SUBJECT: I-10/Cook Street Interchange Project - Transfer of Right-of-Way
DATE: September 9, 1999
RECOMMENDATION:
THAT THE CITY COUNCIL APPROVE THE TRANSFER OF THE RIGHT-OF-WAY
TO THE STATE OF CALIFORNIA FOR PARCELS 30346-1 (Hawn) AND 30344-1
(TMP); AND AUTHORIZE THE MAYOR TO EXECUTE THE ENCLOSED GRANT
DEEDS.
BACKGROUND:
On December 8, 1996, the City of Palm Desert entered into a Memorandum of Understanding
(MOU)between CVAG, the City of Palm Desert and the County of Riverside. The purpose of
the MOU was to define the roles and responsibilities, and contribution levels of the three Agencies
with regard to the construction of the Cook Street and Monterey Avenue I-10 Interchanges.
Through the MOU, the City of Palm Desert agreed to utilize advance funding from CVAG to
acquire the right-of-way necessary to construct the Cook Street/I-10 Interchange. In addition,
the City agreed to transfer this right-of-way to the appropriate agency once construction was
complete.
The City currently holds the Grant Deeds for right-of-way within the State of California
jurisdiction. The recommended action will formally transfer to the State the right-of-way within
its jurisdiction. The Council took a similar action on December 11, 1997, transferring right-of-
way to the County of Riverside.
Public Works staff recommends that the City Council approve the transfer of the right-of-way to
the State of California for Parcels 30346-1 and 30344-1; and authorize the Mayor to execute the
enclosed Grant Deeds.
