HomeMy WebLinkAboutOrd 963 Rescinding Wrist Guards Skakeborders PD Skate Park MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL FROM: JEFF WINKLEPLECK PARKS & RECREATION PLANNING MANAGER DATE: AUGUST 24, 2000 SUBJECT: REQUEST FOR CONSIDERATION TO AMEND ORDINANCE NO. 930 RESCINDING THE REQUIREMENT FOR WRIST GUARDS AT THE PALM DESERT SKATE PARK. RECOMMENDATION: By minute motion, that the City Council waive further reading and pass to second reading Ordinance No.963amending Ordinance No. 930 Sections 8.85.030 and 8.85.060 removing the requirement for wrist guards. II. DISCUSSION: Since the opening of the skate park in September of 1999, the park has seen a great deal of use and provided a tremendous amount of enjoyment for skaters from Palm Desert and surrounding communities. However, there has been a steady decline in attendance since Ordinance 930 was adopted in December which included the requirement that all skaters (inline and skateboard) wear wrist guards. Specifically, the number of teenage skaters has declined sharply. Staff has discussed the situation with several of the people who monitor the park for Coachella Valley Recreation and Park District and they concurred that the number of older skaters (13 and over) has dropped and the park is used primarily by the younger skaters (12 and under). Staff has also spoken to Dallas Williams from the YMCA and Rick Vincent from Sports Fever who confirmed that many skaters have decided to return to the streets and business frontages to skate rather than wear wrist guards at the park. The skaters have indicated that many tricks, especially grabs, can no longer be performed because of the wrist guards limiting mobility. Effectively limiting the types of tricks by requiring wrist guards has made the park less fun. Mrs. Colleen Commito has gathered a petition consisting of businesses and skaters requesting that the City change the ordinance to include wrist guards as optional for skateboarders as opposed to mandatory. The concerns that have been expressed regarding the need for the wrist guard requirement include the following: 1 1. The State law does not require wrist guards. 2. The additional requirement for wrist guards has significantly lessened the effectiveness and benefits of the skate park. The number of skaters at the park are down and many skaters have returned to the streets. 3. The City's insurance carrier does not include wrist guards as one of its requirements The sections of Ordinance 930 dealing with wrist guards are as follows: •Section 8.85.030 (D) D. The City has determined that wrist guards afford a significant measure of injury prevention. Therefore, in addition to the safety requirement required by the State, the City hereby requires any person using the skating area to wear wrist guards. •Section 8.85.060 (A) A. Any person using the skating area must wear a helmet, elbow pads, knee pads and wrist guards. The Parks and Recreation Commission discussed this matter at its February 23, 2000 meeting and recommended to the City Council that Ordinance be changed and the wrist guard requirement be made optional for skaters subject to City Attorney concurrence. The Public Safety Committee reviewed the matter at its July 19,2000 meeting and unanimously recommended to the City Council that the ordinance be amended removing the wrist guard requirement for skaters. Councilman Spiegel recently circulated information that was obtained at the latest League of California Cities regarding skate park As indicated, all of the cities reporting require helmets, elbow pads and knee pads, but none require wrist guards. The cities included Alameda, Mountain View, Santa Clara, Pleasanton, San Mateo, San Ramon, Antioch, Dublin and Fremont. The City Council also expressed some concern on proceeding with the construction of the beginners skate park based on observations of the skate park usage. Coachella Valley Recreation and Park District staff has been conducting peak attendance counts in the morning, afternoon and evenings since the beginning of June. According to the data provided, the numbers were highest in the evenings with peak numbers ranging from 39 to 110 skaters and an average of approximately 66 skaters. The morning and afternoon numbers were similar with average peaks of 8 and 10 respectively. The numbers of skaters in any one evening totals approximately 100 per the CVRPD staff. 