A Regular Meeting of the Planning Commission was called to order by Chairman Gregory
on Tuesday, September 3, 2024, at 6:00 p.m. in the Council Chamber, City Hall, located
at 73-510 Fred Waring Drive, Palm Desert, California.

8.a CONSIDERATION TO ADOPT A MITIGATED NEGATIVE DECLARATION AND
APPROVE A CONDITIONAL USE PERMIT AND PRECISE PLAN FOR THE
LIVING DESERT ZOO AND GARDENS EXPANSION PROJECT
City staff announced conflicts of three Commissioners; Vice-Chair Holt and
Commissioner Pradetto due to financial interest in real property, each owning
property within 500 feet of subject property, and Commissioner Greenwood due
to a financial interest in both a source of income and business entity as his firm is
the Applicant for the project.
Since Commissioners Holt, Pradetto, and Greenwood recused themselves from
further discussion and voting, a quorum was no longer present to hear the item.
The Political Reform Act provides a process to requalify commissioners in cases
of disqualifying conflicts.
City Attorney Verdugo noted pursuant to California Code of Regulations Section
18705(b)(3), the requalification process applies when no alternative decision-
making body is available. On August 15, 2024, the California Secretary of State
conducted a randomized alphabet draw for election ballot order, which staff used
to determine the order for Commissioners to draw straws. The Commissioner
drawing the short straw would serve as the third member for this item.
Commissioner Holt drew first, followed by Commissioner Greenwood, then
Commissioner Pradetto.
Commissioner Greenwood drew the short straw and took a seat on the dais.
Vice-Chair Holt and Commissioner Pradetto left the Council Chamber.

Principal Planner Flores presented a PowerPoint and addressed questions from
the Commissioners.
The applicant’s representative, Allen Monroe from the Living Desert, also
responded to Commissioner inquiries.
Chair Gregory then opened the public hearing.
Linda Simmons, Palm Desert resident, reiterated the need for traffic control
during special events at the Living Desert.
Melody Thornton, Palm Desert resident, advocated for a stop sign at Corsican
Villas on Portola and emphasized the need for traffic control during special
events at the Living Desert.
Ken, Palm Desert resident, raised concerns about excessive noise and signage
during special events at the Living Desert, as well as potential noise from the lion
habitat at night.
Ferdinand Rose, Palm Desert resident, called for a traffic study to be conducted
during special events at the Living Desert.
Chair Gregory closed the public hearing, there being no additional members of
the public wishing to speak.
In response to public comments, Director of Development Services Cannone
proposed organizing a Community Meeting with residents from Corsican Villas,
the Living Desert, and traffic staff within the next 30 to 45 days.
Commissioner DeLuna sought clarification that the Commission’s action this
evening does not pertain to the issues raised during the public comment period.

Commissioner DeLuna announced her recusal due to potential financial interest
and left the Council Chamber.
Commissioner Greenwood announced his recusal due to a source of income and
a business entity as his firm is the Applicant and left the Council Chamber.
Principal Planner Flores delivered a PowerPoint presentation and responded to
questions from the Commissioners.
The applicant, John Vuksic of Prest Vuksic Greenwood Architects, also
addressed questions from the Commissioners.
Chair Gregory opened and closed the public hearing, there being no one from
the public wishing to speak.

BACKGROUND/ANALYSIS:
The Providence Presbyterian Church has been operating for approximately 12 years (2012-
2024) at an existing building located at 42620 Caroline Court under Conditional Use Permit
(CUP) 12-188 via resolution 2587, adopted by the Planning Commission on August 7, 2012 .
Approval of CUP24-0006 will allow the Providence Presbyterian Church (Applicant) to operate
at a new location within a 4,332-square-foot building at 42580 Caroline Court. The proposed
church facility is in an existing multi-tenant office and industrial building. No façade or site
modifications are proposed. The facility will generally operate six (6) days a week, closed on
Saturdays, between 9:00 a.m. and 9:00 p.m.
Subject to the approval of Conditional Use Permit 24-0006, the Applicant has volunteered to
surrender CUP12-188 and cease all church operations at the current location at 42620 Caroline
Court. Planning staff has determined the proposed church complies with the intent an d
objectives of all applicable zoning requirements and is compatible with surrounding land uses.

