Gravel placed in planters adjacent to the parking lot shall match existing parking lot gravel. 2. Shipping container shall be new or like-new condition.3. ACTION CALENDAR 6.a CONSIDERATION TO APPROVE A DESIGN REVIEW FOR ARCHITECTURAL REVISIONS TO THE BRAVO GARDENS PROJECT (MISC24-0009) Principal Planner, Carlos Flores, narrated a PowerPoint presentation on the item and responded to Commission inquiries. Rachel Felton, Development Manager; Joy Brown, Office Manager; Vince Chupka, HPA Lead Architect; and Vely Zaljec, HPA Architect, were present. Chair Vuksic opened the public comment period and invited the applicant to speak. Vince Chupka, HPA Lead Architect; and Vely Zaljec, HPA Architect, introduced themselves and answered questions from the Commission. Motion Carried (6 to 0) 7. REPORTS & REMARKS 7.a ARCHITECTURAL REVIEW COMMISSIONERS Commissioner Colvard provided an update for the Cultural Arts Committee. A sculpture will be placed in the median on Portola between Gerald Ford and Dinah Shore. Another potential location for installation of a sculpture is on Cook Street between Gerald Ford and Frank Sinatra. Additionally, sculptures from Coachella Music festival have been installed in various locations in the Coachella Valley, with several in Indio and Coachella. 7.b CITY STAFF Principal Planner Flores provided the following updates. • On June 18, 2024, at the regular meeting of the Planning Commission the Shadow Ridge project was approved. Wildest Restaurant Patio also went before the Planning Commission and was continued with comments regarding the proposed wrap material for the storage container. This item will return to the Architectural Review Commission for a second review to explore alternative options. • The City is hosting a community meeting today, June 25, 2024, regarding the Pulte “Explorer” project, including the Refuge project, to provide information on the current project and hear concerns from surrounding neighbors. • Staff will be taking several items before the City Council at their next regular meeting of June 27, 2024, including two Award of Contracts; the first to the firm selected for the Unified Development Code update and the second for the firm selected to establish a historic context statement and to complete a City survey. Also, going to the City Council is an appeal of the Chief Building Official decision regarding the City's definition of a bedroom. Principal Planner Melloni provided the following updates. • Staff will be meeting with consultants, JKA Architects, who will be establishing objective design standards for the Downtown District and Hillside development. • Expiration of existing Temporary Use Permits for dining desks were extended by the City Council to June 2025 to accommodate businesses who will be impacted during the City's rehabilitation project for the streets 7 Architectural Review Commission Meeting Minutes June 25, 2024 4 and sidewalks on El Paseo. A Commissioner commented there should be consideration for inclusion of pop-outs on the sidewalk to allow for dining desks to improve the energy and atmosphere of El Paseo. 7.c ATTENDANCE REPORT The attendance report was provided with the agenda materials. BACKGROUND/ANALYSIS: Executive Summary:  Case No.: DR23-0015 (CUP23-0015) On May 28, 2024, the City’s Architectural Review Commission (ARC) considered a request by Charissa Farley-Hay (Applicant), for consideration of a Design Review to approve architecture and landscaping for an outdoor patio remodel for “W ildest Restaurant” (Restaurant), located at 72990 El Paseo, Suite #3 (Assessor’s Parcel Number: 640170013), within the Palms to Pines West Shopping Center. The project includes a 2,977 square foot (sf) outdoor permanent dining patio with a pergola/trellis, an 8’ x 40’ storage container (Container), block wall, pavers, and landscaping. The staff report for this item dated May 28, 2024, is attached to this report and provides more detailed information on the project proposal. The ARC took the following action on the item: Following discussion, MOTION BY CHAIR VUKSIC, SECOND BY COMMISSIONER MCAULIFFE, CARRIED 6-0 (VICE CHAIR MCINTOSH ABSENT); to approve Case No. DR23-0015 with the following conditions: 1. Roll-up door shall be further studied and reviewed by staff regarding its maintainability or be replaced with swinging metal doors. 2. A pilaster with the same stone cladding on the building shall be added to the opening at the northeast corner of the patio. 3. Gravel placed in planters adjacent to the parking lot shall match existing parking lot gravel. 4. Shipping container shall be new or in like-new condition. 9 Architectural Review Commission City of Palm Desert DR23-0015 Revised Page 2 of 2 On June 18, 2024, the City’s Planning Commission (Commission) considered the same project request at a public hearing for Conditional Use Permit approval. The Commission discussed the design of the proposed storage container and after discussion, motioned for the project to be returned to the ARC to refine the Container with a more elegant appearance ; then return to the Commission for further consideration. All other components of the project were found acceptable with exception to the Container. Project Summary: The Applicant has submitted a revised design for the Container. The revisions include: - The Container will be finished with wood panels bolt mounted to the container. - The wood panels will have a “wood grain” pattern and “Peruvian Teak” color, emulating the desert color palette of the restaurant. - The