Should the City receive a Summons, please forward it to our attention. Liability appears to be problematic as there is an asphalt undulation that occurred in the bike lane which caused the bicyclist to be thrown from his bike. We are attempting to resolve this case with the claimant attorney. The claimant has made a demand of $150,000.00. The CJPIA has extended up to $100,000.00 to attempt settlement due to the extent of the injuries. The claimant suffered an acute comminuted and displaced clavicle fracture, and acute left-sided displaced fractures of ribs 2 through 9, acute displaced fracture of left coracoid process, a pleural hematoma adjacent to the fractured ribs, and a laceration to the left knee. The residuals are that as a result of the fractured ends of the Claimant’s clavicle healing over each other his left arm is now shorter and he has a more limited movement in his left shoulder and arm. He claims to have ongoing muscle tightness and pain in the left shoulder and arm region which causes upper and mid back fatigue and cramping when standing for long periods of time or lifting 30 to 50 pound items for work. The Claimant also claims ongoing numbness and tingling in his left shoulder, forearm and wrist. The symptoms are exacerbated when he works long hours at a desk or cycles long distances. He also claims to have continuing pain and stiffness in his neck, as well as a continuing adjustment of his right arm to compensate for his shorter left arm. The claimant also claims to more limited breathing due to the way his injury healed. He also claims to have continuing muscle pain, tightness and fatigue in his upper and mid back. The claimant has permanent scaring on his left knee and claims periodic stiffness, cramping and pain that emanate from his lower back and extend down to his left leg. William L.
