City of Palm Desert Page 1 ALL ACTIONS ARE DRAFT, PENDING APPROVAL OF THE MINUTES CULTURAL RESOURCES PRESERVATION COMMITTEE CITY OF PALM DESERT, CALIFORNIA MINUTES (HYBRID MEETING) Pursuant to Assembly Bill 2449, this meeting will be a hybrid meeting with in-person public access to the meeting location. 1.CALL TO ORDER A Regular Meeting of the Cultural Resources Preservation Committee was called to order by Principal Planner, Nick Melloni, on Tuesday, April 25, 2023, at 8:31 a.m. in the Development Services Conference Room, City Hall, located at 73510 Fred Waring Drive, Palm Desert, California. 2.ROLL CALL Present: Committee Members; Paul Clark, Don Graybill, Vice Chair Kim Housken, Chair Rochelle McCune, Thomas Mortensen, and David Toltzmann. Absent: None City Staff Present: Richard Cannone, Director of Development Services; Rosie Lua, Deputy Director of Development Services; Nick Melloni, Principal Planner; Jason Finley, Chief Building Official; Todd Hileman, City Manager; Anthony Mejia, City Clerk; and Melinda Gonzalez, Recording Secretary, were present at Roll Call. 3.NON-AGENDA PUBLIC COMMENT Principal Planner Melloni opened the non-agenda public comment period. City Clerk Mejia addressed the committee and provided an informational update on the new requirements for remote participation for appointed body members. There were no additional public comments provided. Principal Planner Melloni closed the non-agenda public comment period. 4.CONSENT CALENDAR Principal Planner Melloni opened and closed the public comment period for the Consent Calendar. Tuesday April 25, 2023 8:30 a.m. Regular Meeting Item 4A - 1 Cultural Resources Preservation Committee Minutes April 25, 2023 City of Palm Desert Page 2 ALL ACTIONS ARE DRAFT, PENDING APPROVAL OF THE MINUTES A.APPROVAL OF MINUTES MOTION BY COMMITTEE MEMBER CLARK, SECOND BY VICE CHAIR HOUSKEN, CARRIED 6-0; to approve the Cultural Resources Preservation Committee Regular Meeting minutes of August 30, 2022. CONSENT ITEMS HELD OVER None 5.ACTION CALENDAR None 6.NON-ACTION ITEMS A.CONTINUED DISCUSSION of Cultural Resources Preservation Committee (CRPC) Workplan for Fiscal Year 2023/2024. Principal Planner Melloni acknowledged and introduced the Draft Work Plan which was provided to the Committee in their agenda packet. Principal Planner Melloni explained that the work plan was developed from Committee discussion at the Study Session held in November 2022 and introduced the topics listed on the Draft Work Plan including GIS Resources, Mills Act, Certified Local Government (CLG) Application, Cultural Resources Surveys, and Certificate of Appropriateness Application. Principal Planner Melloni reported to the Committee, staff has conducted some preliminary inquiries with the administrators of the CLG program, the Office of Historic Preservation (OHP), to see where the City of Palm Desert (“City”) stood on submitting a successful application. City staff is working with the OHP staff on developing a preliminary CLG application for the City. Further discussion ensued amongst the Committee on this topic as well as the others, with staff providing supplemental information to the Committee as needed or requested. Principal Planner Melloni moved onto the next item and acknowledged the list of proposed additions to the CRPC draft work plan. He advised the list included proposed items by Chair McCune and staff is requesting committee members provide their own proposed items for the work plan, listed in order of priority. City Manager, Todd Hileman recommended the Committee identify their top (five) 5 to 10 priorities for the work plan and provide them to staff. Staff will compile the information and evaluate it to determine the Committees collective top five (5) proposed work plan items, in order of ranking. Discussion ensued amongst the Committee and staff. It was decided that a Special Meeting would be held on May 5, 2023, to further discuss the CRPC work plan, with the potential for additional meetings to be held on the matter. MOTION BY COMMITTEE MEMBER CLARK, SECOND BY VICE CHAIR HOUSKEN, CARRIED 6-0; to schedule a Special Meeting on May 5, 2023, to discuss the FY23-24 CRPC Work Plan. Item 4A - 2 Cultural Resources Preservation Committee Minutes April 25, 2023 City of Palm Desert Page 3 ALL ACTIONS ARE DRAFT, PENDING APPROVAL OF THE MINUTES B. DISCUSSION regarding Certificate of Appropriateness Application. Principal Planner Melloni reported staff is currently working on updating all Planning division applications and this will include the current Certificate of Appropriateness application. The application will be revised to reflect the new application format and will include handouts. Staff will present a draft of the revised application to the Committee at a future CRPC meeting. 7.PUBLIC HEARINGS: Anyone who challenges any hearing matter in court may be limited to raising only those issues he or she raised at the public hearing described herein, or in written correspondence delivered to the Cultural Resources Preservation Committee at, or prior to, the public hearing. Remarks shall be limited to a maximum of three minutes unless the Cultural Resources Preservation Committee authorizes additional time. A.CONSIDERATION FOR A DESIGN REVIEW TO APPROVE THE ISSUANCE OF A CERTIFICATE OF APPROPRIATENES FOR THE CONSTRUCTION OF A NEW DETACHED RESIDENTIAL ACCESSORY BUILDING ON A SITE CONTAINING AN EXISTING LANDMARK GENERALLY KNOWN AS THE MILES C. BATES HOUSE LOCATED AT 73697 SANTA ROSA WAY. Principal Planner, Nick Melloni, narrated a PowerPoint presentation on the item and responded to Committee inquiries. Gil Stayner, Applicant, was present and answered questions from the Committee. Chair McCune opened and closed the public comment period. No public comments were provided. Discussion on the item ensued with Committee Members providing comments for the project. MOTION BY VICE CHAIR HOUSKEN, SECOND BY COMMITTEE MEMBER GRAYBILL, CARRIED 6-0; to approve Case No. COA23-0001 as presented and: 1.Approve the issuance of a Certificate of Appropriateness 2.Adopt a notice of exemption for a Class 3 Exemption. 