HomeMy WebLinkAboutRes 95-58 Hazardous Waste and Hazardous Materials Regulation • CITY OF PALM DESERT MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL FROM: LISA CONSTANDE, ENVIRONMENTAL CONSERVATION MANAGER DATE: JULY 13, 1995 SUBJECT: HAZARDOUS WASTE AND HAZARDOUS MATERIALS REGULATION: UNIFIED PROGRAM AGENCY DESIGNATION RECOMMENDATION: Adopt Resolution No. 95-58 designating the Riverside County Department of Environmental Health as the Certified Unified Program Agency for the City of Palm Desert. BACKGROUND: Senate Bill 1082 established the unified hazardous waste and materials program to be managed by a single local agency known as a Certified Unified Program Agency (CUPA). Under the terms of the legislation, six regulatory areas are consolidated: 1. Hazardous Waste Generators; 2. Underground Storage Tank Operation; 3. Hazardous Materials Inventories and Release Response Plans; 4. Acutely Hazardous Materials Handling; 5. Hazardous Materials Management Plans and Inventory; 6. Above Ground Storage Tank Spill Prevention and Control and Countermeasure Plans. The Riverside County Department of Environmental Health has a consolidated program for hazardous waste/materials handling and related emergency planning which applies to the unincorporated County and all incorporated cities except Riverside, Corona, and Banning which individually administer the above item Nos. three, four, and five. The law requires the City be a CUPA and administer the above programs or designate another agency to serve as the CUPA for our City. Another option would be to establish a JPA to serve as the CUPA. a UNIFIED PROGRAM AGENCY DESIGNATION JULY 13, 1995 Every county is required by law to apply by January 1, 1996, for certification to undertake implementation of a consolidated program. The Riverside County Department of Environmental Health has traditionally filled the role of regulator of hazardous waste for the City, and will continue to operate in this capacity, if so designated. There is no charge to the City in designating the County as the City's CUPA. The CUPA is authorized by law to charge regulated businesses to recover expenses. The benefits to the City include: 1. No additional cost to the City; 2. Avoidance of training and/or hiring staff with qualifications and experience to undertake such a specialized program. 3. Benefit to Palm Desert businesses by decreasing regulatory duplication, consolidating permitting with consistent time frames and conditions, and coordinating inspection and enforcement. 4. Updates or implementation of new programs will be introduced and coordinated regionally through the Coachella Valley Association of Governments (CVAG). Concur: 7 '--‘7,,- z-J__..,,,,Ke A V.