corners of the Container will have a trim finish, primed and painted to match the rest. - The Container doors will now be a 6’ x 6’-8” double door, rather than a roll up door. - The Container will include a tube frame welded to the container, with flat sleet slats welded to the tubs The Container will also include a new sign, that qualifies as a secondary sign under Palm Desert Municipal Code (PDMC) Section 25.56.080(C). The sign proposed is a non -illuminated, steel plaque sign with the Restaurant logo installed on the south facing elevation of the Container. The sign will be installed at the top of the Container’s elevation and measure 3’-2” in height and 4’-4” in length (13.68 square feet). The top of the sign plaque will be 8’-5 ¼” from the ground floor, extending 5” above the container and 4’ back on the top of the container. The existing sign on the south elevation is a 23.4 square foot illuminated building mounted sign. The combined square footage of the existing sign and the proposed sign is 37.08 square feet, which is under the maximum 50 square feet allowed. All other components of the project remain unchanged. Background The Restaurant occupies the south end of an in-line commercial building (Building) within the Palms to Pines West Shopping Center (Center). The Building has two (2) other commercial tenants and shares parking with four (4) surrounding multi-tenant commercial buildings within the Center. The Restaurant currently utilizes existing parking spaces for a temporary outdoor dining area and seeks approval to have a permanent outdoor patio dining area. Project Summary A. Property Description: The project site is a 1.12-acre parcel within the Center. The total usable area for patio dining purposes would be 2,233 square feet. 12 CUP23-0015 Wildest Restaurant Page 3 of 6 May 28, 2024 Architecture The proposal includes construction and installation of a 20’ x 40’ trellis, an 8’ x 40’ container, perimeter walls, and furniture within the patio, including tables, chairs, and a fireplace. Attachment 1 provides details on the proposed architecture of the expansion, which serves to expand the existing Restaurant, and can be summarized below: - Pergola: the Pergola is 10’ in height, 20’ in depth, and 40’ in length. It will be constructed of aluminum painted white installed with six (6) posts and include ceiling fans and heaters, downlights, and be used for dining. The posts will be cladded with stone veneer at a total height of 2’-4” on the post, to match existing building and wood molding. - Container: A container measuring 8’ in height, 8’ in depth, and 40’ in length will be located on the western part of the outdoor patio. The container will be galvanized steel painted white, have a vinyl print design wrapped around it, and include a mounted herb garden wall. The container will include a window, roller doors, and be used for Restaurant storage. - Block wall: A 40” high retaining wall to be constructed of grey and black precision block. The wall will use the combination of colors, offsetting colors by row. - Pavers: The patio will include pavers in graphite, foundry, and linen colors. Exhibit 2 - Renderings Landscaping The proposal includes landscaping on the perimeter, interior, and adjacent parking stalls, as shown in exhibit 3. The landscaping palette plan includes trees (pygmy date palms, palo verdes, palo blancos, and laurel figs), shrubs and accents, “Pink Powderpuff” vines, and green carpet natal plum ground cover. 13 CUP23-0015 Wildest Restaurant Page 4 of 6 May 28, 2024 Exhibit 3 – Landscaping Plan Analysis Pursuant to Palm Desert Municipal Code (PDMC) Section 25.68, the Architectural Review Commission is the designated authority to approve architectural modifications under a design review. In making a determination on a design review application, the ARC must make findings per PDMC 25.68.040: A. That the proposed development conforms to any legally adopted development standards. The project is subject to the development standards found in Palm Desert Municipal Code (PDMC) Section 25.16.050 Development Standards and meets all the development standards. The project does not propose extension of the physical restaurant building and instead proposes accessory structures, which meet the required development standards of the PDMC. 14 CUP23-0015 Wildest Restaurant Page 5 of 6 May 28, 2024 B. That the design and location of the proposed development and its relationship to neighboring existing or proposed developments and traffic is such that it will not impair the desirability of investment or occupation in the neighborhood; and that it will not unreasonably interfere with the use and enjoyment of neighboring existing or proposed developments and that it will not create traffic hazards or congestion. The project is within an existing shopping center and was reviewed to ensure proper circulation could be achieved, even with the loss of parking. The proposed architecture and landscaping will not create new impacts. The removal of the parking spaces will not create traffic congestion as there is adequate parking available within the rest of the shopping center. The patio is constructed to allow for safe and reasonable circulation. C. That the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan of the City. The proposed project blends well with the surrounding neighborhood, including the existing building and shopping center, by incorporating high-quality architecture and landscaping. The proposal includes accessory structures