2 As can be seen, the numbers indicate that the skate park is still the most used park facility in the city on a daily basis but the decrease in older skaters still needs to be addressed. These numbers can be used for comparison purposes should the wrist guard requirement be rescinded and the City Council wish to delay going out to bid for the construction of the beginning skate park to see if attendance improves. Staff recommends that the City proceed with the bidding process for the beginning skate park because a less advanced learning area is still needed and the restroom facility which is part of the addition is also needed. A delay in sending the project out for bid to see if usage increases will, most likely, result in construction not beginning until early 2001. If necessary, the City Council has the option to delay awarding the construction contract. A copy of the amended ordinance has been attached for the City Council's review and is available should the Council wish to proceed with an action on the matter. SKATE PARK Mr. Winklepleck reported that wrist injuries are more common among in-line skaters than skate boarders, but wrist guards inhibit skate boarders from performing some moves. Colleen Commito stated that her 15-year-old son is rated 2nd in California skate boarders, and it seems that the wrist guard requirement has turned many boarders off to the park; so now many of them are back on the streets and parkinglots, especially the older boys. She is currently working on getting signatures for a petition requesting the City to eliminate the wrist guard requirement for skate boarders. She has visited many other skate parks and knows of no others which require wrist guards. Mr. Winklepleck noted that there are two other skate parks in California which require wrist guards. Mr. Martin felt that requiring wrist guards of on-line skaters, but not skate boarders would present enforcement problems for the skate park staff. Mr. Williams reported that attendance at the park has dropped tremendously. Commissioner Babcock felt that skate boarders should be allowed to skate without wrist guards. Commissioner Bats stated that the park was built for the kids, and if attendance has dropped because of this requirement, the requirement should be eliminated. Mr. Winklepleck agreed that it would be preferable not to lose the serious skate boarders. Chairman Tanner commented that the drop in attendance may or may not be because of the wrist guard requirement, and it could well be that many of the skaters have mastered the course, while others have found it too difficult. Commissioner Munson felt that it should be possible to enforce the wrist guard requirement for in-line skaters while allowing skate boarders to use the park without wearing wrist guards. Commissioner Scheurer indicated that he has had conversations regarding this issue with some of the users, and he feels the reason attendance has dropped is because of the wrist guard requirement. Councilmember Spiegel commented that part of the reason for the drop in attendance could be the $5 charge for an identification card, and suggested that the Commission make a recommendation to the City Council. Commissioner Barnes noted that paramedics prefer maintaining the wrist guard requirement. Commissioner Bats noted that skate boarding and in-line skating are two different sports, and it should be possible to require wrist guards for in-line 3 PARKS & RECREATION COMMISSION FEBRUARY 23, 2000 MINUTES skating, but not skate boarding, with which Commissioner Munson concurred. Mr. Martin felt that it would be difficult to enforce for one group, but not the other. Mr. Winklepleck noted that the JPIA conference established guidelines requiring helmets, knee pads and elbow pads, but the requirements did not include wrist guards. He added that staff is concerned about losing the users for whom the park was built. Action: Commissioner Scheurer moved, seconded by Commissioner Bats, to recommend to the City Council amending the existing ordinance, as long as the City Attorney concurs, such that wrist guards are optional for skate boarders. The motion carried unanimously. B. DEAR PARENTS OF SKATEBOARD AND ROLLER BLADE ENTHUSIASTS: The Alameda Recreation and Park Department (ARPD) is excited about opening Alameda's hottest new attraction providing first rate recreational opportunities for non-traditional sports enthusiasts, the Alameda Point Skate Park. This is the first community built skate park ever constructed. More than 500 volunteers and thousands of dollars and materials and supplies were donated to help build this state-of-the-art 15,000 square foot skate park. This has been a wonderful experience for the people who participated in building the facility and for our community. As with all new facilities and parks, there are some growing pains that interested park patrons need to help the City address. Details of our concerns and how you can help are as follows: BICYCLES: Bikes are not allowed. The mix of bicycles and skaters is extremely dangerous. An enormous amount of research went into this decision. If you would like further explanation,please contact the Recreation Office,748-4565. Please do not ride your bike at the skate park. PARENTS- PLEASE DO NOT ALLOW YOUR CHILDREN TO RIDE THEIR BIKES AT THE SKATE PARK! - SAFETY GEAR: Helmets,elbow pads,and knee pads are required and must be worn..We also suggest wrist guards as wrist injuries are the number one reported injury in skating. HELMETS HAVE BEEN SHOWN TO REDUCE THE RISK OF HEAD INJURY BY AS MUCH AS 85% AND THE