Recommendation:
By minute motion, authorize staff to submit Grant of Easement
documents for Calle de Los Campesinos to Coachella Valley Water
District.
Executive Summary:
At the May 27, 2004 meeting the City Council directed staff to acquire the necessary
easements to provide public access on Calle de Los Campesinos. We have worked with
the CVWD staff and have prepared the necessary documents for the Grant of
Easement.
Therefore, staff recommends that City Council, by minute motion, approve the Grant of
Easement documents as to form and that staff be authorized to present the documents
to CVWD and request that the easement be granted.

FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
COACHELLA VALLEY WATER DISTRICT
hereby grants to the CITY OF PALM DESERT, a municipal corporation, the following
described real property in the City of Palm Desert, County of Riverside, State of California:
AN EASEMENT FOR ROAD PURPOSES OVER THAT CERTAIN PROPERTY
DESCRIBED IN A LEGAL DESCRIPTION AND PLAT ATTACHED HERETO AND MADE
A PART HEREOF AS EXHIBITS "A" AND "B" RESPECTIVELY.

An easement 40 feet wide in the City of Palm Desert, County of Riverside, State
of California over those portions of land described in the Grant Deeds to the
Coachella Valley County Water District recorded October 7, 1958 in Book 2343,
Pages 522 through 525 (Instrument No. 71827), and recorded January 25, 1950
in Book 1142, Pages 135 through 137 (Instrument No. 3191) of Deeds in the
Office of the County Recorder of said County of Riverside, the westerly line of
which is described as follows:
Beginning at a point in the easterly line of Parcel 3 of Parcel Map No. 31056 in
said City of Palm Desert as per map filed in Book 209, Pages 65 and 66 of
Parcel Maps, Official Records of said County, said point also being the
northeasterly corner of that certain parcel of land described in the Deed to the
Coachella Valley Water District Recorded March 28, 1992 as Instrument No.
192571 in the office of the County Recorder of said County, said point is also the
beginning of a curve concave to the west having a radius of 1045.00 feet, a radial
line through which point bears S 72° 46' 39" E;
thence along said curve and said easterly line of Parcel 3 northerly 265.69 feet
through a central angle of 14° 34' 03";
thence along the easterly line of Parcels 3, 2 and 1 of said Parcel Map No. 31056
N 02° 39' 18" E 502.72 feet to the southeast corner of that certain parcel of land
described in the Deed to the Palm Desert Redevelopment Agency recorded May
3, 2000 as Instrument No. 2000 - 165890 in the office of the County Recorder of
said County;
thence along the easterly line of said parcel of land described in Instrument No.
2000 -165890 N 02° 34' 21" E 1427.29 feet to Point "A";
thence along said easterly line N 02° 34' 21" E 1158.55 feet to a tangent curve
concave to the west having.a radius of 1091.00 feet;

thence along said easterly line and said curve northerly 393.25 feet through a
central angle of 20° 39' 08" to the northeasterly corner of said parcel of land
described in Instrument No. 2000 -165890, together with:
Parcel A: A 28 foot easement lying 16 feet southerly and 12 feet northerly of
a line which commences at the hereinabove described Point "A";
thence S 87° 25' 39" E 40.00 feet to the True Point of Beginning;
thence S 87° 25' 39" E 110.00 feet to the easterly line of that
certain parcel of land described in said Grant Deed to Coachella
Valley County Water District recorded January 25, 1950
(Instrument No. 3191).
Said 28 foot easement to be located between the northerly and
southerly concrete barriers of the Thrush Road bridge (28 feet
wide).
The easterly line of said 40 foot wide easement to intersect with radial lines
through the Point of Beginning and the terminus point of the described westerly
line.