Project Summary
A. Property Description:
The project site is an existing 4,332-square-foot office/industrial building located at 42580
Caroline Court. The site is improved with parking, landscaping, and utilities.

C. Project Description:
Providence Presbyterian Church is requesting a Conditional Use Permit to establish a
4,332 square-foot place of worship within an existing office-industrial suite. The church is
proposed in a building located near the northeasterly portion of the site. Approximately
2,090 square feet of the church space will be dedicated to the assembly area. The
remaining floor space will be used for ancillary offices, restrooms, and common areas.
The project does not propose additions to the existing building.
No modifications are proposed to the existing project site. The building has access to
sixty-seven (67) existing parking spaces located on the parcel. This building shares a
parking lot with the tenants within the industrial business park center and will secure an
agreement with the owners of the property to secure access and parking spaces to
support the use.

No modifications are proposed to the existing building footprint, floor area or height. The
project will require interior alterations to modify the existing building layout to
accommodate the proposed assembly use (church) operations. Peak attendance will
occur during morning assembly worship on Sunday mornings. The proposed assembly
area contains folding seating for 147 persons. The Applicant’s Statement of Use which
includes the hours of operation, and anticipated number of persons is provided as Exhibit
B to the attached Resolution.
Analysis
Table 25.16-1: “Use Matrix for Commercial and Industrial Districts” under Section 25.16.030 of
the Palm Desert Municipal Code (PDMC) lists permitted, conditionally permitted, and prohibited
land uses for the SI zoning district. Religious institutions require a CUP in accordance with
Section 25.72.050 of the PDMC.
A. Land Use Compatibility
The Conditional Use Permit process allows for special consideration of the proposed
assembly use and associated activities and determining land use compatibility for a specific
site. An assembly use is listed as a Conditional Permitted Use in the Service Industrial Zone.
The proposed CUP will allow the Staff to condition the use to comply with the City's adopted
land use policies and regulations for uses within the Service Industrial (SI) Zone.
The neighboring uses in the project site are predominantly professional office uses with some
light industrial and wholesale businesses. These existing businesses operate during daytime
hours on weekdays. An existing church, Providence Presbyterian Church, has operated in a
building adjacent to the site since 2012 without code compliance issues. Therefore, staff finds
that the proposed use is compatible with the existing and future uses within the industrial
park.
B. Site Plan
The property is presently developed and is adequate in size, shape, topography, location,
and serviced by all necessary utilities to accommodate the proposed use. The u se will be
located entirely within an existing building. No exterior alterations are proposed to the project
site. The site has two access entry points from Caroline Court.
C. Parking
The proposed church will require 62 total parking spaces based on PDMC requirements. The
PDMC requires parking for assembly uses at a rate of one space per three fixed seats within
the main auditorium, thus requiring 49 spaces for the 147 fixed seats. The remaining floor
area will require 12 spaces based on the following ratio.

The center was approved with 67 total parking spaces; no additional parking will be required.
The existing industrial business park is a mix of professional office, light industrial, and
distribution businesses, which generally operate from 8:00 a.m. to between 5:00 p.m. and
6:00 p.m. on weekdays. These businesses are typically closed on weekends. Peak
attendance for the church will occur during late evening hours on weekdays and early
mornings on weekends. Because the hours of operation are staggered, staff does not
anticipate the church expansion will generate parking issues with neighboring businesses.
The Providence Presbyterian Church is an existing place of worship located in the same
center at 42620 Caroline Court. It operates under a similar schedule with minimal weekday
hours and peak weekend usage. The proposed church will use parking on the site, which is
presently underutilized during the proposed hours of operation.
It is important to note that this industrial business park is set up to share a parking lot for all
the businesses occupying the park. The park is managed by an owner’s association that
oversees the day-to-day operations of the facility.
Public Input
Public hearing notices were mailed to all property owners within 300 feet of the proposed project
and published in The Desert Sun on September 20, 2024. To date, the Development Services
Department has received no letters in opposition to or in favor of the proposed project.
Environmental Review
For the purposes of CEQA, the Director of Development Services has determined that the
proposed project request is categorically exempt under Article 19 Section 15301 – Existing
Facilities (Class 1) of the CEQA Guidelines. The proposed project will involve establishing a new
place of worship with no physical expansion of the existing building; the project site has been
previously developed and has no value as habitat for endangered, rare or threatened species;
the proposed project does not have a reasonable possibility for significant cumulative impacts
upon the environment; and the site can adequately be served by all required utilities and public
services. Therefore, based on the above findings, staff is recommending that the Planning
Commission adopt a finding that the proposed project is categorically exempt.
Findings of Approval
Findings can be made in support of the project and in accordance with the City’s Municipal Code.
Findings in support of this project are contained in the draft Planning Commission Resolution Nos.
2882 and 2883, attached to this staff report.