and uses that enhance the area and restaurant and are not determinantal to the development within the area. D. That the design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors, and that it is aesthetically of good composition, materials, textures, and colors. The proposed design utilizes durable finishes and features a quality contemporary style characterized by modern forms, quality finishes, and desert-compatible colors. The project provides quality pavers, textures (stone veneer, vinyl) and colors for a quality development. The patio is meant to expand existing restaurant operations to create a desirable restaurant experience for tenants and customers. E. That the proposed use conforms to all the requirements of the zone in which it is located and all other applicable requirements. The project has been previously reviewed and approved and found to comply with applicable requirements and is an expansion of an existing and allowed use. F. That the overall development of the land shall be designed to ensure the protection of public health, safety, and general welfare. The site plan and grading plan have been reviewed to confirm the design provides protection of the public’s health, safety, and general welfare. The site is adequately serviced by utilities and the grading plan was reviewed in accordance with City requirements. The project provides setbacks from adjacent and internal properties that meet the standards of the zone. 15 CUP23-0015 Wildest Restaurant Page 6 of 6 May 28, 2024 STAFF RECOMMENDATION Staff recommends the ARC determines that the requirements of the findings have been met based on the analysis and approves the Design Review. The ARC has the discretion to request the Applicant modify the design of the project before approving the case. Any modifications required should be added to the motion as a condition of approval. Project Plans 16 Palm Desert Planning Commission Meeting Minutes June 18, 2024 4 8.c CONSIDER ADOPTING A NOTICE OF EXEMPTION AND APPROVING A CONDITIONAL USE PERMIT FOR AN OUTDOOR PATIO FOR DINING PURPOSES FOR AN EXISTING RESTAURANT AT 72990 EL PASEO, SUITE 3 Principal Planner Flores narrated a PowerPoint presentation and responded to Commission inquiries. Chair Pradetto opened the public hearing. Zayda Braun, the Applicant's representative, stated the patio had been very successful since its opening and noted that the object of the project is to increase pedestrian traffic to the west side of El Paseo. Commissioner Gregory requested clarification regarding the function of the storage container, The Applicant representative responded that the container would be used for patio furniture storage, trash enclosure screen, and to provide an additional server station for those on the patio. Responding to further question, the Applicant's representative noted the structure could be clad in alternate materials, and expressed that the Applicant was open to suggestions for improvement. Chair Pradetto closed the public hearing, there being no member of the public wishing to speak. Chair Pradetto suggested adding a condition to specify the storage container not be wrapped in vinyl and to return to the Planning Commission for further approval. Motion by: Chair Pradetto Seconded by: Commissioner DeLuna Direct the project be returned to the Architectural Review Commission to refine the storage container with a more elegant appearance and bring back to Planning Commission for further consideration. BACKGROUND/ANALYSIS: Executive Summary: The proposal is a request by Michael Reilly (Applicant) for consideration of a Design Review to approve an amendment to the architecture for a guesthouse, located at 72240 Upper Way West.  Case No.: Design Review 24-0005 Amendment No. 1 (Related: PP21-0005 for a Hillside Development Plan) Background: In 2021, the Applicant submitted a Precise Plan request (PP21-0005) to construct an 1,103-square-foot (sf) guesthouse on a property with an existing single-family home located at 72240 Upper Way West, within the Hillside Preservation Residential (HPR) zone. Precise Plan 21-0005 was ultimately approved by the City Council on April 14, 2022, via Resolution 2022-28. In 2023, the Applicant prepared building construction plans and discovered that the location of the guesthouse was within an easement that doesn’t allow structures. Project Summary: The Applicant applied for a new Precise Plan (PP24-0005) to amend the approved Precise Plan PP21-0005, to move the 1,103-sf guesthouse to a new, allowable location on the property (Project). The Project would require Planning Commission and City Council approval. A. Property Description The property is a 5.06-acre lot composed of steep sloping areas and three graded pad areas (Property). One of these pads is developed with a 2,873 square foot, single-family residence and originally built in the 1960’s under the jurisdiction of the County of Riverside. There is no record of approval for the remaining graded pads. Much of the site is undevelopable due to the steep terrain. Access to the site is provided by a privately maintained paved access road that bifurcates the property. Properties to the north, south, and east are hillside areas developed with single-family residential dwellings. Properties further to the west are hillside conservation areas and the Stone Eagle Golf Club. B. The top of the roof will extend to a height of 16 feet, 7 inches and the central portion will sit at a height of 13 feet, 0 inches. As a response to the conditions placed on