in that the placement and appearance of the projecting signs do not pose safety hazards, nor do they detract from the subject building or surrounding properties. Therefore, it has no adverse impacts on public health, safety, or general welfare protection. D. That the size, shape, color, height, and placement of the sign is compatible with and will have a harmonious relationship to the building it identifies, the surrounding neighborhoods, and other signs in the area. 40 Architectural Review Commission City of Palm Desert SARC 24-0008 – Millennium Specific Plan Page 5 of 6 The proposed signage and paint colors are compatible with adjacent buildings. The proposed signage materials, logo, paint color, and illumination will provide a high-quality visual appearance that identifies the Millennium Apartment complex. E. That both the location of the proposed sign and the design of its visual elements (lettering, words, figures, colors, decorative motifs, spacing, and proportions) are legible under normal viewing conditions prevailing where the sign is to be located. The signs are oriented to be visible for vehicles and pedestrians passing along Technology Drive and Gerald Ford Drive. As proposed, the sign visibility and legibility, including letter height and legibility, contrast background relationship, placement, and location, are consistent with the Millennium Specific Plan (PR-22) zoning district and requirements of Chapter 25.56 (Sign Ordinance) Signage Guidelines. F. That the location, height, and design of the proposed sign does not obscure from view or unduly detract from existing or adjacent signs, and does not in any way compromise the health or safety of any person(s). The approval of the sign review will not obstruct views from existing or adjacent signs, nor be detrimental or injurious to property or improvements in the vicinity, harmful to the public health, safety, general welfare, or convenience in that the placement and appearance of the projecting signs do not pose safety hazards, nor do they detract from the subject building or surrounding properties. The proposed signage design, paint color, and location align with the character of the approved apartment complex and surrounding buildings within the immediate area. The signs are compatible with the scale of the modified entry block wall where they are placed. The nighttime sign illumination is designed to minimize negative impacts on surrounding properties and will not create hazardous glare for pedestrians or vehicles. Additionally, the sign paint colors are harmonious with the apartment complex and do not adversely impact surrounding developments. Therefore, it has no adverse impacts on public health, safety, or general welfare protection. G. That the location and design of the proposed sign, and its size, shape, illumination, and color are compatible with the visual characteristics of the surrounding area so as not to detract from or cause depreciation of the value of adjacent developed properties. The proposed signage materials, logo, paint color, and illumination will provide a high-quality visual appearance. The proposed entry block wall mounted signs are internally illuminated at night and are approximately 24 square feet in area. The sign and materials are consistent with the Millennium Apartment complex and surrounding properties. The nighttime sign illumination is designed to minimize negative impacts on surrounding properties and will not create hazardous glare for pedestrians or vehicles nor cause depreciation of the value of adjacent developed properties. H. That the location and design of a proposed sign in close proximity to a residential district does not adversely affect the value or character of the adjacent residential uses. 41 Architectural Review Commission City of Palm Desert SARC 24-0008 – Millennium Specific Plan Page 6 of 6 The proposed signs are appropriately designed for both daytime and nighttime use and located on the entry building block walls at Technology Drive and Gerald Ford Drive. The signs are suitable for the residential Millennium Apartments complex, and the design does not detract from the surrounding area nor impact residents within the district location. I. That any neon tubing used in conjunction with any sign is incorporated as an integral part of the sign design with careful attention to color, intensity of light, and the use of colors that are not overly bright. Neon tubing is not proposed as part of the sign materials. J. That the quantity of information displayed in the sign does not cause visual clutter . The signage text is limited to the name of the apartment complex and their logo. The proposed signage would maintain and enhance the quality of the Millennium apartment complex appearance, by limiting signs to avoid clutter and providing an aesthetically complementary design.