RISK OF BRAIN INJURY BY AS MUCH AS 88% (as reported by National Safe Kids Campaign). Of those who reported wearing a helmet,98%said they wore it for safety reasons, 70%because a parent or spouse insisted on it,and 44%because the law required it. PARENTS-PLEASE INSIST THAT YOUR CHILDREN WEAR THEIR HELMETS! SUPERVISION: It is strongly suggested that children under the age of 14 never be left unsupervised at the skate park. The park is open to the public and extremely busy. • . More than 75 enthusiasts have been seen using the park at the same time. The ages of users range from 5 to 45 years of age(and possibly older). It is important that parents supervise their children to ensure that they are as safe as possible by insisting they wear their safety gear,to make sure they are not interacting with potentially harmful strangers,and that they do not wander away from the park where they may encounter some type of trouble. VANDALISM& GRAFFITI: Skate Park users have been respectful of the park. However,vandalism and graffiti has become a major problem in the areas surrounding the skate park. Skating is not allowed outside or inside hallways of any building at Alameda Point. It is trespassing to do so. Trespassing skaters are ruining several buildings that are considered to have historical significance to Alameda and are important buildings for our community to preserve. PLEASE DO NOT SKATE ANYWHERE AT ALAMEDA POINT OUTSIDE OF THE SKATE PARK (with the exception of coming and going to the park). - LITTER: Please help us keep the park clean for safety,as well as appearances. Design of the ramp(s) do not exceed 5'3", on the east end two ramps are connected running the entire width of the park. A fun box 8'8" wide x 4' high is located between two ramps. The new cement park was designed by City of San Leandro Community Services Skateboard park staff to accommodate all levels of skateboardersfinliners. Santa Clara Parks and Recreation Department will determine the acceptability of safety equipment. GUEST POLICY Residents of Santa Clara are allowed to have one guest per calendar month. Guests are subject to all Skate Park rules,which includes providing emergency,contact information. Guests must be in the company of their Santa Clara hosts. Residents are responsible for the behavior of their guest. ' HOURS OF OPERATION The Skate Park opens and closes at different times throughout the week. Please check the monthly calendar for hours of operation.It is asked that children be picked up before closing time. A signed waiver must be on-file and each member must carry his/her own membership card to the park for each use. 2. No skater will be allowed to skate without wearing the proper safety gear which includes helmet, kneepads and elbow pads. NO EXCEPTIONS. 3. Adult must accompany skaters under 8 years of age. 4. Skating is not allowed on the streets and sidewalks within the 42nd Avenue Business District, including 41S`, 431-d, Olympic Avenues and El Camino Real. Please respect our neighbors. 5. Report any broken equipment, loose screws or unsafe conditions to the skate park attendant immediately. 14.Respect your fellow skaters and skate responsibly.No profanity. Experienced skaters shall give less experienced skaters a fair chance at the equipment. 15. Warnings will be issued by skate park attendants for failure to obey any of these rules or regulations or any reasonable request made by a skate park attendant or peace officer. Any user who received two warnings within a twelve-month period will have their privileges revoked for 7 days. Any user who receives 4 warnings will have their privileges revoked for 30 days. Any user receiving 5 warnings shall be permanently banned from the park. Police- issued citations for any infraction of a San Mateo City Ordinance related to the usage of the park or the conduct or behavior in and around the park, such as skating on the sidewalks and streets, etc. will be counted as two warnings. The skate park may be closed at any time and without warning when such closing will best preserve the public peace and prevent damage to public property. It is unlawful for any person upon or riding on or by means of a skateboard or in-line skates to go upon any public street or alley within the central traffic district as defined in Section 11.08.030 of the City of San Mateo Municipal Code, or in, upon or around City parking lots and structures, when appropriate signs giving notice thereof have been erected or painted on the pavement surface, except that such activity may be permitted if it is sponsored, operated and controlled by the City's recreation department. For purposes of this ordinance, the public streets and alleys include the public sidewalks located on either side of those streets or alleys or which exist in the median strips or any other location within the central traffic district. No person shall rollerskate, ride a bicycle or skateboard on any grassy area, path or walkway designated and posted exclusively