8.INFORMATIONAL REPORTS & COMMENTS A.CULTURAL RESOURCES PRESERVATION COMMITTEE MEMBERS Chair McCune informed the committee of the Preservation Matters Event being held April 29th and 30th in Palm Springs. Vice Chair Housken provided additional information on the event adding interested parties need to register for the free event. B.CITY STAFF Deputy Director of Development Services, Rosie Lua, provided committee members a copy of Palm Desert Municipal Code (PDMC) Chapter 29.10.010 Purpose, as well as Ordinance No. 1390 which updated Chapter 29.30, CRPC Bylaws. C.ATTENDANCE REPORT The attendance report was provided with the agenda materials. The Committee took no action on this matter. EXECUTIVE SUMMARY The intent of this memorandum is to summarize the City Council’s acceptance of the Cultural Resource Preservation Committee’s (CRPC) proposed Work Plan for the 2023/2024 Fiscal Year, and generally outline next steps to achieve the work plan items over the course of the fiscal year beginning July 1, 2023. On June 8, 2023, the Palm Desert City Council received the draft of the CRPC’s Work Plan for the 2023/2024 fiscal year and accepted the plan as presented. This work plan consists of five (5) priority items, which were decided upon based on the consensus of the CRPC in a special meeting held on May 5, 2023. The priorities and next steps are summarized in the table below: Table 1 – Cultural Resource Preservation Committee 2023/2024 Priorities Priority Next Steps / Resources Cost 1. 50th Anniversary events, City events, and Modernism Week to include: • Explore creation of yard signs or similar device for residential properties 50 years or older Assign a subcommittee to work with public affairs regarding modernism week. CRPC will establish a subcommittee to plan for event participation during 2023. None anticipated. 2. Update and maintain inventory of current historical landmarks and make them available on the City’s website. • Convert the existing driving tour document to a Staff will update maps of historic resources and landmark districts to show locations on the City website using existing ESRI software resources. None anticipated. Item 5A - 1 Work Plan FY23-24 Page 2 of 3 June 27, 2023 Priority 1 Recommended next steps for the item are as follows: The CRPC will form a subcommittee to explore the creation of a yard sign or other device to identify properties which are 50 years or older and work with Public Affairs regarding participation in the City’s 50th anniversary event. Planning Division staff will seek guidance from the subcommittee and prepare a list of properties which are 50 years or older and initiate an outreach to property owners to gauge searchable document and reformat. •Provide a brochure on the website with links to informational resources on how to research a historic structure. 3. Establish a historic resources survey and a Citywide historic context statement. Staff will seek a consultant to prepare the survey and statement. $40,000 which was previously budgeted and allocated to the preparation of Objective Design Standards for Multifamily Housing may be re-allocated to the preparation this survey. $40,000 4. Seek certified local government (CLG) designation Staff will assess the potential to file an application and hire a consultant to prepare the application. Final approval of the application will require City Council Approval. $30,000 5. Continue to review Mills Act Contracts and consider requesting the Council modify or remove the application limits established by Resolution No. 2011-1. Staff will amend the resolution establishing the application process, and review procedures to implement the Mills Act by increasing the number of preservation agreements the City may enter into per calendar year or removing the requirement altogether. No direct cost at this time. Fiscal impacts will be assessed at time the resolution is modified. Item 5A - 2 Work Plan FY23-24 Page 3 of 3 June 27, 2023 interest in the program and present the findings to the subcommittee during the months of July and August for additional feedback and next steps. Priority 2 Planning staff will revise website listings to refer to the Planning Division rather than Building and Safety with anticipated completion by August/September 2023. Planning staff will also update maps to show all officially designated Historical Landmarks and Districts with links to information with anticipated completion by September 2023. Finally, Planning staff will explore turning the 2007 Bus Tour Exhibit into a story map with anticipated by September 2023. Priority 3 Planning staff will draft a request for proposal (RFP) Scope of Work to hire a consultant to prepare a Citywide Historical Resources Survey and Historic Context Statement to present to City Council later this year. The study will be intended to identify and document potentially significant resources more than 45 years of age with the appropriate National Register Status Code and evaluate potential eligibilities to be included in National and State Registers. Proposals received will be evaluated by a selection committee comprised of City staff. Priority 4 Planning staff will work with staff at the California Office of Historic Preservation (OHP) to assess eligibility before formally applying to become a Certified Local Government (CLG). Staff will assess what additional steps are necessary based on OHP feedback. Priority 5 Planning staff will draft a revised ordinance to increase the number of Mills Act Contracts that can be processed in a fiscal year. The current resolution limits the total at seven (7) applications. Staff anticipates having an item ready to present to City Council in August. Recommendation: 1. Form a subcommittee to discuss the implementation of Priority 1 of the 2023/2024 Work Plan.