building, located at 42580 Caroline Court Assessor’s Parcel Number (“APN”) 634-260-
026; and
WHEREAS, the Planning Commission of the City of Palm Desert, California, did
on the 1st day of October 2024, hold a duly noticed public hearing to consider the request
by Providence Presbyterian Church for approval of the above-noted; and
WHEREAS, the parcel is located in the Service Industrial (“SI”) zoning district,
which allows “Religious Institutions” as a permitted use, subject to the approval of a
Conditional Use Permit (“CUP”); and
WHEREAS, under Section 21067 of the Public Resources Code, Section 15367 of the
State California Environmental Quality Act (“CEQA”) Guidelines (Cal. Code Regs., tit. 14, §
15000 et seq.) and the City of Palm Desert’s (“City’s”) Local CEQA Guidelines, the City is the
Lead Agency for the Project; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the CEQA” Resolution No. 2024-35, in that
the Director of Development Services has determined that the project will not have a
significant impact on the environment and that the project is categorically exempt under
Article 19, Section 15301 – Existing Facilities (Class 1) of the CEQA Guidelines; and
WHEREAS, at the said public hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify the approval of said
request:
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:

SECTION 1. Recitals. The Planning Commission hereby finds that the foregoing
recitals are true and correct and are incorporated herein, as substantive findings of this
Resolution.
SECTION 2. Findings on Conditional Use Permit. As required by PDMC Section
25.72.050(F), the Planning Commission makes the following findings to approve the granting of
the CUP:
1. That the proposed location of the conditional use is in accordance with the
objectives of the Zoning Ordinance and the purpose of the district in which the site
is located.
Assembly uses (“Churches”) are permitted subject to a Conditional Use Permit
within many zoning districts within the City. The proposed location is in the Service
Industrial (“SI”) zone. Professional offices and industrial businesses are the
predominant uses in the existing area and during the week, the Church will operate
during similar office hours. The proposed location is based on the objectives of the
Zoning Ordinance and the purpose of the district in which the site is located. The
services conducted at the proposed site are compatible with the adjacent business
hours and would have minimal impacts on parking.
2. That the proposed location of the conditional use and the conditions under which
it would be operated or maintained will not be detrimental to the public health,
safety, or welfare, or be materially injurious to properties or improvements in the
vicinity.
The assembly use (“Church”) complies with all applicable requirements of the
Zoning Ordinance and all applicable building codes and will not be detrimental to
general public health, safety, and welfare or materially injurious to the properties
in the vicinity. Water, sanitation, public utilities, and services are constructed and
readily available for the building.
3. That the proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or adjustments.
The project site is developed, and the proposed use is consistent with the intent
of the PDMC Sections 25.16.00 and 25.72.050. During the week (Monday –
Friday), the facility will operate with similar office hours. Peek attendance will occur
on Sunday mornings when neighboring businesses are generally closed. The
facility would not interfere with business operations or generate parking
deficiencies. Conditions have been placed on the project to ensure that all the
minimum requirements comply with Chapter 25.46 (Off-Street Parking Loading)
provisions.
4. That the proposed conditional use complies with the goals, ob jectives, and policies
of the City’s general plan.

