Because of this involvement, I would like to recommend that the Council continue consideration of this ordinance amendment to its meeting in August so that I can agendize it for Public Safety Commission review at its July meeting. I. RECOMMENDATION: A. By minute motion, that the City Council direct staff to draft an ordinance amending Ordinance No. 930 Sections 8.85.030 and 8.85.060 making wrist guards optional for skateboarders II. DISCUSSION: Since the opening of the skate park in September of 1999, the park has seen a great deal of use and provided a tremendous amount of enjoyment for skaters from Palm Desert and surrounding communities. However, there has been a steady decline in attendance since Ordinance 930 was adopted in December which included the requirement that all skaters (inline and skateboard) wear wrist guards. Specifically, the number of teenage skaters has declined sharply. Staff has discussed the situation with several of the people who monitor the park for Coachella Valley Recreation and Park District and they concurred that the number of older skaters (13 and over) has dropped and the park is used primarily by the younger skaters (12 and under). Staff has also spoken to Dallas Williams from the YMCA and Rick Vincent from Sports Fever who confirmed that many skaters have decided to return to the streets and business frontages to skate rather than wear wrist guards at the park. Mrs. Colleen Commito has gathered a petition consisting of businesses and skaters requesting that the City change the ordinance to include wrist guards as optional for skateboarders as opposed to mandatory. The concerns that have been expressed regarding the need for the wrist guard requirement include the following: 1 1. The State law does not require wrist guards. 2. No empirical data has been presented showing the effectiveness of wrist guards. 3. The additional requirement for wrist guards has significantly lessened the effectiveness and benefits of the skate park. The number of skaters at the park are down and many skaters have returned to the streets. 4. The City's insurance carrier does not include wrist guards as one of its requirements The sections of Ordinace 930 dealing with wrist guards are as follows: Section 8.85.030 (D) D. The City has determined that wrist guards afford a significant measure of injury prevention. Therefore, in addition to the safety requirement required by the State, the City hereby requires any person using the skating area to wear wrist guards. Section 8.85.060 (A) A. Any person using the skating area must wear a helmet, elbow pads, knee pads and wrist guards. The Parks and Recreation Commission discussed this matter at its February 23, 2000 meeting and recommended to the City Council that Ordinance be changed and the wrist guard requirement be made optional for skateboarders subject to City Attorney concurrence. That Chapter 8.85 of Title 8 Of the Code of the City of Palm Desert, California is hereby revised, and replaced in its entirety, to read as follows: "CHAPTER 8.85 SKATE PARK REGULATIONS Sections 8.85.010 Purpose 8.85.020 Definitions 8.85.030 State Law Compliance 8.85.040 Hazardous Recreational Activity 8.85.050 Use of the Skate Park& Surrounding Areas 8.85.060 Regulations 8.85.070 Penalty 8.85.080 Notice 8.85.010 Purpose The purposes of this ordinance are: (1)to establish regulations for the use and enjoyment of the Skate Park facility, in the interest of public safety; (2) to comply with Health and Safety Code Section 115800 by adopting an ordinance requiring use of safety equipment, with penalty by citation and notice by sign; and (3) to satisfy the conditions of Sections 115800 and 115800.1 for qualified immunity from liability for hazardous recreational activities. 8.85.020 Definitions A. The terms used in this chapter, e.g., "skateboard", shall have the meanings in common usage, except as otherwise defined herein or by the Health and Safety Code and other applicable laws. 1 RMPUBVCT\158689 Ordinance No. 93 B. For the purposes of this chapter only, the following definitions shall apply: 1. The term "Skate Park" means the Palm Desert Skate Park facility, located in the Palm Desert Civic Center in the City of Palm Desert, California; 2. The term"Skating Area" means the area within the Skate Park designed for skating and skateboarding activities, which is limited to the bowl and adjacent concrete. 8.85.030 State Law Compliance A. Health and Safety Code § 115800 prohibits any operator of a skateboard park to permit any person to ride a skateboard therein unless that person is wearing a helmet, elbow pads, and knee pads. B. The City hereby requires, pursuant to § 115800, that: 1. Any person riding a skateboard at the Skate Park must wear a helmet, elbow pads, and knee pads; and 2. Notice of the safety equipment required in subsection 1 above and notice of the penalty for violation shall be provided. C. The Parks and Recreation Department shall develop a system for recording skateboarding and in-line skating injuries and claims and shall report those incidents to the Judicial Council in accordance with §§ 115800 and 115800.1. D. The City has determined that wrist guards afford a significant measure of injury prevention. Therefore, in addition to the safety equipment required by the State, the City hereby requires any person using the skating area to wear wrist guards. 8.85.040 Hazardous Recreational Activity A. Skateboarding and in-line skating are deemed hazardous recreational activities, within the meaning of Government Code § 831.7, by Health and Safety Code §§ 115800 and 115800.1 under specified conditions. B. The City hereby adopts the pertinent State law definitions of hazardous recreational activities and hereby affirms that use of the Palm Desert Skate Park is deemed a hazardous recreational activity to the fullest extent permitted by law. 2 RMPUBUC1M 158689 Ordinance No. 930 C. In conformity with § 115800.1: 1. The City hereby designates the Palm Desert Skate Park, located in the Palm Desert Civic Center in Palm Desert, California, a recreational area in which in-line skating is permitted; and 2. The City shall post notice advising the public that in-line skating in the designated area by adults is deemed a hazardous recreational activity and that the City may not be liable for injuries incurred by participants. 