PP21-0005 by the ARC in 2022, the Applicant revised the originally proposed architecture as follows: - The guesthouse will not include a stone veneer element and will instead utilize smooth stucco finish throughout the building with a Gobi Desert paint finish. - The top of the flat roof color is Desert Tan and the fascia material is metal. Other applicable conditions provided by ARC in 2022 have been recommended by Staff to remain as conditions of approval for this project. Landscaping No revisions to the approved landscaping are proposed as part of this Project. The preliminary landscape plan approved as part of PP21 -0005 would remain effective for this Property. The proposed grading is minimal in the context of the site as only 3.2% of the existing lot will be disturbed by grading. The grading proposed will improve an existing un improved pad by re-naturalizing previously disturbed areas. C. That the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan of the City. The design of the proposed building features well-articulated building forms and quality, desert-compatible materials, and colors. The footprint is minimal and preserves large hillside open space areas on the property. The single-story building design is in keeping with the character of surrounding neighborhoods and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan. D. That the design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors, and that it is aesthetically of good composition, materials, textures, and colors. The project utilizes high-quality finishes and features a desert contemporary design characterized by earth tones and finishes to blend into the hillside area. The building is located high on the hillside providing a desirable environment for its occupants with minimal visibility from the nearest public street. E. That the proposed use conforms to all the requirements of the zone in which it is located and all other applicable requirements. The development conforms with legally adopted development standards set forth by the Hillside Planned Residential zoning district. Woodstoves, pellet stoves and fireplaces shall also comply with all applicable local ordinances. Division 4.5 – Environmental Quality (Pollutant Control) 4.504.1 Protection During Construction At the time of rough installation, during storage on the construction site and until final startup of the heating, cooling and ventilating equipment, all duct and other related air intake and distribution component openings shall be covered. Tape, plastic, sheet metal or other methods acceptable to the enforcing agency to reduce the amount of water, dust and debris entering the system may be used. 4.504.2.1 Adhesives, Sealant s and Caulks Adhesives, sealants and caulks used on the project shall meet the requirem ents of the following st andards unless more stringent local or regional air pollution or air quality managem ent district rules appl y: 1. Adhesives, adhesives bonding prim ers, adhesive primers, sealants, sealant prim ers, and caulks shall comply with local or reg ional air pollution control or air quality managem ent dist rict rules where applicable, or SCAQMD Rule 1168 VOC limits, as shown i n Tables 4.504.1 or 4.504.2 as applicable. Such products shall also comply with Rule 1168 prohibition on the use of certain toxic components (chloroform , ethylene, dichloride, m ethylene chloride, per chloroethylene, and trichloroethylene), except for aero sol products as specified in subsection 2 below. 2. Aerosol adhesives , and smaller unit sizes of adhesives, and sealant or caulking compounds (in units of product, less packaging, which do not weigh m or e than one pound and do not consist of more than 16 fluid ounces) shall com ply statewide VOC standards and other requirem ents, including prohibitions on use of certain toxic compounds, of California Code of Regulations, Title 17, comm en cing with Section 94507. 4.504.2.2 Paints and Coatings Architectural paints and coatings shall comply with VOC lim its in Table 1 of the ARB Architectural Suggested Control Measures as shown in Table 4.504.3 unless the more stringent local limits apply. The VOC content limit for coatings that do not m eet the definitions for the spec ialty coatings categories listed in Table 4.504.3 shall be determined by classifying the coating as Fl at, Nonflat , or Nonflat-High Gloss coating, based on its gloss as defined in subsections 4.21, 4.36, and 4.37 of the 2007 California Air Resources Board, Suggested Control Measure, and the corresponding Fl at, Nonflat, or Nonflat-High Gloss VOC limit in 4.504.3 shall com ply. 4.504.2.3 Aerosol Paints and Coatings Aerosol paints and coatings shall meet the Product-Weighted MIR Limits for ROC in Section 94522(a)(2) and other requirements, including prohibitions on use of certain toxic compounds and ozone depleting substances, in Section 94522(e)(1) and (f)(1) of the CCR, Title 17, commencing with Section 94520; and in areas under the jurisdiction of the Bay Area Air Quality Management District shall additionally comply with the percent VOC by weight of product limits of Regulation 8, Rule 49. 4.504.3 Carpet Systems Carpet installed in the building interior shall meet the testing and product requirements of 1 of the following: 1. A slab design specified by a licensed design professional. 4.505.3 Moisture Content of Building Mater ials Building materials with visible signs of water damage shall not be installed. Wall and floor framing shall not be enclosed when the framing members exceed 19% moisture content. Moisture content shall be verified in compliance with the following: 1. Moisture content shall be determined with either a probe-type or a contact-type moisture meter. Equivalent moisture verification methods may be approved by the enforcing agency and shall satisfy requirements in Section 101.8. 2. Moisture readings shall be taken at a point 2 feet to 4 feet from the grade-stamped end of each piece to be verifi ed. 3. At least 3 random moisture readings shall be performed on wall and floor framing with documentation acceptable to the enforcing agency provided at the time of approval to enclose the wall and floor framing. Insulation products which are visibly wet or have a high moisture content shall be replaced or allowed to dry prior to enclosure in wall or floor cavities. Manufacturers’ drying recommendations shall be followed for wet-applied insulation products prior to enclosure. Fans shall be ENERGY STAR compliant and be ducted to terminate outside the building. 2. Unless functioning as a component of a whole house ventilation system, fans must be controlled by a humidity control. a) Humidity controls shall be capable of manual or automatic adjustment between a relative humidity range of less than 50% to a maximum of 80%. b) A humidity control may be a separate component to the exhaust fan and is not required to be integral or built-in. The Sign will be framed with a 2’ x 2” x 1/8” aluminum frame bordering each sign and placed on top of an aluminum base measuring 6” in height and 77” in length. The Sign will be installed with an 18” x 96” concrete footing. The Sign frame will be a white “Swiss Coffee” color and the aluminum base a ”Tawny Amber” color, both intended to match the existing building , with a semi- gloss finish. The Sign will measure a total of 6’ in height, 8’ in length, and 18” in depth. Exhibit 2 – Sign Elevations Landscaping No new landscaping is proposed as part of this project as the proposed location is fully landscaped with decomposed granite (DG), two (2) trees, and shrubs. Zoning Ordinance Summary: Pursuant to Section 25.68.050 of the Palm Desert Municipal Code (PDMC), all freestanding signs (monument signs) require Architectural Review Commission (ARC) review and approval. The standards for permanent identification signs are listed under Section 25.56.070 (D) and Section 25.56.080 (B)(2) of the Sign Ordinance. That the sign does not constitute a detriment to public health, safety, and welfare. The design of the sign does not constitute a detriment to public health, safety, and welfare, as it does not incorporate elements that are distracting or intrusive to motorists or pedestrians. The placement of the sign is not anticipated to create sight obstructions to motorists or pedestrians, as it is setback away from any line of site areas, adjacent streets, and drive aisles. The proposed sign is setback 35 feet from the face of the street curb. 4. That the size, shape, color, height, and placement of the sign is compatible with and will have a harmonious relationship with the building it identifies, the surrounding neighborhoods, and other signs in the area. The size of the sign complies with the development standards established in the City's Sign Ordinance, as shown in Table 2 of the report. The sign's location in the landscaped area within the parking lot is typical of other monument signs. The sign is oriented to be visible to pedestrians and motorists traveling along San Pablo. The sign text and logos are contrasted on a white background to provide legible text and visuals in normal viewing conditions. The sign is also internally illuminated to allow for visibility in non-daylight hours. 6. That the location, height, and design of the proposed sign does not obscure from view or unduly detract from existing or adjacent signs and does not in any way compromise the health or safety of any person(s). As proposed, the maximum height of 6 feet conforms to the Ordinance and is setback 35 feet from the face of the San Pablo curb. The sign’s proposed location, height, and design does not obscure the view or unduly detract from any existing signs in the vicinity, and it does not adversely affect public health, safety, or welfare. 7. That the location and design of the proposed sign and its size, shape, illumination, and color are compatible with the visual characteristics of the surrounding area so as not to detract from or cause depreciation of the value of adjacent developed properties. The sign is compatible with the design of the building and meets the requirements established in Table 25.56-2 for commercial signage, so it will not adversely impact nor generate bright or direct lighting impacting the character of adjacent residential uses. The sign would feature internally illuminated panels. 8. That the location and design of a proposed sign in close proximity to a residential district does not adversely affect the value or character of the adjacent residential uses. The sign is located within the Downtown zoning district and as identified in Table 1, is surrounded by Downtown district zoning designations. To the west there is an existing Apartment complex, within the Downtown district; the sign is not visible to the Apartment Complex. 9. That any neon tubing used in conjunction with any sign is incorporated as an integral part of the sign design with careful attention to color, intensity of light, and the use of colors that are not overly bright. Neon tubing is not proposed as part of the monument sign.