The assembly use (“Church”) is compatible with other surrounding uses and as
conditioned, meets the City’s goals, objectives, and policies of the general plan at
the newly proposed 42580 Caroline Court location. Assembly uses like the
Providence Presbyterian Church are conditionally allowed within the Service
Industrial (“SI”) Zoning District. The Providence Presbyterian Church has operated
at 42620 Caroline Court under Conditional Use Permit 12-188 for approximately
12 years (2012- 2024). The SI Zoning District is intended for a range of recreation,
resource preservation, open space, and assembly uses, as well as religious
institutions like the Providence Presbyterian Church. There is no record on file of
the Providence Presbyterian Church ever impairing the interest and character of
the SI Zoning District.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, AS FOLLOWS:
1. That the above recitations are true and correct and constitute the findings of
the Planning Commission in this case.
2. That the Planning Commission does hereby approve Conditional Use Permit
24-006, subject to the conditions attached as Exhibit “A,” the project plans
attached as Exhibit “B,” and the statement of operations attached as Exhibit
“C.”
SECTION 3. Project Approval. The Planning Commission hereby approves Case No.
CUP24-0006.
SECTION 4. Custodian of Records. The documents and materials that constitute the
record of proceedings on which these findings are based are located at the City’s office at
73510 Fred Waring Drive, Palm Desert, CA 92260. Richard D. Cannone, AICP, the Secretary
to the Palm Desert Planning Commission, is the custodian of the record of proceedings.
SECTION 5. Execution of Resolution. The Chairperson of the Planning Commission
signs this Resolution, and the Secretary to the Commission shall attest and certify to the
passage and adoption thereof.

EXHIBIT A
CONDITIONS OF APPROVAL
CASE NO. CUP 24-0006
Community Development Department:
1. This Conditional Use Permit (“CUP”) approval is to allow the operation for assembly
use (“Church”) within an existing industrial building. The project includes a tentative
improvement to include classrooms and administrative offices within a 4,332 square -
foot building located at 42580 Caroline Court (Assessor’s Parcel Number 634-260-
026) as generally depicted on the approved project plans attached as Exhibit “B,”
and approved operations statement attached as Exhibit “C,” and as specified by the
following Conditions of Approval.
2. This CUP shall lapse and become void one (1) year following the effective date of
the use permit, unless prior to the expiration a building permit is issued and
construction is commenced and diligently pursued toward completion, or a new
certificate of occupancy is issued for the use, or as specified by Title 25 of the Palm
Desert Municipal Code (“PDMC”). If the CUP expires, the applicant must file a new
application which shall be processed in accordance with the requirements of Title 25
of the Palm Desert Municipal Code.
3. Prior to the expiration of the permit, the applicant may request a one (1) year time
extension by filing a written request with the Planning Division for consideration by
the Planning Commission. Any request for extension shall be noticed and be
considered at a public hearing held before the original approval body.
4. The operation of the facility shall conform substantially to approved exhibits on file
with the Department of Community Development, except as modified by conditions
herein.
5. Permittee shall notify City Planning Department of any change in operations and
such change may require a revision of this permit. Failure to notify the City of any
change in operations is material grounds for revocation of this Conditional Use
Permit.
6. The Conditional Use Permit shall expire if construction of the said project shall not
commence within two (2) years from the date of final approval unless an extension
of time is granted; otherwise said approval shall become null, void, and of no effect
whatsoever.
7. The project shall be developed and maintained in conformance with the approved
plans and exhibits on file with the City. Any variation from the approved plans must
be reviewed and approved by the Department of Community Development prior to

building permit issuance and may require review and approval by the Planning
Commission and/or City Council.
8. The Applicant shall agree to defend, indemnify, and hold harmless the City of Palm
Desert or its agents, officers, and employees from any claim, act ion or proceeding
against the City of Palm Desert or its agents, officers or employees, to attack, set
aside, void, or annul, any approval of the City of Palm Desert, whether by its City
Council, Planning Commission, or other authorized board or officer of the City. The
City of Palm Desert shall promptly notify the applicant of any such claim, action, or
proceeding, and the City of Palm Desert shall cooperate fully in the defense.
9. The operation shall not encroach or obstruct parking lot circulation, access
driveways, ADA paths of travel or emergency vehicle access.
10. Prior to issuance of a building permit for construction of any use or structure
contemplated by this approval, the applicant shall first obtain permits and/or
clearance from the following agencies:
Coachella Valley Water District (CVWD)
Public Works Department
Fire Department
Building & Safety
11. Should parking shortages or other parking-related issues arise, the applicant shall
institute appropriate operational mitigation measures. Proposed mitigation must be
reviewed by the Department of Community Development.
12. The Church operation shall comply with the City of Palm Desert’s outdoor lighting ,
noise, and landscaping requirements.
13. No signs are approved by this project. Sign Permit for any exterior signs shall be
submitted to the Planning Division for review and approval prior to installation. All
signage must be in accordance with the applicable standards of the Palm Desert
Municipal Code.
14. Changes to the floor plan including, but not limited to, additional seating, changes
from fixed to moveable seating, shall require additional review by the Department of
Community Development and may result in a new public hearing.
15. This Conditional Use Permit does not include provisions to allow the operation of a
school that is not ancillary to the church operation.
16. Approval of Conditional Use Permit 24-0006 shall terminate all assembly use
(“Church”) operations under Conditional Use Permit 12-188 No Church operations

are be allowed at 42620 Caroline Court unless approval of a new Conditional Use
Permit.
17. The Applicant or any successor in interest shall comply with all applicable local, state,
and federal laws and regulations.

