SUBJECT: REVISED REPORT Request for Ratification of Soil Procurement:
I-10 Interstate and Cook Street Interchange;
Project No. 658-95;

RECOMMENDATION:
By Minute Motion; Ratify the procurement of 140, 000 Cubic Yards of
Soil from Southwest Excavators, Inc. at a not to
exceed cost of FOUR HUNDRED SEVENTY FIVE THOUSAND
($475,000) plus a contingency of TEN ( 10%) PERCENT
for use in on the north side of the Cook & I-10
Interchange Project; Project 658-95 .
BACKGROUND:
Recently, the City has report an unsolicited proposal for the
procurement & stockpiling of import borrow fill dirt locally, for a cost
below the current competitive rate. This soil will be utilized for
construction of the ramps on the north side of the Cook & I-10
Interchange.
After reviewing the circumstances, the City Attorney has advised that
the procurement of soil does not require competitive bidding. However,
current competitively bid prices for the soil and it transportation to
this same stockpile via a CVWD contract just bid yielded costs that were
41% higher. Additional research has shown that the final placement of
this soil will bring the total cost of the soil to a level of about 75%
of the CalTrans Project Report budgeted amount.
An earlier attempt to provide this soil failed in the final cost
negotiation. This soil procurement is based on a written cost proposal.
The expedited action to purchase this soil is required to prevent the
possib'.lity of losing part of the dirt to other private area projects .
Additionally, this action will expedite the construction and CVAG
construction expenditure reimbursements .

After the original Staff Report was submitted, the Supplier approached
the City Staff with the possibility of additional Project savings .
Based upon these discussions Staff is recommending an amendment to allow
for 120,000 cubic yards of soil compacted in place and 20,000 cubic
yards of soil stockpiled on the north side of Varner Road.
The Supplier has agreed to provide 120,000 CY compacted in place at
$3 .45 per CY, or $414,000. The Engineer' s and Caltrans ' estimates were
$6 . 00 per CY. Additionally, the Supplier will stockpile 22, 000 CY at
$2 . 90 per CY, or $58,000. This soil could be placed in August without
impacting the Varner Road relocation work. Having the ramp embankment
started early would speed the completion date, as well as providing
significant visual impact regarding the progress of the Cook & I-10
Interchange construction.
CONCLUSIONS:
Staff recommends that City Council ratify the procurement of 140,000
Cubic Yards of Soil from Southwest Excavators, Inc. at a not to exceed
cost of FOUR HUNDRED SEVENTY FIVE THOUSAND ($475,000) plus a contingency
of TEN ( 10%) PERCENT for use in on the north side of the Cook & I-10
Interchange Project; Project 658-95 .