for pedestrian use. No person shall leave a bicycle or skateboard in any place or position where other persons may trip over or be injured by it. No person shall ride or use a skateboard,roller skates, ,roller-blades or in-line skates at a City skateboard facility without wearing a helmet, elbow pads, and knee pads. Reasonable notice chall be posted at such facilities to the effect that any person riding or using a skateboard,roller skates,roller-blades or in-line skates in the facility must wear a helmet, elbow pads, and knee pads and that failing to do so is in violation of the Municipal Code and subject to citation as an infraction." Section 2. Sections B7-280 through B7-284 are adopted and compiled into the San Ramon Municipal Code as Chapter XV (Skateboards, In-Line Skates and Bicycles) of Division B-7 (Public Peace, Morals and Welfare): 316 Chapter XV Skateboards, In-Line Skates and Bicycles Section B7-280. Intent. Skateboarding and use of other rolling or wheeled devices on sidewalks and in parking lots is often incompatible with pedestrian and vehicle traffic thereby resulting in safety hazards. Additionally, performance of"tricks or stunts" with skateboards and similar devices has caused substantial damage to concrete and other improvements on both public and private property. The purposes of this Chapter are (a) to reduce the risk of personal injury to skateboarders and to the public in general and(b) to provide owners of private and public property with the means to protect their improvements from damage. Section B7-281. Definitions. For purpose of this Chapter the following definitions shall apply: (a) "Rolling or wheeled devices"means skateboards, roller skates,roller-blades, in-line skates, bicycles and similar devices but do not include vehicles licensed under the California Vehicle Code or wheelchairs for the disabled. (b) "Public or private property"means areas of property, whether in public or private ownership, which are ordinarily open to and used by the general public. Such areas include but are not limited to pedestrian walkways, business establishments, office complexes, shopping center common areas, parks, churches, school grounds, and other public facilities. (c) "Tricks and stunts"means singular or repetitive jumps, flips, grinds or any other trick performed for demonstration, practice or display of skill on a skateboard or other rolling or wheeled device. Section B7-282. Prohibited Acts. A. No person shall ride or use a skateboard or other rolling or wheeled device on private or public property which is properly posted pursuant to Section B7-283 to prohibit such use. Pushing or carrying the skateboard or other device on the posted property does not violate this Section. B. No person shall perform"tricks or stunts"with a skateboard or other rolling or wheeled devices on public or private property which is properly posted pursuant to Section B7-283 to prohibit"tricks and stunts". C. No person shall leave a skateboard or other rolling or wheeled device in any place where others may trip over or be injured by it. Bicycles shall be left in a bicycle rack whenever one is prohibited and there is space available. D. No person under the age of 18 years shall ride or use in-line skates, roller skates, roller blades or a skateboard in the City of San Ramon without wearing a helmet. 317 Section B7-283. Postings. A. The owner of public or private property desiring to prohibit "tricks or stunts" on such property shall post at prominent locations, including all driveways and open plazas, signs which read: "No Skateboarding, Skating or Bicycle Tricks or Stunts Allowed". Violators may be cited. San Ramon Municipal Code Section B7-283." B. The owner of public or private property desiring to prohibit skateboarding or use of similar rolling or wheeled devices on walkways designed for pedestrian use shall post such walkways with signs which read: "Pedestrian Use Only-No Skateboarding, Skating or Bicycles Allowed. Violators may be cited San Ramon Municipal Code section B7-283." Section B7-284. Enforcement. Any violation of this Chapter is punishable as an infraction. Posting by the owner of private property as provided for under section B7-283 shall constitute the request and consent of the owner of such property for enforcement of this Chapter by the San Ramon Police Department on such private property. Nothing in this Chapter is intended to limit other remedies at law available to owners of public or private property for damages caused by unauthorized use of skateboards or other rolling or wheeled devices on such property. Section 3. This ordinance shall take effect thirty(30)days from the date of its passage. This is an urgency ordinance needed to protect the public health, safety and welfare, and shall therefore become effective immediately upon its adoption. The reason for the urgency is to have adequate regulations in place by the time that the new skateboard park, currently under construction, is completed.
