SUBJECT: CONTROL BURN BY FIRE DEPARTMENT

DISCUSSION :
The Fire Marshal , Mike McConnell would like City Council
permission to control burn the vacant structures on a 10 acre
site on Monterey Avenue known as parcel 627-061 -038-5 , across
from the Palm Desert Town Center . This control burn enables the
fire fighters to gain valuable experience .
The owner of the property has given the Fire Marshal the approval
to burn the structures considered by the Code Compliance
Department to be a fire hazard .
Upon Council approval , the Fire Marshal would then contact the
South Coast Air Quality Management District to determine the
date of the burn .
RECOMMENDATION :
Staff recommends approval .

Dear Capt. McConnell :
This letter is to inquire about the possibility of your department
conducting a controlled burn of building structures located at 44-
544 Monterey Avenue in Palm Desert . These buildings are presently
unoccupied and boarded up. We have been informed they are being
broken into, lived in by transients, and have become a general
nuisance for the City and the neighborhood .
We at Charter Communities own the 10-acre site on which these
buildings are located and are proceeding to finalize working
drawings for development of a Residential Care facility on the
site . We would, therefore, be demolishing these buildings
sometime within the next several months . We have been approached
by the City of Palm Desert and informed by their Code Enforcement
Division that the buildings, in fact, are a nuisance .
We would be willing to allow the Fire Department to practice
firefighting techniques in a controlled situation should that be
desirable and the timing meet with your needs in the near future .
Enclosed with this letter is a copy of the legal description of
the property as well as a survey showing the location of the
buildings . If you have any questions or need further legal
documentation in order to proceed, please feel free to contact me
or give me a call .