Employees:
The applicant has one (1) full-time employee and two (2) part-time employees. The part-time
employees work remotely, but at times will work from the office at 42580 Caroline Ct.
Hours of Operation:
The applicants’s hour of operation will be:
Sunday: 9:00 am - 12:00 pm. (Longer 4 times a year, 9:00 am - 2:30 pm)
9:30 - 10:45 am — Worship
10:45 - 11:15 am — Coffee & Conversation
11:15 - 12:00 am — Christian Education
12:15 - 2:30 pm — Quarterly Lunch. 4 times a year

Applicant’s Activities:
The applicant will host:
• Sunday 9:00-10:45 — Morning worship, with attendance ranges from 70 to 100 in
season (November to April), and 50 to 80 out of season (May to October).
• Sunday 11:15-12:00 — Christian Education classes with attendance ranging from 25-35
• Sunday 12:15-2:30 — 4 times a year, lunches with an attendance ranging from 35-60
• Wednesday 8:30-10:00 — Bible studies with attendance ranging from 6-20
• Thursday 1:00-2:30 — Bible studies with attendance ranging from 6-20
• First Tuesday the month 5:00-9:00 PM — Evening meeting with attendance of 3-6.

1-2 employees, with 1-2 others coming in for meetings/pastoral counseling, at different

• There will be other meetings in the morning before office hours or evening after office

• The Applicant anticipates hosting a Sunday evening and/or a weeknight gathering with an
anticipated start time of 6:00 PM with a maximum two-hour duration. The anticipated

PLANNING COMMISSION RESOLUTION NO. 2883
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, REVOKING, IN ITS ENTIRETY,
CONDITIONAL USE PERMIT NO. 12-188 FOR THE OPERATION OF A
CHURCH FACILITY WITHIN AN EXISTING INDUSTRIAL BUILDING
LOCATED AT 42620 CAROLINE COURT APN 634-260-028.
WHEREAS, on August 7, 2012, the City of Palm Desert Planning Commission,
California, approved a Conditional Use Permit 12-188 (Resolution No. 2587) to allow the
operation of a Church located in a service industrial zone at 42 -620 Caroline Court
Assessor’s Parcel Number (“APN”) 634-260-026; and
WHEREAS, on October 1, 2024, the City of Palm Desert Planning Commission,
approved a Conditional Use Permit 24-006 (Resolution No. 2882) to allow for an
assembly use (Church) within a 4,332 square-foot building located at 42580 Caroline
Court Assessor’s Parcel Number (“APN”) 634-260-026; and
WHEREAS, on October 1, 2024, the City of Palm Desert Planning Commission
adopted Resolution No 2883; revoking Conditional Use Permit (‘CUP) 12-188 for
Providence Presbyterian Church operations located at 4260 Caroline Court, Palm Desert,
California (“Property”); and
WHEREAS, on September 20, 2024, written notice of a hearing to consider
revocation of CUP12-188 in its entirety scheduled for October 1, 2024, at 6:00 p.m. with
the Planning Commission in the Council Chamber located at 73510 Fred Waring Drive,
Palm Desert, was provided to Presbyterian Church (“Applicant”); and
WHEREAS, the City of Palm Desert (“City”) has received a letter from the applicant
to surrender Condition Use Permit NO 12-188 (‘CUP”); and cease all Church operations
located at 42620 Caroline Court, as presented to the Planning Commission in the
administrative record, including but not limited to, staff and public testimony, and other
evidence as referenced in this resolution as fully set forth herein; and
WHEREAS, in the event that the request for Conditional Use Permit No 24-0006
is approved to allow for community assembly (“Church”), existing Conditional Use Permit
No 12-188 will no longer serve of any use to the applicant. Therefore, the applicant has
agreed to surrender Conditional Use Permit No. 12-188. This will assist City Staff’s efforts
to clean up outdated entitlements; AND
WHEREAS, the Planning Commission finds and determines that this proposed
action is categorically exempt from the provisions of the California Environmental Quality
Act (“CEQA”), per State CEQA Guidelines Section 15321 – Enforcement Actions by
Regulatory Agencies; and

