Resolution No. 02- 5 Recommendation: Waive further reading and adopt Resolution No. 02- 5 establishing a policy that requires private developers and homeowners associations enter into an agreement with the City of Palm Desert to share in the engineering, construction, maintenance and energy costs for signals installed at private entries. Background: Prior to 1995, developers and associations were required to participate only in traffic signal engineering and construction costs. In 1995, the City of Palm Desert began requiring private developers and homeowners associations to share in the costs associated with traffic signal engineering, construction, maintenance and energy costs. When a private development requests a traffic signal at its main entry, the City performs a study to determine whether or not a signal is appropriate at the location. The City then enters into a formal agreement with the developer or homeowners association to share in the costs for engineering, construction and on-going maintenance and energy costs. Up to this time, the policy has been handled on an informal basis with the developer or homeowners association willingly agreeing to share in all the costs. We have recently been put into the position of justifying this policy because without a resolution, the enforcement of this policy is being challenged. Therefore, we believe a resolution requiring the developer or homeowners association to pay their fair share of costs associated with signalization will benefit the City as a whole. WHEREAS, private developers and homeowners associations occasionally request the installation of a traffic signal at their private entries; and WHEREAS, the City of Palm Desert has installed traffic signals at various private entries where it has been appropriate; and WHEREAS, the City of Palm Desert believes that private developers and homeowners associations should share in all costs associated with the engineering, installation and on-going maintenance and energy costs of traffic signals; and WHEREAS, a binding agreement is needed for the enforcement of this policy.
