SUBJECT: GRANT DEED OF PROPERTY FROM THE AGENCY TO THE CITY FOR
THE BARTLETT PROJECT AT PORTOLA AND HIGHWAY 111
Recommendation:
That the Agency Board, by minute motion, approve the following:
1) Approval of the Grant Deed to the City of the southernly four feet of the property,
for public improvements.
2) Authorization for the Chairman or his designee to execute the Grant Deed.
3) Authorization for the Chairman or his designee to sign documents for a lot merger
of the said property.
Background:
On January 14, 1999, the City Council and the Agency Board approved a Disposition and
Development Agreement (DDA) with Timothy Bartlett. The DDA covered that sale of 0.67
acres from the Agency to Mr. Bartlett. The Public Works Department will require that Mr.
Bartlett deed the four feet of property for additional right-of-way for the alley, which is
located on the southern boundary of the property. Staff feels that it is convenient for the
property to be deeded from the Agency to the City before property is sold. Mr. Bartlett, as
well, has requested that the property be deeded before we close escrow.
Mr. Bartlett has also requested that we merge the property from two lots into one
consolidated lot. Staff will process the lot merger through the Planning Commission as
requested. Staff is recommending that the Agency Board approve the Chairman or his
designee be authorized to execute the necessary documents to merge the parcels.

Staff is therefore recommending that the Agency Board approve the Grant Deed, the
execution thereof by the Chairman or his designee, and the authorization of the Chairman
or his designee to execute the necessary documents to process the lot merger of the
property. We have attached a copy of Mr. Bartlett's letter with his requests to this report
along with the proposed Grant Deed, and a map of the property.

dated June 11, 1998 and September 17, 1998, copies enclosed, I would like to take this

which must be ac mplished prior to cl se of escrow. Joe Gaugish has informed me that this
task may be perfo med in a timely man er pending Planning Commission approval.
