Said property to be designated very low density residential (1-3 dwelling units per acre) and open space (O.S.) in the General Plan and prezoned PR-1 (planned residential one unit per acre maximum and O.S. Waive further reading and pass Ordinance No. 938 to second reading for Case No. C/Z 00-2 CITY COUNCIL STAFF REPORT CASE NOS. GPA 00-1 AND C/Z 00-2 MARCH 23, 2000 B. DISCUSSION: BACKGROUND: The Members of Ironwood, Inc., recently acquired a substantial piece of property from the Coachella Valley Water District. This property is adjacent to the southern boundary of Ironwood Country Club and the city boundary. The Members of Ironwood, Inc., desire to have this property annexed to the city of Palm Desert. The Planning Commission at its February 15, 2000 meeting reviewed this request. There was no public testimony (applicant was represented). The commission on a 4-1 vote recommended approval of the application, Commissioner Finerty voting nay. Commissioner Finerty expressed a desire to limit future development to no more than 60 dwelling units. As proposed there is approximately 100 acres zoned PR-1 which would allow up to 100 units although the applicant's current intention is to develop 40 to 60 single family lots. A. ADJACENT ZONING AND LAND USE: North: PR-7 / Ironwood Country Club South: County NA (natural assets) / Vacant East: Indian Wells / The Reserve West: County NA / vacant B. GENERAL PLAN DESIGNATION : The property is presently not included in the City General Plan. The County General Plan designates all of Section 5 as mountain. The east part of Section 5, including this property, is flat desert land. It is our intention to designate the area north of the dike, approximately 100 acres which includes several golf holes, very low density residential and this would be consistent with the applicant's desire to eventually develop 40 to 60 single family lots. The area south of the dike is to be designated open space (O.S.). 2 CITY COUNCIL STAFF REPORT CASE NOS. GPA 00-1 AND C/Z 00-2 MARCH 23, 2000 C. ZONING: All of Section 5 is currently zoned NA (natural assets) under the County. It is our intention to prezone the area north of the dike PR-1 consistent with the general plan designation of very low density residential. The area south of the dike is to be prezoned O.S. (open space). II. ANALYSIS: The applicant wishes to annex the property into the city. Part of the annexation process requires that the city prezone the property. The applicant has indicated that the long term goal is to develop the land with 40 to 60 single family lots, retain the existing golf course, flood control and other open space. The west portion of Section 5 has significant hills which could explain the county land use designation of "mountain." The area we are looking at in the east part of Section 5 is a drainage area, low foothills and existing golf course. We feel the proposed land use and zoning (very low density residential) is appropriate. The remainder of Ironwood Country Club is zoned PR-7 and designated medium density residential (5-7 units per acre). Pursuant to a request by Mayor Crites staff have pursued a easement agreement with the applicants to create a trail easement across a portion of this property south of the dike. As of the writing of this report we have not completed this agreement. We will report further to City Council at the hearing. 9 III. ENVIRONMENTAL REVIEW: The Canyons at Bighorn and The Reserve at Indian Wells are projects located to the west and east respectively of the subject property. Both these projects were approved pursuant to environmental impact reports which were recently prepared and certified. Based on the information provided in those documents we have completed the environmental checklist and responses and prepared a draft Negative Declaration of Environmental Impact. 3 CITY COUNCIL STAFF REPORT CASE NOS. GPA 00-1 AND C/Z 00-2 MARCH 23, 2000 The area is potentially within the habitat area of the bighorn sheep as delineated in the draft Bighorn Sheep Recovery Plan. Therefore staff will recommend that second reading on the ordinance and initiation of annexation proceedings will be held in abeyance until the environmental status is resolved. IV. FINDINGS FOR APPROVAL: The proposed prezoning which will become effective upon annexation of the property to the city will be consistent with the adopted general plan amendment. GPA 00-1 WHEREAS, the City Council of the City of Palm Desert, California, did on the 23rd day of March, 2000, hold a duly noticed public hearing to consider approval of the general plan amendment for the purpose of future annexation to the city of property generally located in the east half of Section 5, T6S R6E (south of Ironwood Country Club) and a Negative Declaration of Environmental Impact as it relates thereto; and WHEREAS, the Planning Commission by its Resolution No. 1972 has recommended approval of the general plan amendment; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 97-18", in that a Negative Declaration of Environmental Impact has been prepared and the Director of Community Development has recommended that it be certified; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to justify its actions, as described below: 1 . The proposed land use designation of very low density residential and open space is consistent with the existing land use in Ironwood Country Club and this represents the only logical extension of Ironwood Country Club and land use will be consistent with surrounding land use. 2. The proposed general plan designations will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the City Council in this case. 2. That the Negative Declaration of Environmental Impact is hereby certified, as shown on Exhibit "B" attached hereto. RESOLUTION NO. 00-36 3. That GPA 00-1 Exhibits "A" attached hereto which will become effective upon annexation of the property to the city.
