Waive further reading and adopt Resolution No. 2016 - 77 accepting
the offer of dedication of Lot "R" of the Palma Village Unit No. 7 plat map,
and Lot "A" of the Palma Village Unit No. 11 plat map.
Background
The Economic Development department has contracted with The Altum Group to
design improvements to Alessandro West, the area formerly known as Alessandro
Alley. The Altum Group is working with utility companies to ensure that there are no
construction delays due to utility conflicts. During their research, Coachella Valley
Water District (CVWD) discovered that the alley was never accepted by the County into
the street system, and that CVWD would be unable to relocate facilities within the
subject area until the alley is established as public right-of-way.
In 1946, the subdivisions that include the alley offered the alley to the County for public
use for street purposes. The County specifically did not accept the lots being offered for
street purposes on the plat maps for Palma Village Unit Numbers 7 and 11. However,
the public has been using the alley for street purposes since long before the City was
incorporated in 1973.
Although there are ways that the alley could be informally accepted, the City Attorney
recommends that the City formally accept the lots that compose the alley, specifically
Lot "A" from Palma Village Unit No. 11 subdivision map, and Lot "R" from Palma Village
Unit No. 7 subdivision map. The identified lots run parallel to Highway 111 from Las
Palmas Avenue to Monterey Avenue.

Fiscal Analvsis
The City has already been treating the subject lots as public right-of-way. Therefore,
there is no fiscal impact associated with this action.

RESOLUTION NO. 2016- 77
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, ACCEPTING CERTAIN OFFERS OF
DEDICATION WITHIN THE SUBDIVISION MAP OF PALMA VILLAGE
UNIT NOS. 7 AND 11, M.B. 21/16 & 96 RESPECTIVELY, RIV. CO. REC.,
UNDER PROVISIONS OF TITLE 7, DIVISION 2, CHAPTER 4, ARTICLE
3, SECTION 66477.2 OF THE GOVERNMENT CODE OF THE STATE
OF CALIFORNIA
The City Council of the City of Palm Desert, California, does hereby
DETERMINE, ORDER AND RESOLVE as follows:
WHEREAS, the subject acceptance of dedication is made pursuant to California
Government Code Section 66477.2.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PALM DESERT,
CALIFORNIA, AS FOLLOWS:
Section 1: That the offer of dedications described/listed and shown in attached
Exhibit "A" are hereby accepted; and
Section 2: That the City Clerk of the City of Palm Desert, California, shall
cause a certified copy of this resolution and order to be recorded in the office of the
County Recorder of Riverside County, California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert
City Council held on this 22"d day of September 2016 by the following vote, to wit:
