Warner, Assistant City Manager 4\-- t- DATE: August 18, 1988 Clark's Offic03 SUBJECT: Proposed JPA Amendment to include JoslynCo ve C ve Senior Center RECOMMENDATION: Staff recommends the city council: 1. Authorize the mayor to execute the third amendment to the Joint Powers Agreement for the Cove Communities Public Safety Commission to allow for the inclusion of certain activities related to the funding support for the senior center (attachment A). 2. Appropriate $77,500 to account number 110-4810-3693 from the unobligated general fund balance. DISCUSSION: During budget deliberations for FY 88-89 council instructed staff to explore methods of ensuring a straightforward and fiscally sound process for allocating support funds for the operation of the Joslyn Cove Senior Center. The recommendation was prompted by two factors: 1) senior center budget requests which have been increasing dramatically and, 2) a desire to coordinate funding decisions between the cities of Rancho Mirage, Indian Wells and Palm Desert. The city managers and myself met to discuss alternatives for accomplishing these goals and to review the operations and budget for the senior center. As a result of these discussions it was determined that: 1. An amendment to the existing JPA for public safety would allow for monitoring and budget allocation decisions to be made by representatives of all three cities at one time; 2. The existing non-profit corporation and board of directors could be left intact to run the day to day operations of the center while providing information and receiving public funds support from the Cove Communities JPA; 3. The budget as currently proposed for the senior center is reasonable and does not have significant areas for reduction. The primary reason for the increased needs is operational expenses of the soon to be built addition; and JPA AMENDMENT 4. An allocation formula for ongoing support by all three cities would be desirable. The method used for CVAG dues was chosen (ie, 50% population/50% assessed value). For 1988/89 the cities' allocations will be: Palm Desert $107,500, Rancho Mirage $64,500, Indian Wells $28,000. Staff believes these steps will provide a framework to effectively monitor and coordinate governmental support to the senior center. GIBSON /dlg 9 CONTRACT NO. 00-316 Revised 7/13/88 ATTAC I is "A" Revised 7/15/88 THIRD AMENDMENT JOINT POWERS AGREEMENT FORMATION OF COVE COMMUNITIES PUBLIC SAFETY COMMISSION THIS THIRD AMENDMENT is made and entered into by the City of Indian Wells, City of Palm Desert and the City of Rancho Mirage. RECITALS WHEREAS, pursuant to Section 6500 et seq. of the Government Code, the parties have heretofore entered into an agreement on October 8, 1981, entitled "Joint Powers Agreement, Formation of the Cove Communities Fire Commission" (the "Agreement") ; and WHEREAS, the parties to the joint powers agreement desire to collectivelycontribute c ntri ute financial support to the Cove Communities Senior Association, a California Non-Profit Public Benefit Corporation, aka the Joslyn Cove Communities Senior Center (the "Senior Center") , located at 73-750 Catalina Way, IIII Palm Desert, California; and WHEREAS, it is the purpose of this amendment to designate the Commission to act on behalf of the parties: COVENANTS NOW, THEREFORE, in consideration of the mutual promises and agreements herein contained, the parties agree as follows: 1 0 1. Amendment. The parties agree that Paragraph 9 of the Agreement is hereby amended to provide as follows: CONTRIBUTIONS 9 . Prior to April 1 of each year the Commission shall adopt a preliminary budget of expenditures for the following year. The preliminary budget shall contain the estimated amount of contributions that will be required from each member to finance the proposed budget. The amount of the contribution required from each member shall be a percentage of the total budget established as follows: (a) Public Safety. The percentage of the total budget attributable to each member agency to pay all public safety costs and expenses incurred by the Cove Communities Public Safety Commission shall be established each year on the basis of the assessed valuation of taxable property of each member agency as follows: Assessed Valuation of Member Agency - Percentage of Assessed Valuation Member Agency (%) of All Member Agencies The assessed valuation of taxable property of each member shall be determined based upon the last equalized assessment roll of the County of Riverside existing at the time of adoption of the preliminary budget, as specified under Section 2050 et seq. of the Revenue and Taxation Code. 2 0 (b) Senior Center. The percentage of the total budget attributable to each member agency to pay contributions to support a portion of the operating expenses for the Joslyn Cove Communities Senior Center incurred by the Cove Communities Public Safety Commission shall be established each year on the basis of fifty percent (50%) population and fifty percent (50%) of the assessed valuation of taxable property of each member agency in accordance with the formula method for membership dues as established by Coachella Valley Association of Governments (Sample made apart hereof as Exhibit "A") . (c) Budget. The proposed budget shall be submitted to each member agency for approval. The final budget shall not be adopted by the Commission until a majority of the parties have approved of the proposed budget as originally adopted or as modified by the Commission. If the final budget exceeds the current budget by more than 15%, it must be approved by all parties. The contributions required from tram each party to fund the final budget shall not exceed the estimated amount contained in the preliminary budget as originally adopted or as modified. The parties, when informed of their respective contributions, shall pay the ,same within 30 days after the receipt of billing of charges. 2 . Effective Date. This Third Amendment shall become effective upon execution by all of the above-mentioned parties.