8.85.050 Use of the Skate Park & Surrounding Area or luge skateboarding Stunts, tricks g are: 1. Prohibited in the picnic area, parking lot, curbs, and surrounding areas of the Skate Park, Civic Center and Civic Center Park; and 2. Permitted in the Skating Area only. B. Skating and skateboarding are the only activities permitted in the Skating Area. Bicycles or other vehicles are prohibited from entering the Skating Area. C. The safetyof the SkatingArea is reduced by the presence of debris of any kind and by wet conditions. Food and beverage consumption produce foreseeable litter and are not permitted within the Skating Area. Use of the Skating Area under wet conditions is also prohibited. D. The City hereby designates the Skate Park a"public place" within the meaning of Municipal Code Chapter 8.36 (§§ 8.36.010 et seq.). "No smoking" shall be included in the regulations posted for public notice. 8.85.060 Regulations The following regulations shall be posted for public notice. A. Any person using the skating area must wear a helmet, elbow pads, knee pads and wrist guards. B. No bicycles or other vehicles are permitted in the skating area. C. No spectators are permitted in the skating area. 3 RMPUB\ICT\158689 Ordinance No. 930 D. No food, glass bottles or cans are permitted in the skating area at any time. E. No unauthorized ramps,jumps or obstacles are permitted in the skate park. F. Use of the skating area is prohibited when it is raining or the concrete is wet. G. No smoking, alcohol or drug use is permitted in the skate park. H. Sponsored events(contests, demonstrations, classes, etc.) must be approved by the City, in advance, through the park reservation process. 8.85.070 Penalty A. The City hereby resolves that failure to observe § 8.85.060A(above), which requires use of safety equipment, shall be an Infraction with a specific fine in the amount of Fifty and No/100 Dollars ($50.00). B. Any person who fails to observe § 8.85.060A(above), requiring use of safety equipment, is subject to citation, fine and removal from the Skate Park. B. Notice of this penalty shall be posted with the Regulations in § 8.85.060. 8.85.080 Notice A. The City shall post an official sign at the entry of the Skate Park facility and additional signs therein as needed to provide reasonable notice of this ordinance. B. The sign(s) shall provide notice to the public of: 1. The Regulations(A through H) above; 2. The caution: "Skating and skateboarding are hazardous recreational activities and the City may not be liable for injuries"; and 3. The Penalty: "Violators will be subject to citation, a $50 fine and removal. (Palm Desert Municipal Code Section 8.85.)" " Section 2. Upon the effective date, this ordinance will supersede, repeal, and replace the urgency ordinance adopted on September 9, 1999 which added Section 8.85 to the Palm Desert Municipal Code. 4 RMPUBUCT\158689 Ordinance No. 93G Section 3. SKATE PARK Mr. Winklepleck reported that wrist injuries are more common among in-line skaters than skate boarders, but wrist guards inhibit skate boarders from performing some moves. Colleen Commito stated that her 15-year-old son is rated 2nd in California skate boarders, and it seems that the wrist guard requirement has turned many boarders off to the park; so now many of them are back on the streets and parking lots, especially the older boys. She is currently working on getting signatures for a petition requesting the City to eliminate the wrist guard requirement for skate boarders. She has visited many other skate parks and knows of no others which require wrist guards. Mr. Winklepleck noted that there are two other skate parks in California which require wrist guards. Mr. Martin felt that requiring wrist guards of on-line skaters, but not skate boarders would present enforcement problems for the skate park staff. Mr. Williams reported that attendance at the park has dropped tremendously. Commissioner Babcock felt that skate boarders should be allowed to skate without wrist guards. Commissioner Bats stated that the park was built for the kids, and if attendance has dropped because of this requirement, the requirement should be eliminated. Mr. Winklepleck agreed that it would be preferable not to lose the serious skate boarders. Chairman Tanner commented that the drop in attendance may or may not be because of the wrist guard requirement, and it could well be that many of the skaters have mastered the course, while others have found it too difficult. Commissioner Munson felt that it should be possible to enforce the wrist guard requirement for in-line skaters while allowing skate boarders to use the park without wearing wrist guards. Commissioner Scheurer indicated that he has had conversations regarding this issue with some of the users, and he feels the reason attendance has dropped is because of the wrist guard requirement. Councilmember Spiegel commented that part of the reason for the drop in attendance could be the $5 charge for an identification card, and suggested that the Commission make a recommendation to the City Council. Commissioner Barnes noted that paramedics prefer maintaining the wrist guard requirement. Commissioner Bats noted that skate boarding and in-line skating are two different sports, and it should be possible to require wrist guards for in-line 3 PARKS & RECREATION COMMISSION FEBRUARY 23, 2000 MINUTES skating, but not skate boarding, with which Commissioner Munson concurred. Mr. Martin felt that it would be difficult to enforce for one group, but not the other. Mr. Winklepleck noted that the JPIA conference established guidelines requiring helmets, knee pads and elbow pads, but the requirements did not include wrist guards. He added that staff is concerned about losing the users for whom the park was built. Action: Commissioner Scheurer moved, seconded by Commissioner Bats, to recommend to the City Council amending the existing ordinance, as long as the City Attorney concurs, such that wrist guards are optional for skate boarders. The motion carried unanimously. B.
