REQUEST: President's Plaza III Property and Business Improvement District
Formation

Final Engineer's Report
RECOMMENDATION
1) Open the public hearing and receive testimony from the property owners within
the district in favor of or opposed to the district formation.
2) Close the public hearing.
3) Instruct the City Clerk to open and count the written ballots received by the City
and report the results.
4) If a majority of ballots returned combined with the public testimony from the
property owners are opposed to the formation of the district, declare the
proceedings closed.
5) Or if a majority of the ballots returned combined with the public testimony from
the property owners are in favor of the formation of the district, adopt the
following four resolutions:
a) A resolution declaring the results of a property owner protest proceeding
for the President's Plaza III property and business improvement district
and approving certain related actions.
b) A resolution approving the final management district plan for the
President's Plaza III property and business improvement district for Fiscal
Year 2001/2002 and appointment of an advisory board.
c) A resolution ordering the formation of the President's Plaza III property
and business improvement district and the levy and collection of
assessments for said district for Fiscal Year 2001/2002.
d) A resolution approving the final engineer's report for the President's Plaza
III property and business improvement district, Fiscal Year 2001/2002.

DISCUSSION
The formation of the President's Plaza III property and business improvement district is
necessary for the property owners (not the City) to pay for the ongoing maintenance of
the public parking area which serves their business.
Pursuant to Council's direction if the majority of the property owners protest either by
written ballot or at the public hearing, the district will not be formed. Thus, the City will
not record the public parking easements received from the property owners; and the
City will not spend money on the proposed reconstruction and improvements to this
parking area.
Through several meetings with the property owners city staff's confidence level is high
that this district will be formed, thus, allowing the President's Plaza III parking
improvements to proceed this summer.