WHEREAS, the Planning Commission did on October 1, 2024, hold a duly
noticed public hearing to consider this revocation; and
WHEREAS, at the said public hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, t he Planning
Commission did find the following facts and reasons, which are outlined in the staff report,
exist to justify revocation of the Conditional Use Permit.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
SECTION 1. Project Approval. The Planning Commission hereby approves the
revocation of Case No. CUP12-188.
SECTION 2. Custodian of Records. The documents and materials that constitute
the record of proceedings on which these findings are based are located at the City’s
office at 73510 Fred Waring Drive, Palm Desert, CA 92260. Richard D. Cannone, AICP,
the Secretary to the Palm Desert Planning Commission, is the custodian of the record of
proceedings.
SECTION 3. Execution of Resolution. The Chairperson of the Planning Commission
signs this Resolution, and the Secretary to the Commission shall attest and certify to the
passage and adoption thereof.

RECOMMENDATION:
Adopt Planning Commission Resolution No. 2884 entitled, “A RESOLUTION OF THE
PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A TWELVE-MONTH TIME EXTENSION FOR PRECISE PLAN 22 -0003 AND TENTATIVE
PARCEL MAP 38336 UNTIL OCTOBER 13, 2025”
BACKGROUND/ANALYSIS:
On October 13, 2022, the City Council of the City of Palm Desert, California, approved Precise
Plan 22-0003 and Tentative Parcel Map 38336 for a 241-unit, multi-family affordable housing
development community consisting of 10 three-story apartment buildings, one (1) two-story
community building with two (2) on-site manager’s units, outdoor recreation areas, landscaping,
and associated parking areas on a 10.49-acre site on the northwest corner of Gerald Ford Drive
and Technology Drive. The City Council staff report packet with background, analysis, and

The original life of the Precise Plan and Tentative Parcel Map was 24 months and is set to expire
on October 13, 2024.
Project Description:
Palm Desert Municipal Code (PDMC) Section 26.20.140 Extensions of Time allows the Planning
Commission to grant tentative maps an extension of time to file the final map. However, PDMC
Section 25.60.100 allows the Planning Commission to grant Precise Plans a twelve-month
extension of time. The currently proposed extension is the first proposed extension of time for
the Precise Plan and Tentative Parcel map.
Per PDMC 25.72.030(K)(2), a maximum one-year extension may be granted from the date of
expiration of the precise plan by the Commission when extenuating circumstances can be clearly
shown by the applicant. Additionally, per PDMC 25.72.030(K)(3) the Precise Plan would not be
eligible for any future extension requests due to the adoption of the Multifamily Objective Design
Standards that would impact the precise plan . Staff has made the applicant aware of this
requirement.

The applicant has filed a timely request to extend the Precise Plan and Tentative Parcel Map for
a twelve-month period. This additional time is needed for the applicant to record the final map,
and the project is being considered for competitive financing through the State of California Low
Income Housing Tax Credit Program. Granting the request will extend the tentative map until
October 13, 2025.
Environment Assessment/Environmental Review:
Pursuant to CEQA and the State CEQA Guidelines, the project was found to be exempt from
further environmental review per Section 15061(b)(3) (General Rul e exemption). The project is
an extension of time and will have no direct foreseeable impacts on the environment.
Public Input:
Public Notification
Public noticing was conducted for the October 1, 2024, Planning Commission meeting per the
requirements of PDMC Section 25.60.060 and Government Code Sections 65090 to 65094. A
public hearing notice was published a minimum of 10 days before the hearing date in The Desert
Sun newspaper. Notices were mailed to all property owners within 300 feet of the project site.
No comments have been received as of the date of this report.

