BACKGROUND: At the March 11, 1999,City Council Meeting,Bill Ware's commission for the subject artwork project was approved, as recommended by the AIPP Commission. A copy of the approved staff report is attached for your reference. Past City policy for artwork installed on a development has been such that when a developer intsalls a piece of approved artwork,per the development requirement,reimbursement has been made once the commissioned art has been installed and accepted by the Art In Public Places Commission. In this case the Courtyard/Residence Inn development has asked that the City Council approve a different form of reimbursement as follows: 1)Approval of a fifty percent(50%) disbursement($41,825)of the AIPP funds paid by Bill Swank/Desert Cities Development for the Marriott Courtyard/Residence Inn project to the artist,William Ware; and 2)approve a twenty-five percent(25%) disbursement of the balance of AIPP funds in 90 days with the final twenty-five percent (25%) to be paid upon City Council's approval of the completed work. The AIPP Committee discussed at length a new procedure for developers to commission works. At present, the developer pays an AIPP fee at the time of application of the building permit. Once an artwork concept is approved by Council, the developer then pays the same amount out of pocket to the artist in the commission of the artwork. At one point in the process, the developer has paid twice the art fee, with eventual refund of the fee by the City upon approval of the work. It is the Committee's intent to facilitate the commission of new work by having the developer invoice the City directly, with payment coming from the AIPP Fund. Contingent to this is a 25% final payment which is subject to approval of the artwork by the City. This way the Committee feels that it can monitor the progress of the work without hampering the artistic process. According to Paul Gibson, Bill Swank and Desert Cities Development has paid $83,650.53 into the AIPP fund. Subject to submission of a contract between the artist and developer, which should include a 25% final payment phase, the developer will submit an invoice to the City to begin the project. It is my understanding that the contract between the developer and Bill Ware is in the amount of $85,000. The City will be responsible to remit only that amount paid by the developer to the AIPP fund. STAFF REPORTS & REMARKS Member Bartlett stated that he asked the members of the Development Committee to bring up an issue that when a building to gain a Certificate of Occupancy the fees needs to be paid up front. Member Bartlett said, if you have an artist in mind to develop a piece, it is his understanding that fees have to be paid and artists fees need to be paid. His concern is a builder actually double pays and when the project is complete the money is returned. Mr. Nagus stated that he spoke to Paul Gibson and Dave Erwin regarding the procedure and the artist could invoice the City. Mr. Nagus will work with Mr. Swank and Mr. Ware. Member Bartlett stated that the Marriott paid $90,000.00 into the art fund and have to pay an additional $90,000.00 for the artist fee. At one point they are out of pocket twice so if that money is in a fund and it is invoiced to the City, the City could just pay it out of that fund and then there would be no refund. There would be a payment schedule. Member Urrutia asked if the artist gets paid before he has completed the project - is refund being made before it is excepted. Mr. Nagus responded yes. Member Urrutia stated that the by-laws are not written that way. Mr. Nagus stated that that is an issue. Mr. Nagus stated that there could be an 03/17/99 7 agreement where final payment is made. It would have to be written into the contract that final payment would not be paid until the AIPP Committee approved it. Mr. Nagus stated that with the upcoming projects a bond can be issued at a minimal fee at the beginning but if there is a project that has a ten year build out, you are not going to want to issue a bond. Councilmember Benson suggested that during the time that fees are collected that the builder knows once it is paid then they deal with the City as to the timing of the projects. The builder could get 25 percent when the project is started and then maybe 25 percent midway through the project and 50 percent when complete. That would give the builder enough money to begin with to purchase supplies that are needed. 03/17/99 8 William E. DISCUSSION The Marriott Courtyard and Residence Inn Projects are currently under construction and will be completed within the next few months. The project has generated approximately $90,000 in public art fees. The developer of the project, Bill Swank, has selected a Palm Desert artist, Bill Ware, to create three site specific artworks for the project. The two Ware projects are sculptural installations which utilize the porte cochere entry structures as a proscenium arch for each of the hotel buildings gate houses. Each installation creates a natural desert tableau utilizing images of birds, reptiles, animals and plantlife indigenous to the site. The sculpture works are being proposed as a variety of metals including bronze with certain elements crafted in aluminum, copper and brass. It is the AIPP Committee's belief that these installations were Mr. Ware's strongest work to date and recommend that Council approve these projects for the developer to begin the commission. L WILLIAM WARE Bill Ware was born in Indianapolis, Indiana,. where his artistic talent was noted by his third grade teacher, whom Bill learned when he met her twenty years later, had kept his sketches among her personal mementos. A self-taught artist, Bill attended Baylor University where he was a pre-med major. However, his first love was art and his best marks were in illustrating for Biology and Physiology. Bill's commercial art experience began in 1964 in Newport Beach, California as an art director for an art magazine, Orange County Illustrated. A job illustrating for a text book publishing company in New York City provided funds to travel to Palma de Mallorca, Spain in 1966. While in New York City, Bill did watercolors based on city street scenes. In Spain he continued painting while working as an illustrator for Spanish magazines. In Spain, Bill was inspired by the works of Miro whom he met while there. As an illustrator and cover artist for the Saturday Evening Post, Bill improved his craft while producing many fine works. As an independent artist in Indiana, Bill found success and recognition when the Indiana Convention Center commissioned him to paint a mural. This led to a commission from Indiana bell, where he produced paintings of Indiana scenes for an entire high-rise over a one year period. One of these paintings won an award and became part of a touring show of corporate art, hanging in the exhibit between Norman Rockwell and N.C. Wyeth. Though Bill's background is in painting, his desire to be involved in Art in Public Places, pushed him into creating sculptures and relief pieces using non-ferrous metals. This medium opened up many occasions to work with architects, city planners, and various committees' through the building process. Bill has designed, created and installed numerous two and three dimensional works for private and public settings.
