Background: After the last used car sales events over Labor Day 2002, the Council directed staff to cease approving permits for these events. Previously, the Council had authorized at Westfield's request up to three sales per year in the off-season between Easter and Thanksgiving in the "back 40" parking lot. On March 12 a request was received from Sky Valley Resorts to display some of their RV/mobile cabins at the entrance of the mall at Plaza Way. Based on the Council direction and specific input from Councilman Spiegel, the request was denied. On March 21 Westfield submitted a request for car shows over Memorial Day, 4th of July and Labor Day weekends. Staff Report Temporary Uses at Westfield Shopping town Palm Desert Page 2 April 10, 2003 While parkinglot car sales are not specifically identified in Chapter 25.64 Temporary Uses, P Y they have been historically approved at limited locations based on Subsection 25.64.040.A which allows carnivals, circuses and other special private events for up to ten days per calendar year and Subsection F which allows the Planning Director to consider similar uses within the intent and purpose of the chapter. With only a few exceptions, the sales have occurred in the "back 40" parking lot at the mall. The Council's direction to cease approval of these sales was based on the conclusion that the negative image conveyed by these sales, associated signage and promotion were not worth the sales tax revenue received by the City. The City's sales tax share for a three-day event range between $8,000 to $10,000. Westfield receives between $9,000 to $15,000. Since the Sky Valley Resort event would not involve any on-site sales, there would be no city revenue. Discussion: Since used car sales are not a specifically listed temporary use, these approvals are purely discretionary. To approve or deny these requests can be based on weighing the benefits to the City and Westfield against the perceived negative impacts. Although it was suggested that the GPAC discuss this issue, it was never placed on the agenda. Normally this level of detail is not a subject of General Plan discussion. Conclusion and Recommendation: In periods of tight budgets, every revenue source can be important. Sales tax revenues of $30,000 for nine days of car sales is equivalent to the City's annual revenues received from a large successful restaurant. If sales events are scheduled in the off-season, located in under utilized low visibility areas with tasteful signage and promotion, negative image impacts can be minimized. Our current plan is to have three car or RV shows with local dealers on Memorial Day weekend (May 23-26th), Fourth of July weekend (July4-6th), and Labor Day weekend (August 29-September 1st). I am planning to hold all of the shows in the North 40 portion of our parking lot. These shows will bring approx. $3,000-5,000 per day to my budget and of course, will bring the City of Palm Desert sales tax revenue from the car sales. Such uses shall be so conducted that they will not be detrimental in any way to the surrounding properties or to the community.