EXTENSION FOR PRECISE PLAN 22-0003 AND TENTATIVE PARCEL MAP
38336 UNTIL OCTOBER 13, 2025

WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th day
of October 2022, adopt Resolution No. 2022-85, approving Precise Plan 22-0003 and
Tentative Parcel Map 38336 for a 241-unit, multi-family affordable housing development
community consisting of 10 three-story apartment buildings, one (1) two-story community
building with two (2) on-site manager’s units, outdoor recreation areas, landscaping, and
associated parking areas on a 10.49-acre site on the northwest corner of Gerald Ford Drive
and Technology Drive; and
WHEREAS, the original resolution for the Precise Plan and tentative map established
a 24-month life and was set to expire on October 13, 2024; and
WHEREAS, a timely request was filed by Palms Communities, the authorized
representative for the property owner, for an extension of Precise Plan 22-0003 and TPM
38336; and
WHEREAS, the original findings and Conditions of Approval in the entirety for
Planning Case Nos. PP 22-0003 and TPM 38336 as stated in City Resolution No. 2022-85
are still applicable to the project and incorporated herein by reference; and
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 1st day of October 2024, consider the request by the property owner for approval of the
above-noted extension of time request at a duly noticed public hearing; and
WHEREAS, at the said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, the Planning Commission
did find the following facts and reasons, which are outlined in the staff report exist to justify
approval of said request; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have
occurred; and
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
SECTION 1. Recitals. The Planning Commission hereby finds that the foregoing
recitals are true and correct and are incorporated herein as substantive findings of this
Resolution.
SECTION 2. Project Approval. The Planning Commission approves a twelve month
time extension for Planning Case Nos. Precise Plan 22-0003 and TPM 38336 from to October
13, 2025, subject to the Conditions of Approval attached hereto as Exhibit “A.”

CONDITIONS OF APPROVAL
CASE NOS. PP22-0003/TPM 38336 EXTENSION OF TIME NO. 1
PLANNING DIVISION:
1. The Applicant agrees that in the event of any administrative, legal, or equitable action
instituted by a third party challenging the validity of any of the procedures leading to the
adoption of these Project Approvals for the Project, or the Project Approvals themselves,
the Developer and City each shall have the right, in their sole discretion, to elect whether
or not to defend such action. The Developer, at its sole expense, shall defend, indemnify,
and hold harmless the City (including its agents, officers, and employees) from any such
action, claim, or proceeding with counsel chosen by the City, subject to the Developer’s
approval of counsel, which shall not be unreasonably denied, and at the Developer’s sole
expense. If the City is aware of such an action or proceeding, it shall promptly notify the
Developer and cooperate in the defense. The Developer, upon such notification, shall
deposit with City sufficient funds in the judgment of the City Finance Director to cover the
expense of defending such action without any offset or claim against said deposit to
assure that the City expends no City funds. If both Parties elect to defend, the Parties
hereby agree to affirmatively cooperate in defending said action and to execute a joint
defense and confidentiality agreement in order to share and protect the information under
the joint defense privilege recognized under applicable law. As part of the cooperation in
defending an action, City and Developer shall coordinate their defense in order to make
the most efficient use of legal counsel and to share and protect information. The
Developer and City shall each have sole discretion to terminate its defense at any time.
The City shall not settle any third-party litigation of Project approvals without the
Developer’s consent, which consent shall not be unreasonably withheld, conditioned, or
delayed unless the Developer materially breaches this indemnification requirement.
2. The Applicant shall comply with the Conditions of Approval of the previously appr oved
per City Council Resolution No. 2022-85, attached hereto as Exhibit “B” in their entirety.
The Conditions of Approval are still applicable and valid and are incorporated herein by
reference.
3. The Precise Plan 22-0003 and Tentative Parcel Map 38336 map will expire on October
13, 2025, unless an extension of time is granted by the City of Palm Desert’s Planning
Commission.

The letter is Palm Communities’ request for an Extension of Time for Precise Plan 22-003,
Tentative Parcel Map 38366, and Environmental Assessment 22-003 for the Palm Villas at
Millennium affordable housing project. A 1,000-foot Radius Map, Labels, and Certification are
being delivered to your attention via UPS from Title Pros IS.
Palm Villas at Millennium was approved on October 13, 2022, by the City Council. Project
construction drawings and financing documents are currently being prepared. The County of
Riverside Housing Authority has authorized Project Based Vouchers for the project and the
environmental review is underway. Bonds and tax credits were applied for August 27 th, 2024.
Therefore, additional time is needed to accommodate the funding timeline and to prepare
construction plans and submit them for City plan check.
