MINUTES
Wednesday, October 9, 2019

Approve the Minutes of the regular meeting held on September 11,
2019.

Commissioner Boren moved to approve the Minutes of
September 11, 2019. Motion was seconded by Commissioner
Campbell and carried 7-0-0 with Adney, Boren, Campbell, Darby,
Hauer, Miller, and Myrland voting AYE.
V. DISCUSSION ITEMS
A. ORAL REVIEW OF CITY COUNCIL ACTION — Mayor
Susan Marie Weber
Mayor Weber reported that the City Council approved the
three honorariums for the sculptures for placement at the
Palm Springs Art Museum in Palm Desert.
B. PLANNING COMMISSION REPORT — Lindsay Holt
Mr. Stendell reported that La Quinta Brewery will be located
near the DMV on Technology Drive.
Desert Wave will be on the October 15 Planning
Commission agenda.
C. ARCHITECTURAL REVIEW COMMISSION (ARC) REPORT
— John Vuksic
Mr. Vuksic reported the following actions from the
Architectural Review Commission (ARC).
Construction for Chick-fil-A was approved.
The Chandi Group was present to discuss a proposal for a
three story mixed -use project on Fred Waring Drive and San
Pablo Avenue. The project will be presented to the ARC a
few more times before it is approved.
Pink awnings for Lilly Pulitzer located between Coda Gallery
and Coffee Bean and Tea Leaf (San Pablo Avenue and
Highway 111) were approved.
D. PRESENTATION ON THE RALPH M. BROWN ACT —

Ms. Klassen distributed a brochure regarding the Brown Act
to the Commissioners, gave a brief presentation, and noted
the general rules. She noted that all committees and
commissions are reminded of the Brown Act periodically. All

meetings must be posted on the City's website and on the
Bulletin Board.
It is permissible for Commission members to attend the
City's gallery openings without having to post the event.
Subcommittees are permitted. If three Commission
members, for example, are at an event and the conversation
steers toward the City's public art, redirect the subject. Ms.
Klassen talked about serial meetings which entails a
Commission member calling another Commission member
to talk about an item on the agenda and then that member
calls another member, and so on; it is unlawful.
Commissioners meeting for coffee or lunch, etc. should be
avoided. All commissions/committees are subject to the
Public Records Act. Any City business conducted on
personal devices could also be subject to the Public Records
Act. Upon question by Commissioner Hauer, staff will look
into getting email addresses for the Commission members.
Ms. Klassen introduced City Attorney Robert Hargreaves.
Mr. Hargreaves concurred with Ms. Klassen's report. The
Commissioners can request staff to add a discussion item on
a future agenda.

VII. NEW BUSINESS
A. APPROVAL FOR THE ART IN PUBLIC PLACES
COMMISSION TO CURATE THE 2021/2022 EL PASEO
SCULPTURE EXHIBITION AND SELECTION OF UP TO
THREE COMMISSION MEMBERS TO SERVE ON A
SUBCOMMITTEE FOR ARTWORK SELECTION
Ms. Lawrence referred to the staff report regarding the
Commission to select three Commission members to serve
on a subcommittee for artwork selection for the 2021/2022 El
Paseo Sculpture Exhibition. Staff will ask the City Council
for approval to send out an RFP for selection of 18 artists
and four alternates. It was the concurrence of the

Also, staff is recommending a change in the contract
regarding the sale of a sculpture during the exhibition period.
Currently, if an artist sells a sculpture during the exhibition,
the contract states that it must remain on the pad for six
months after the installation date prior to removal of the
piece. The artist is to provide a sculpture to replace the sold
sculpture the same day the sold sculpture is removed.
However, this year Mario Pikus (whose sculpture was sold
before the six month deadline) did not have a suitable
replacement sculpture to place on the pad. Staff referred to
one of the approved alternate artists but the approved
sculpture was no longer available. The artist proposed
another sculpture, which was approved. Due to the sale of
Mr. Pikus's sculpture, an additional honorarium was paid to
the alternate artist and ads were delayed until the new
sculpture was placed. Staff researched similar programs
and sales were allowed during the exhibition but the
sculpture had to remain on display throughout the entire
exhibition period.
There was discussion of including a section of the exhibition
to be site specific (interactive, sound, light, emerging artists,
etc.). Ms. Lawrence stated that she liked the idea but noted
that having an interactive sculpture on San Pablo would be a
better location than on El Paseo. The El Paseo Sculpture
Exhibition does not present the opportunity for pedestrians to
stop and interact with the art that is placed on the median.
Also, there are no electrical hook ups that would allow for
sculptures that would require lighting or sound on El Paseo.
Ms. Lawrence reported that she will send out the RFP to
CAFE and as many artist opportunity links as she can.
There was discussion of adding wording to the RFP to
attract edgy, playful, etc. sculptures for the upcoming
exhibition.
Commissioner Adney moved to approve that the entire
Art in Public Places Commission curate and select eighteen
sculptures and up to four alternates for the 202112022 El Paseo
Sculpture Exhibition. Motion was seconded by Commissioner
Campbell and carried 7-0-0 with Adney, Boren, Campbell,
Darby, Hauer, Miller, and Myrland voting AYE.
There was discussion of the possibility that the selection
process of the entries may take longer than a full meeting.
Staff will ensure that the voting process will be efficient to

expedite the process. A second meeting will be scheduled
in advance, if necessary, to complete the selection process.

X. PROJECT STATUS REPORTS
A. Palm Desert Community Gallery
Ms. Lawrence reported that the opening reception for Robert
Bergazyn's show was held on Monday, September 23 and
was well attended. She thanked the Commission members
who attended the opening. Mr. Bergazyn's show will end on
November 15. Darleen Wilkerson's batik artwork will be on
display beginning on November 22.
B. Docent Tours
Ms. Lawrence reported that staff and one of the current
docents interviewed four docents and all were excellent
candidates. The training sessions will begin on October 28
and end in January.
Ms. Lawrence reported that she gave the First Weekend
docent tour at the Library on October 5 and had two visitors.
C. First Weekend
Ms. Lawrence reported that the First Weekend events will
begin on November 1 with STREET at the Westfield mall,
followed by Celebrate the Season at The Gardens on El
Paseo on December 6. Also, Brew at the Zoo will be the
First Weekend event in April.
D. Documentary Film Series
Ms. Lawrence announced that she is finalizing the schedule
of the films for the documentary film series. To -date she has
scheduled Yarn, Kusama Infinity, and Obey Giant. She is

still researching for a fourth film. The films will screen
January through April on the third Thursday of the month.
XI. REPORTS AND REMARKS
A. STAFF
Ms. Lawrence noted that there was a request to have staff
present the public art budget to the Commission. She
presented the budget memo that she provides to Mr.
Stendell that is then approved by the City Council. The total
public art budget is $145,850.
Ms. Lawrence reminded the Commission that the City
Council will present the National Arts Proclamation to the Art
in Public Places Commission at its October 10 meeting. She
encouraged the Commission members to be present at the
meeting to receive the award.
Ms. Lawrence reported that Large Steel Roots located in
front of City Hall at the east end (Fred Waring side) will be
relocated to Melissa Morgan's sculpture garden on El Paseo.
B. COMMISSION REPORTS
Commissioner Boren circulated rack cards for Corazon de
Mexico at the Coachella Valley History Museum that will be
displayed for two years.
XII. ADJOURNMENT
Chairperson Darby adjourned the meeting at 10:52 a.m.
