SUBJECT: TRANSFER OF PROPERTY TO PDH ASSOCIATES
Recommendation:
That the City Council,by minute motion, approve the quitclaim deed transferring Lot 1 of
Tentative Tract Map 28450 to PDH Associates.
Background:
During the recent transaction regarding the sale of the 11.3 acres at Desert Willow to PDH
Associates, it was determined that the City had certain vested interests in the property to be
transferred. That interest generated as a result of the City being a signatory in the execution of
the Tentative Tract Map. Although the closing has taken place, First American Title has
requested an official action by the City transferring its interest in that parcel to PDH Associates.

FOR A VALUABLE CONSIDERATION,receipt of which is hereby acknowledged, the
undersigned, the CITY OF PALM DESERT, a municipal corporation, hereby quitclaims,
releases and remises to PDH ASSOCIATES LLC, a Utah limited liability company, all of the
undersigned's right, title and interest in and to the following described real property:
Lot 1 of Tract 28450, Palm Desert, Riverside County, California, as
per Map recorded in Book 264, Pages 4 through 15, inclusive, of
Maps, Official Records, Riverside County, California.
Reserving and Excepting therefrom the following:
1. All right, title and interest of the undersigned arising by reason of an
Ordinance initiating the redevelopment plan for Palm Desert Project Area No. 2, a certified copy
of which was recorded August 5, 1987 as Instrument No. 225870, Official Record of Riverside
County, California.
2. All right, title and interest of the City of Palm Desert arising by reason of a
Resolution executed by the City of Palm Desert, recorded September 23, 1987 as Instrument No.
275070, Official Records of Riverside County, California.
3. The rights reserved by the owner of the property set forth in the Map for
Tract 28450, for certain easements shown as "PUE, Pedestrian and Landscape Easement" for
landscape and drainage purposes.
4. The rights dedicated by the City of Palm Desert by the owners of the
property set forth in the Map Tract 28450, for certain easements shown "PUE, Pedestrian and
Landscape Easement" for sidewalk and public utility purposes.
5. The easement granted to the City of Palm Desert by the instrument
recorded July 24, 1997, as Instrument No. 261207.
Subject to all easements, encumbrances, liens, covenants, conditions, restrictions, and rights of
way of record.
IN WITNESS WHEREOF, the undersigned has executed this Quitclaim Deed as of the day and

Subject: Report on Marriott Project Artwork Considerations
Date: May 8, 1998
At the meeting of April 23, 1998,the City Council asked that John Nagus prepare a report on the two
new Marriott hotels and what, if anything,had been done for inclusion of art. John prepared such
a memorandum for presentation to the City Council at its meeting of May 14, 1998, but it was
mistakenly attached to another document on my desk and did not make it on the agenda.
I have attached John's report for your information. If you would like it agendized for May 28th,
please let me know. Neither John nor I will be at the May 14th meeting,but John will be available
onday and Tuesday of next week if you have any questions.

SUBJECT: MARRIOTT PROJECT ARTWORK CONSIDERATIONS
DATE: May 14, 1998
I have been asked to provide remarks concerning the two new Marriott Hotels and their interaction with the
Art in Public Places Program. After earlier preliminary discussion with Tim Bartlett, he and I met on Monday,
May 4 to discuss the project and how the developer could work most effectively with the Art in Public Places
Program. The AIPP fees for the Courtyard and Residence Inn are estimated at this date at $84,000. By
paying the fee at the time of issuance of a building permit, the developer is in effect in compliance with the
ordinance and is eligible for an occupancy permit at the time the project is complete. The developer may
consequently wish to site art within the project and has the opportunity to work with staff to comply with City
guidelines. If an artwork or artist is selected and approved by Council the developer may subsequently apply
for a refund of fees paid to the program. The strength of Palm Desert's AIPP program is the flexibility the
developer has in working with the program.
It is my opinion that it is in the City's best interest to pursue private commission of artwork for new
developments wherever possible. An important goal of the program is to mitigate the impact new
construction has upon the City's built and social environment. Palm Desert has crafted a public program
which respects the developers point of view but which cares about the quality of life of its citizens. Public art
need not be seen merely as another fee by the private sector, but can be shown to add real value and
positive identity to new developments.
The two Marriott projects do not offer any real opportunity for art to be integrated into the architecture.
However, there is ample opportunity for sculpture placement within the development. Artists can be sought
to bring works to the site which compliment or reflect the artworks commissioned by the City at the Desert
Willow resort. At the same time, through careful art and site selection, a large number of national and
international visitors drawn to Desert Willow can be made aware of public art throughout Palm Desert. I will
meet with the developer, if so desired, to assist in creating a preliminary plan for incorporation of art within
their project. This plan can provide early input from the AIPP Committee and is helpful in eventual artist
selection by the developer.
